Review: Based in United States, sudosurplusllc has been an eBay member since Dec 15, 2005. I responded to the sale of one Gateway E4300 P4 HT Hyper Threading 3.2GHz 1GB RAM 80GB DVD CD-RW XP ProUp for sale is a Gatway E4300 Desktop Computer. This computer is in great working condition, guaranteed not to be dead on arrival. This computer has been inspected by a CompTIA A+ Certified Computer Technician.I paid the asking price $79.99 with the guarantee of being fully inspected and running. What I received is a Gateway E4300 piled with dirt and dust that does not work. Arrived tied up in a garbage bag which seemed unprofessional but I hooked it up and tried to start it. It is dead and sometimes in shipping parts can shake loose. Opened the case to discover it had not been touched as the coating of dust didn't have any fingerprints until I looked inside. Now this seller states that if I pay the return postage they will refund my purchased price."No, I don't think so because they never sent me what was described in the original sale." It is not my place to supply the cost in return shipping of this disgustingly dirty desktop. My time is valuable and it is my request that this seller send me the computer I paid for in the first place. Currently up for auction is another Gateway E4300 Desktop and I've asked to be sent this computer along with my payment of an additional $12.00. eBay seems to think that this seller has made their best offer and I do not agree. I am owed a working, inspected Gateway E4300 as advertised in the first place. This seller also scammed one other purchaser while sending something dead and not as advertised. If I can't have the proper Gateway E4300 sent to me then I expect a total refund without having to pay return postage. eBay is notorious for allowing bad deals like this go wayside with seller support.Desired Settlement: Currently up for auction is another Gateway E4300 Desktop and I've asked to be sent this computer along with my payment of an additional $12.00. eBay seems to think that this seller has made their best offer and I do not agree. I am owed a working, inspected Gateway E4300 as advertised in the first place. If I can't have the proper Gateway E4300 sent to me then I expect a total refund without having to pay return postage. I have submitted pictures of the thick intact dust.

Pictures and a description of the item purchased were posted in the listing on ebay.com. I shipped the item that corresponds with the picture and description using the same methods I have for thousands of other transactions. If a buyer changes his or her mind about a purchase or disagrees with the description after receiving the item, he or she is welcome to follow the procedures outlined in the return policy clearly stated in the listing and outlined below: Return Policy: After receiving the item, contact the seller within 30 days. Refund will be given as money back. Buyer is responsible for return shipping costs. This policy was displayed to the buyer before purchasing. Instead of wanting to return the item, Ms. [redacted] requested that a replacement be shipped free of charge without having to return the item. Since this item is now sold out, Ms. [redacted] requested a different, more expensive, item be shipped instead, prior to returning the original item. I have not denied this buyer a refund. I have notified the buyer nine times that I will refund the full amount of original payment once the item has been returned and I am currently awaiting a response from the buyer. Thank you for your time, Andrew Sarver

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.I should not be responsible for the cost of return shipping in order to receive a negative deduction from my purchasing price. Obviously this seller falsely advertised what he sold to me as "inspected" and guaranteed to run. This Desktop was filthy and packed with dust voiding any responsible decision making on the seller's behalf. I have complained to other major businesses when a product has failed and without asking they have immediately mailed me a replacement at no charge. Therein they also apologize for their error and appreciate my business and hope that I will again purchase from their site. (Example: order a pair of reading glasses and was sent the wrong frame. I responded in an email that it wasn't the style I originally ordered. Did not request an entirely new pair to be shipped but was waiting for email instructions on what I should do? Of course I will buy from them again and I have ordered a 2nd set of reading glasses. Also I do not hesitate in advertising their excellent business and products.) All I've asked is that I receive the Desktop that I originally ordered be sent to me. Yes I requested a higher priced model of around $10.00 and I offered to pay $12.00 toward that purchase. You mean to tell me that now I must purchase a shipping box, packing material, and postage so that this neglected Desktop can be again resold? eBay is allowing fraudulent advertising soliciting money from a sector of people hoping to save money with the promise of these sales making the seller a continuous profit. This is not proper business ethics and I remain concerned about the fact that I have to pay all the fees to return this when it was guaranteed to have been inspected by a highly trained technician. I remain unsatisfied as written on this seller's eBay messages and as promised I notified the Revdex.com regarding my concerns awaiting my receipt of a working desktop. There was so much dust gobbed in hardened formation it caused me to get ill with a severe head cold: This is unacceptable and a violation of a customer's trust in truth of sellers merchandise.
