---- Forwarded message ----------From: <[redacted]@summitlandscapedev.com>Date: Sun, Dec 11, 2016 at 7:15 AMSubject: Fw: [redacted]To: "[redacted]@myRevdex.com.org" <[redacted]@myRevdex.com.org>[redacted],We received the complaint from the Revdex.com.  I'm not really sure how this works.Attached is a copy of the...

letter we received from the [redacted]s attorney and the last email correspondence that their attorney requested from us.  Below is my response to the [redacted]s attorney. These letters pretty much sum up the situation. After we received the letter from [redacted] we also retained a lawyer.  My letter was sent on September 7, 2016.  Summit has not heard a word on the situation from [redacted].  Our attorney has advised us not to discuss the situation any further.I hope this helps you!Thank youMike B[redacted]Summit Landscape Development, Inc.Cell    ###-###-####Office ###-###-#### X[redacted]@summitlandscapedev.comFrom: [redacted]@summitlandscapedev.comSent:... ?September? ?6?, ?2016 ?3?:?02? ?PMTo: [redacted].comCc: [redacted], michael b[redacted],As requested by [redacted] in our conversation on 8-29-16, attached is the last email  from myself to **. and [redacted]. [redacted].  This email explains what Summit was willing to do for [redacted] and [redacted] to try and rectify the situation.  At this point I would like to retract any offers.  Summit does not feel it is responsible for any water loss in their pond since we did not hear a word from them in over 9 months. We installed a large landscape project for the [redacted]s  starting in September 2013 and completed it in the  Spring  of 2014.  This project included many different components including a pond, waterfall and spillway.  The project took  longer than we anticipated due to many factors including the following; snow came early that year, we were very busy, and we were short handed.  The Crew leader that that built the original pond also left the company on good terms over the winter to start his own pond business.  I think this disappointed the [redacted]’s and made them unhappy.  From that point on, [redacted]. [redacted] became demanding and hard to please.  She criticized and would insult our work, insisting that we do things 2 and 3 [redacted]es until it was acceptable to her. It reached a point when I could not handle her any more because she would yell at me through emails and phone conversations.   At that point, I informed **. [redacted] that I would no longer speak with her and would only speak with Mr. [redacted] regarding the pond.Over the next year I would be called or emailed and told the pond is leaking.  I would head over to the [redacted]s and water would be splashing from the falls all over the patio due to debris blocking the falls.  I have been trouble shooting and repairing ponds for over 20 years.  You cannot lose hundreds of gallons of water from a pond this size a week and not see where it is going.  Summit even went to the extent of removing all the stone and boulders from the pond to inspect things to make the [redacted]s happy at no expense to the customer.  This was a three day process. After another hot Summer(2015), Summit had another pond company come check out their job as per Mr. and [redacted]. [redacted]’s request.  We contacted Song Bird Ponds and asked the owner, Roger Sears to reseal the spillway as per his suggestion that that was the only place it could be leaking.   This occurred in October 2015.  The next time the [redacted]’s contacted Summit was June 2016. Summit does not understand how the pond did not leak for 9 months and the [redacted]’s then decided that it is our fault and are seeking compensation.  We do not know what circumstances occurred during that period of [redacted]e.  A chipmunk may have chewed a hole in the liner or some other factor may have arisen.  I have seen this happen many times.  There had also been another contractor working with this pond which is stated in the attached email, who could have caused damage or introduced any unknown changes.I reached my limit of frustration when the [redacted]’s sent me an estimate from another contractor to rebuild the pond and make it bigger.  Why should Summit have to pay to make the pond bigger? In summary, [redacted]s paid for this project in full in the spring of 2014.  The pond is running to this date, however, they want me to pay another contractor $11,000 to build a bigger pond when my original quote to them was $7,000.  They are a rare customer that will most likely never be pleased with the final project.  Summit will not be working on this pond from this point forward and will also not be spending any more money on a completed and fully paid for project.Thank youMike B[redacted]Summit Landscape Development, Inc.Cell    ###-###-####Office ###-###-#### X[redacted]@summitlandscapedev.com
