Attached is an email where Mr. [redacted] told me specifically not to have ANY contact with him except through my lawyer. Now if Mr. [redacted] needs his memory further refreshed I have EVERY email, text message and phone conversations recorded with anyone I have spoken to that pertains to Mr. [redacted] and Superior Builders.I have emails where Mr. [redacted] was in communication [redacted] (realtor) [redacted] where Mr. [redacted] specifically states the house was going to be completed no more than 30 days from Feb. 5 2017. This is third completion Mr. [redacted] has given us, only to be let down when the house was not complete on those said days. Now if Mr. [redacted] does not remember such conversation I can post the contents of those emails to refresh his memory. So Mr. [redacted] which is the truth and which is the lie, because you further stated that you told my realtor that you would be finished with the house by the end of this month. If that is the case. Then why did you request for us to sign and addendum to the contract that stated you would be completed by the end of Feb. and we would have the certificate of occupancy by the March 10 but never signed to addendum. Before you answer that be for warned that I have every email that was sent between Mr. [redacted] and my realtor that concern you and I.What I find truly disturbing is that Mr. [redacted] is still in business and that he continues to bully people and try to run off those who stand up to him and hold him accountable. My intentions now are to let everyone know how Mr. [redacted] treats the potential homeowners. Filing a complaint with the Revdex.com is but the beginning. I intend to make everyone is aware of how Mr. [redacted] operates his business and hopefully keep other unsuspecting people from having to deal with the same issues we did with Mr. [redacted].I have been involved in the construction industry on and off for the most part of my life and have never seen anyone treated like this. This is just one of those deals I don’t know what to do and can’t please the buyer.
The home was sold as a contingency that the buyer sell her other home first. The realtor never received a deposit. I heard the Buyers son just spoke to his mother very rude as well to the female realtor, when the...
son got rude with me over the phone the first time I ever spoke with him and within the first sentence, I simply handed the phone back to the buyer and said I am not selling you this house. Ms [redacted] told me she still wanted the house.
I stayed at the property working as the closing attorney and realtors kept calling me and begging for me to sell this home to Ms. [redacted] and I said only if we could agree to a reasonable “final punch” that we both agreed to. We both signed and that was a huge mistake, I wish I never saw these people and continuously offered to purchase the home back after more harassment from the buyers son. I believe now these complaints and letters are still from her son that also claims to be a home builder yet I cant find any background on him.
My buyers son has defamed my name numerous times and it hurts most on the internet, please read attached and let me know if you have any suggestions.

Attached is potentially helpful documentation. Just before [redacted] contacted the Revdex.com we had a verbal agreement that the Home would be complete by 3/31/2017 but he released us from contract 2/22/2017 (see “release”). There was a verbal agreement with the two realtors, seller and buyer because I refused to meet the demands for a contract extension from [redacted] and he at that time refused to sign a contract release (see “unaccepted extension”). We continued on and re-sold the home and had it substantially complete by 3/31/2017 (see [redacted] email from his realtor). I emailed the potential Buyer / Customer see [redacted] email from me).Our contract has standard terms as below and we offered many times a release from contract and return of the $2,000.00 deposit but the potential customer wanted to continue on with the deal until finally released 02/22 when we were so close to completion. “Builder estimates completion of construction within __working days from the start of construction, except for delays caused by changes or acts of Buyer, or persons employed by Buyer, acts of arbitration, failure of any subcontractor or materialman, fires, strikes, acts of public authority, inclement weather, allocation of materials priorities, delays or defaults by public or private carriers, shortages of materials or labor, acts of God, or other work stoppages, casualties, or other causes beyond the control of Builder. Contractors and Inspectors are also very busy and often there are unexpected delays in construction. We have just recovered from a huge economic down turn in the industry and now there are many labor issues due to the sudden massive recovery. We had communicated with the potential customer regarding the delays but the potential customer made many unreasonable demands that we could not meet in regards to extending the contract to purchase therefore we offered all monies returned and a full release of contract but the potential customer refused to accept a release until just days before project completion. I hate to lose any customer but I feel that in this case we were better off without this potential customer. All money returned to potential customer and a full release from contract was received. I have replied previously by email to the Revdex.com on 8/17/2015 to [redacted]. Please refer to that previous email as well as email attachments regarding this complaint.
Pre Closing punch list items that were agreed upon by buyer and seller are all complete. Warranty claims will be honored per written warranty given to purchaser at time of closing.
I have gone above and beyond and dealt with defamation and slander by the purchaser's son. I have an attorney representing me regarding these issue as I will pursue litigation.
However I still have tried my best to resolve my customers concerns but when we meet the purchaser in person she seems to not even understand her complaints thus leading me to believe these are more issues brought about by her Son?
#2- Not on pre closing punch list, separate written acceptance received by builder, recorded verbal approval by buyers son as well.
#4- Not on pre closing punch list, observed by builder rep. and functions properly.
#5- Replaced at day of sale and witnessed by multiple contractors, suspected either homeowner tore weather stripping during moving or maliciously damaged by other than Builder
#6- Not on pre closing punch list, 8/04/2015 carpenter was back on site again but buyer refused to sign off on repair "until all items were complete". This is unfair to the builder and representatives as we can't keep coming back. Either a repair is done or it is not. Just because something was done differently than the way someone else may do it, that it doesn't make it incorrect.
#7- Not on pre closing punch list, per licensed HVAC contractor plates are intentially left off to allow furnace to function properly,

#25- Fixed and accepted by buyer pre-punch list. Carpet does not get "sealed" by builder.

Builder representatives always immediately responded to Ms [redacted]. The siding issue was not on pre closing punch list, separate written acceptance received by builder that she was not "forced" to sign, recorded verbal approval by buyers son as well. Son was notified he was being recorded and was complimenting siding / aluminum contractor. Caulking is a normal practice at seams and where two different materials meet.
Response to paragraph 2:
Home was completed and inspected by local building officials as well as a certificate of occupancy was issued. All items on the pre-closing punch list are complete. This home was built as a contingency that purchaser must sell previous home before purchasing home from builder. Buyer never gave a deposit binding the contract and once buyers existing home sold the builder timely completed the new home. Builder actually refused to go to closing because of issues with buyer's son. At time closing was to occur the Realtors and closing attorneys begged builder to sell the property to Ms. [redacted] so finally the Builder gave in. After closing harassment by the buyers son began. I offered to refund purchasers money and buy the home back but the purchaser refused.

I have read the response from the builder which is not true. The builder himself has not contacted me and the original list hasn't been completed. The poor workmanship and failure to complete the home as some of the photos clearly represent has nothing to do with my son nor his advice given to me. I had several professional individuals perform a walk through all reaching the same consensus. I have stated nothing less than the facts. The builders comments are based on hearsay and an attempt to slander the integrity of my son who was cursed by [redacted] himself and witnessed by other parties of the community via telephone conversation. I did in fact pay a deposit, given by me to the realtor [redacted]. [redacted] of Superior Builders has obviously chosen not to finish my house in accordance with the contract. His first and only walk through of this house was conducted on the day of and approximately one hour prior to the initial closing. He has not nor subsequently became involved in resolution of the outstanding issues that currently stem from his efforts as a home builder. He has chosen to avoid the many construction issues which he has created rather than face them and resolve the items once and for all.
I only want what I paid for and that is a dwelling constructed per the contract free of workmanship defects and un-finished projects. Pictures tell most everything that of which I have. One of the many examples of what I have dealt with from Superior Builders is for instance the front door lock which would not engage as the door was shut (deadbolt only) - the builders crew leader [redacted] told me to slam the door as a fix. This is one of many examples that doesn't take an experienced trades person to recognize as a means to pacify my valid concerns. Again the builder has not called nor has he attempted to call me in effort to resolve these issues. Reading his response would only make me believe he is attempting to avoid ownership on the single family house I paid him to construct. I request that the case remain open and that the builder make an attempt to get this resolved without delay, thank you much.

For your reference, details of the offer I reviewed appear below.We are now at day 212 from the date that we signed the original contract , on August 16, 2016, to purchase the house which is now 92 days past December 14, 2016. The only delays that Mr. [redacted] of Superior Builders have incurred are those that are self inflicted. According to the Nation Weather Service we have had a VERY mild winter thus there should be very little days attributed to inclimate weather.f Mr. [redacted] has been in business for the 26 year, as he stated , I find it difficult to believe he would have grossly underestimate the time in which it would take to complete a house in Simpsonville, at this point 92 days, without coming to the conclusion that Mr. [redacted] of Superior Builders had no intentions of completing the house on or before the estimated completion date agreed on in the contract. It is my belief that Mr. [redacted] of Superior Builders and Mr. [redacted] of [redacted] of Shelby County, colluded to fraudulent misrepresent the completion date that was listed in the contract. Mr. [redacted] of Superior Builders has on several occasions tried to force us to sign a release and to refund us the $2000.00 that we paid as a down payment and as seen by past experience he will re-list the house at a higher price which gives him another reason to try to get out of the contract. We only wanted what we originally agreed to and that is the completion of the house within the timeframe given in the contract. Now if Mr. [redacted] wants us to sign a release we will be more than welcome to but we have incurred more expenses than just the $2000.00 we paid him as the down payment. We will sign the release only if he agrees to pay our expenses we have incurred concerning the house in question as well as the $2000.00 that we paid as the deposit.
