Hello,Stillwater Community Management was hired by the Spring Mesa HOA to preform property management for the HOA. One of the items the Board wanted to focus on was residents leaving trash cans outside, within view of their neighbors or the street. Last week, *** *** was sent a
courtesy notice. This is a notice sent out to make residents aware that they may be in violation of the Governing Documents of the HOA. *** *** was not issued a violation nor was there a fine attached to this notice.Community Manager, *** *** was out on vacation late last week and had a message on email and voicemail stating that fact and that she would be returning on Monday, she was unable to answer *** *** immediately. *** *** called SCM offices no less than times from Thursday to Monday.*** *** was upset that he got this notice and eventually spoke to *** Bristol. *** told him that he did not know about the letter but that *** would get back with him on Monday. We are sorry that *** *** felt *** *** was rude. It is our goal to give everyone great customer service.Attached is a copy of the page from Spring Mesa's Governing Documents regarding trash storage and an email from a Spring Mesa Board Member confirming that trash was indeed being kept at the side of the house, within view of the neighbors/street. *** ***Stillwater Community Management

Hello, the HOA had been in contact with the complaintant for at least a year regarding the trees in question She got approval to plant these trees on HOA property with the understanding that they would be of short statureAs they grew, the trees were taller than anticipated The HOA
asked her to remove the trees which she kept promising to do but did notThis started in the fall of and then again in the early spring of 2017. They were not removedThe HOA Board requested that the HOA landscaper remove the treesThis happened I met with the resident and explained that the trees were on HOA property and that I would do what I could but the HOA Board refused to compensate the homeowner

Complaint: [redacted]
I am rejecting this response because: I told them I was going to remove them before the trees sprout and they did not deny that. They removed my trees without notice and they lied that my property don't belong to me. They also planted two ugly crappy trees in my property without my permission. That's ridiculous.
Sincerely,

[redacted] received an email last week with an apology. SCM strives to provide excellent customer service. SCM apologized for the interaction and will continue to work diligently to provide good customer service and always improve.
Complainant is a member of the Aspen Hills HOA and SCM is the contracted managing agent of the Aspen Hills HOA. Complainant is bound by the recorded Declaration of Covenants, Conditions and Restrictions (CC&Rs) as a member of the HOA and SCM is bound by contract and under the direction of the Board of Directors to enforce the CC&Rs. Two responsibilities of an HOA member is to inform the HOA of valid contact information and to provide a copy of any current lease documents if the member’s property is rented. SCM used the USPS mailing and email address provided by the complainant to inform the complainant about issues regarding mailbox repair and processes for getting mail during repair. The complainant had not updated his email address once that address became outdated. A third party received the emails about the mail retrieval process and began asking questions and making complaints about that process. SCM did not have a record of the name of the person requesting information about the complainant’s address, did research to determine if the requests were valid and determined the requests were not valid. During the course of this research, SCM also determined that the HOA had no record of lease for the complainant’s address, nor a valid email address. SCM requested from the complainant a copy of the lease and gave the complainant 10 days per the CC&Rs to comply with the request or further action may be taken. SCM also requested a valid email address. The complainant provided the lease copy within 10 days, confirmed the correct email address and requested a statement of account from the HOA. SCM confirmed receipt of the documents and informed complainant that no fines or fees would be levied on his account via email to the new, updated address. SCM also provided the requested statement of account. Several days after this exchange of emails, the complainant made an additional request for a statement of account. SCM wrote the attached letter confirming the complainant was in compliance and no fines or fees would be levied on his account, included a copy of the statement of account and mailed the package via USPS to the complainant’s address of record. By law and under the CC&Rs, this action satisfies the complainant’s request for statement of account. SCM acted in accordance with the HOA’s CC&R, our managing agent contract, with Colorado law and complied with all valid requests by the complainant. For these reasons, SCM does not believe there is any basis for the complainants claim or complaint to the Revdex.com.
