Initial Business Response /* (1000, 5, 2016/03/23) */
My name is Ashraf A[redacted], Attorney at Law. I am speaking on behalf of my client Summit Auto Sales.
At the time before the purchase, the customer was given every opportunity to inspect the vehicle himself, or have a third party inspect the...
vehicle. This customer was also afforded an opportunity to drive the vehicle.
At the time of purchase, Mr. W[redacted] signed several documents that are attached to this response. These documents are very clear and conspicuous in identifying that the customer was purchasing the vehicle WITHOUT a Warranty. It is unfortunate that the vehicle is having mechanical issues, however, as the terms of the agreement between Mr. W[redacted] and Summit Auto Sales, my client is not responsible for repairing the vehicle. As Mr. W[redacted] indicated in his complaint, at the time of the sale the vehicle was working properly. After the vehicle leaves the lot, there are many things that could have happened to the vehicle that would make it malfunction. We have no way of knowing if this vehicle was involved in an accident, or if a mechanic was working on the vehicle and caused damage to it. Regardless, the agreement attached indicates that Summit Auto Sales will not offer a warranty.
Furthermore, there were no oral warranties or representations made related to this purchase. On the contrary, Summit Auto Sales did everything in its power to inform the customer that he was buying this vehicle without a warranty (please see attached documents).
My client will gladly respond to any further correspondence related to this matter. But according to the terms of the contract signed by Mr. W[redacted], my client is not responsible for making any repairs on said vehicle.
Initial Consumer Rebuttal /* (3000, 7, 2016/04/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not agree with what is being said, and will pursue legally if need to be. I was given a warranty, and was reassured that the warranty was good at any ford and thousands of garages across the united states. Further more I was told that the vehicle was the vehicle was in tip top shape and there was no issues with it. The car lot was misleading and dishonest, there for I do not wish to close out the case.
Final Business Response /* (4000, 9, 2016/04/07) */
The warranty that the customer is referring to is actually a Service Contract from a third party that was purchased along with the vehicle. There is a significant difference between a warranty and a service contract, and I suggest that the customer seeks legal help to discover the difference.
Again, my client sold the vehicle without any warranty, and therefore they are not responsible for any repairs that the vehicle may need after it leaves the dealership.
