SUMMARY: The breeder acted unethically in relation to the sale of a show standard American Hairless Terrier puppy which eventually resulted in the Buyer being forced to return the puppy yet incurring costs and emotional stress.
List of Issues relating to the transaction (more detail and evidence can be provided)
- Breeder sold a show quality puppy with defective tail without informing the Buyer till she arrived to collect the puppy
- Puppy sold with skin issue on head, along back and on the tail which breeder said was an allergy
- Breeder prescribed a medication for said allergy but vet indicated it was not the right medication and was 125mg when a puppy his weight should not receive more than 50mg
- Puppy had issue with extreme urinating. Buyer thought maybe UTI. Breeder agreed and suggested take to a vet. Tests kept coming back indicating issues but Breeder said vet was exploiting me and I should not take the puppy back. Then gave ultimatum to decided to return the puppy in a few days without the buyer having a diagnosis. Buyer was forced to return the puppy
The Breeder and Co-breeder ganged up on the Buyer. They were rude and harassing and gave an ultimatum regarding the puppy which meant the Buyer had no choice but to return (incurring costs of $1,180) for no product

Refund I would like to receive the costs back from this transaction which there was no option other than for me to return the puppy
A woman name *** called my husband's number to inquire about a puppy. She was told by my husband that we had a male puppy available for $1,000 without papers. She was fine with that and mentioned that she wanted a nice pet as she was very active herself. At end of that phone call she stated to him she wanted to purchase the pup and would be over at a date she had given us on a future weekend. She had then called back on a different evening stating that she wanted to do agility with him and asked if we could give her UKC papers. My husband asked me and I said yes, NOT charging her full price of $1,500 that is normally charged. When she arrived to pick up her pup she mentioned concern that the puppy had a curl tail and that it could not be shown. I explained that he had a slight curl, the fault would be in having a ring tail. Per UKC Standards (which is the registry for the pup)
Tail
The tail is set on at the end of the croup. The natural tail is thick at the base and tapers toward the tip. When the dog is alert, the tail is carried in an upward curve. When relaxed, the tail may be carried straight out behind the dog. The tails of the coated variety dogs may be docked. If so, docking should be between the second and third joint of the tail.
Faults (both Varieties): Bent tail; ring tail.
Disqualification (both Varieties): Natural bobtail.
As you can see, an upward curve is desired. I showed her a photo of a champion of mine with the exact same tail (The pups father). At that point she could have backed out as she had not put down a deposit yet or paid and not proceeded with the purchase. She chose to proceed and purchase the puppy. She paid me $800 that day, still owing $200, which she stated was sent through PayPal but I had not received.
She sent me multiple messages stating how great he was and that she loved him over the next few days. A few days later she messaged complaining about him and his tail. She stated that she should have been made aware of his tail, etc. I replied that we already had discussed his tail when she was at my house. At that point I offered to take the puppy back and replace with another, she declined.
Then the messages came advising me that she was taking him to the vet to get checked as he was urinating frequently, which she had posted on *** about as well as the extreme amounts of water she was making him drink. I agreed that was a good idea and advised her to keep $200 of the $1000 purchase price that she had not paid me yet to go towards the vet bill. After taking him, she messaged me a copy of the vet bill which showed cost for an office visit and urinalysis. Nothing abnormal was found so she decided to take him back to the vet the next day and they ran another urine test as well as blood work. She stated to me that the only thing found was that his Urine Specific Gravity was 1.004 (see attached guidelines for normal range).
He did have some slight skin irritation when she picked him up, being a hairless breed, skin issues can be common, just like with people. He was on an antibiotic that was sent home with her, prescribed by a vet, not a breeder-who would be unable to prescribe meds.
She was offered at this point to bring back the puppy and she would receive a full refund of her $800. I advised her that I would take him to the vet when he got back to me and cover the costs. I offered this even though the contract clearly states the buyer has 72 hours to take the puppy to vet to be health checked and can return the puppy at that point for a full refund. At this point we were 7 days past her purchase/pick up of the puppy. She was not forced to do anything, she was given the option to keep the puppy which I had accommodated her with the $200 towards vet bills, or return him for a full refund. She decided a few days later she would bring him back. As far as a co-breeder, I am at a loss as to who she was speaking of as there is no co-breeder for this litter and the co-owner of StoneyBrooks Xolo has never spoke to or messaged ***.
I cannot understand her costs of $1,180 as she was refunded her full purchase price of the puppy. I fulfilled the contract and even allowed her to return the pup 10 days after purchase for a full refund, even though my contract that she signed states 72 hours. I had even offered to take him back and have him vetted myself which she declined and made the choice to incur the costs.
The pup is now with my sister where he has been since he came back after being watched for any symptoms and vetted. He has not had any issues, vet check was clear, holds his urine very well for a pup of his age and he is healthy. I had repeatedly asked for the vet reports and she has not provided any of them, which were supposed to come to me with the pup. I stood behind my puppy and returned her money in full and took back a healthy puppy. I don't believe there was much else I could do, and I went above and beyond what many breeders would have done.
