Good Morning,Ms [redacted] had entered the diver training program stating that she could not lift anythingMs [redacted] failed to notify us of the fact that her doctor indicated a likely hood of a spinal fracture was the deciding factorHer breast cancer was not the deciding factor in not proceeding with her trainingOn her medical clearance, the doctor stated that she “had a high probability of a spinal fracture” which was not disclosed prior to her contacting usThis condition on the medical form written by her doctor was of great concern to us concerning our liabilityThese conditions were not made clear by Ms [redacted] prior to contacting usShe completed the knowledge portion of the training prior to presenting us with the medical form signed by her doctorThere was never any mention of the probability of a spinal fracture prior to her applying to us for trainingWhile we strive to make every customer happy it became clear that whatever we did would not satisfy Ms [redacted] Upon learning of her complete medical condition, we contacted the legal department of the national training agency and our insurance company, both advised us not continue training Ms [redacted] As she had completed the knowledge portion of the training and had written in her educational materials we offered her a refund on the unused portion of the programThe was unacceptable to Ms [redacted] Our company has the greatest sympathy for Ms [redacted] ’s condition and wish her wellShe was welcome to return any item she purchased in an unused stateThat offer was declined by Ms [redacted] Sincerely, [redacted] ***President Stone Oak Scuba LLC
