The attorney preparing the deed for the seller in compliance with the contract did not add the language that Mrs*** requested due to a conflict in opinion of law. *** ***, the attorney who prepared the deed, refused to put the language because the language will NOT create a valid joint tenancy with right of survivorship. According to ***, the Texas statue requires a written agreement between the partiesThe deed was prepared and delivered to the title company on April 21, after hours and too late to deliver to Mrs*** prior to closing on April 22, 2016. We provided all this information to Mrs*** at closing but she refused to read the information and did not want to talk to *** ***To be clear, the title company does not prepare legal documents or give opinion of law to customers on estate matters or any other legal mattersMrs*** was talking in a very loud tone to the closer and assistantShe stated very loudly that she was not going pay the attorney that prepared the deed and demanded to speak to management. Mrs*** addressed me in the same manner and I asked if she had an attorney to advise her and she said no because she was an attorney. I explained that she was not paying the attorney for preparing the deed and it was a seller charge and that if she did not want to close we certainly were not forcing her to close. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.
Mr. G[redacted]'s recounting of the events is factually incorrect. He did not ask me if I had spoken with an attorney about the deed language--the language that I had asked to be inserted was from the advice of the real estate attorney that I had hired to review my contract and title documents. Moreover, Stewart Title should have provided me with a copy of the deed prior to the morning of closing, as I had repeatedly requested. The closing was scheduled to take place the day before and the information to complete the deed had been given to the title company a month prior. There is no reason why the deed was not prepared ahead of time to allow me and my attorney a chance to review. Moreover, Mr. G[redacted]'s assertion that I was speaking loudly is no excuse for his unprofessional and inappropriate treatment of me and my husband. At that point, we were basically held hostage in forced to go through with a closing that we otherwise were not comfortable completing because we had to move out of our old house. I have also filed a formal complaint with the Texas Attorney General's office based on the behavior of Mr. G[redacted] and Stewart Title.
