Complaint: [redacted]
We are rejecting this response because: First, this project is for [redacted] and [redacted]. I understand that only [redacted] signed the contract but the job is for both (husband and wife) of us. On September 20, when [redacted] finally came out to look at the job, we were informed that we were suppose to prepare the ground for the concrete pad. Being a homeowner and not in construction we were unaware of this at the time the contract was signed. According to [redacted] we were suppose to dig the footings six inches below the grade before he started. We were also suppose to spread the dirt, gravel and sand for him. We found this out on September 20, after he did the work. In our first complaint notice we said that we paid 1/3 of the contract amount, which was a typo, as we had paid him 2/3. We paid [redacted] $8.00 a square foot for a concrete foundation, which is high for our area. In addition, we paid for all the gravel and sand separately as [redacted] had initially requested. We did not request [redacted] to build the pad as though it was an extra job. We assumed it was part of the job. Blueprints and barn drawing was provided prior to contract being signed. [redacted] wrote down the wrong square footage in the contract. He wrote 4,165 sq ft instead of 4,177 sq ft. As the owners, we need to know what is added work, before doing the work, not after the work is done. We paid to have a contractor provide us with a concrete foundation and we now have a useless pad. We will not sign another contract with [redacted] when they cannot fulfill the first contract. We signed a contract for a concrete foundation, paid 2/3 of the bill and he is asking for additional monetary funds for a useless slab. We want a concrete foundation and we want it done right. We provided him with a list of problems, which he agreed needed to be corrected, however, he wants more money to commence work. The list of problems that we provided him with were as follows: Need 12" wide footings, need 4" slab, rebar should not be touching ground, need 18" center on top mat, need 5" in natural ground on high side. Now he has informed us that the slab should be 6" below grade. Well it is on grade not below grade so there's another error. We have had to give up some of our dreams for a state of the art horse facility due to this big loss. I'm, [redacted], 94 years old a WWII Veteran and I will not be able to recover this loss in my life time.

Thank you for your time. In regards to [redacted] project. This job was bid on grade, meaning that the pad the foundation was to be close to level in preparation for setting forms. It was not! The far side was 30 inches low. We worked through that by setting forms 32 inches on back...
side. Owner agreed to pay for fill material which was stated in contract. They used my labor to build pad at my expense. added labor was in contract and Owner refused to pay. Square footage on this job was wrong. Owner wanted all slope to the middle of breeze way and water to be pushed to the outside of foundation, then Owner goes to California and calls after I had already graded job and says she wants to change the grade, so I changed the grade. So at this point we put steel in place. Set drops and foundation is ready to pour. We had a massive rain and I took incentive to take steel back out and regrade this foundation. Are there some issues with this foundation now. Yes, but minor. I did meet with the Owners yesterday to proceed forward with job. And I am willing to do so as soon as My labor is paid on the front end of this contract. I feel like I have went out of my way under the circumstances set before me. I would like to work these issue out if possible, and willing to work toward that. In contract it states that any added work will be added to the cost of this project and to be paid on second part of this contract. That obligation has not been fulfilled by Owner. Owner stated that she would not sign any change orders and stated that there would be no more money paid on this project. Owner called me as well and told me to not come back to this project. One more statement.I have been around construction most of my life and I know that to every problem there is a solution. I am very easy going and willing to work with anybody. Lets find a solution that works for everyone and move forward. Thank you for you time
