I have two main issues with the fence. First in his quote he said the spacing between pickets would be 1/8th of an inch. The spacing ranges from 1/8th inch to 3/4 inch. Spacing is not consistent. I asked him about it and he said the boards were not sawed evenly and he would not fix it. (Does this statement indicate he put inferior pickets?) He first stated the spacing would expand once the boards dried out; I told him I thought they would contract once dried. That's when he came up with the irregularly cut pickets the lumber company gave him.
My second and probably the most important as far as water drainage from my neighbor. When they went to install the new posts, the ground was so wet from a heavy rain instead of cutting off the old posts close to the ground and leaving the ground untouched, they managed to totally pull the posts out of the ground causing gaps/large holes in the land and they scattered the mud that was left on the bottom of the old posts or left it piled up thus causing the gaps and holes. When asked Stranger Creek about fixing the large gaps under the new fence, he told me he didn't do any work on the ground area only the fence. But I told him he created the gaps; said he installed according to standard which measuring 5 inches from the bottom edge of the vertical posts from ground (again he said that was the standard) and the pickets should be 1 inch from ground. The land slopes to the North; so shouldn't the top of the pickets slope if the land slopes? It does not; all of the picket tops are even throughout the fence except in one spot. I asked why the top of the pickets are so even and don't vary according to slope of ground. Again he told me he isn't concerned with the ground; he only cares about the TOP of the pickets being totally straight.
I really am dissatisfied with the fence and would like for him to fix it. His quote clearly states 1/8th inch spacing but he is refusing to fix it. He did throw some dirt on the largest holes and then told me as he left, I should get the dirt away from the bottom of the fence as the dirt if left will rot the bottom of pickets (huh, but he is the one who put the dirt there?). He refused to fix the rest of the gaps and clean up the mess they created on the neighbors yard. Also he was SO ANGRY that as he was leaving he told me he didn't want to do any more work for me EVER!!.

I texted her and told her I would get it fixed. I plan on going out there next week. I have every intention of getting it fixed.
I just realized the response was attached. Sorry. Mr. didn't specify how he was going to fix the fence. My original request was to reinstall the pickets. Its been six weeks and the spacing has changed dramatically. In addition one section of the fence has bowed; don't know if this part can be fixed or will need to be replaced. I also think the supporting vertical boards need to be replaced in that section. I need a date he will be here and how he plans to fix the pickets; reinstall or replace.
I have heard nothing from Mr.. I have filed a case in small claims court and will let you know the outcome.
