This is a complaint regarding a stay in PEI. I am not a resident of PEI and during the month of November I was there on personal business. There was never possibility of my staying in the province beyond Nov 30.
On Oct.31 I made a verbal agreement with ***, Suites of Euston, from the hotel through his employee, for a hotel stay of 30 days, the month of November. The agreed cost was $700 plus $75 parking. A security deposit of $700 was given at that time. I explicitly told him it was for November only and asked that there was no minimum stay longer than a month required. At that time I asked for receipts for the payment and received two: one for the cost of the room $700, and a second of $700 stating it was for the security deposit. I have both those receipts. On Nov. 6th I left the province and have not returned.
My business concluded early than I expected and on Nov 6 I checked out of the room returning the room keys and asking for only the $700 security deposit. The employee at the hotel said he couldn't do it, only the owner could and he was out of town. At my request he called the owner in my presence and told him the circumstances and the owner said he would return the security deposit when he returned. Again at my request I had the employee give written acknowledgement of the return of the keys, the proper state of the room (no damages), and an statement saying *** would return the security deposit on his return. I have the this written statement. At that time I left my email address and phone number asking for the a notice to be sent when the credit card refund transaction was done including the transaction number.
After approximately 10 days nothing was done and I telephoned *** and was told by him that he was still away and it would be done when he returned at the end of that week.
After approximately another 10 days nothing was done and I telephoned ***. At that time he tried various evasive excuses until I told him I had in writing the previously stated written acknowledgement. He then stated he would talk to his employee about it and ended the call.
After approximately another 10 days nothing was done and I emailed *** on Nov 28th demanding the return of the $700 and stating I would make complaints and take legal action in claims court, etc. He again said he would return the $700 by Dec 1. This was the second time in writing he acknowledged had no claim to this money. I have this email.
By the third week of December nothing was done and I emailed again demanding the return of the $700. There was no reply to this email. Two months later nothing has been sent.
The facts contained here are 100% true and accurate and have not been embellished or exaggerated in any way -all the documentation supports them. Copies of all of it including credit card statements showing no refund transaction can be sent to you. This is not a case of a misunderstanding, in fact it is not a case of dispute of ownership. It is simply someone not returning what knowingly is not theirs. For the sake of some brevity I have not included some details for further support these facts. I can send copies of the documentation at any time.
This purpose of this complaint is not simply the return of the $700. It is to put the complaint on record here and later with other organizations like yourself.
