This issue is almost a year old. There was nothing wrong with the wheels he purchased. He contacted the credit card company which opened a case (which is usually very easy to win) and he lost. Last week, this issue was heard in small claims court and he lost again.I am attaching my
response to the credit card company last September. If I can be of any assistance, please do not hesitate to contact me.*** *** ***Star Tire
[redacted] is a long time customer who has brought several vehicles to us over the years. He did indeed purchase a set of [redacted] tires on 3/13/2017 for a total of 595.34 ($148.83 per tire complete). He returned a week later with a tire that had a hole in it and was driven flat....
Both of those circumstances are not covered by [redacted]'s warranty which I have attached a link to here: [redacted]. It states that road hazards are not covered by the manufacturer. This is the same warranty that [redacted] ([redacted]'s parent company), [redacted] and many other tire manufacturers offer. As a courtesy to Mr. [redacted], we offered to replace the tire at substantially below our cost, $74.41 including tax, installation and balancing. I have been contacted by [redacted], who [redacted] contacted about his disappointment in the tire. They told me, and told him, that we went above and beyond what our obligation was. We stand behind and honor all manufacturers’ warrantees. Although there was no warranty in this situation, we did our best to satisfy our customer, by splitting in half what he paid for the tire. As for his request for an apology, I am truly sorry that he felt we were rude. As for his claim that we did not stand behind our products, we defer that to [redacted], who dictates what is covered under their warranty. [redacted]
Complaint: [redacted]
I am rejecting this response because: What Mr. W[redacted] says in inaccurate. [redacted] did not tell me that Star went above and beyond what it had to do. [redacted] said that since Mr. W[redacted] no longer had the tire that they had to believe his story. [redacted] said that I had the right to ask for the defective tire and have it evaluated by one of its dealers. Mr. W[redacted] employees did not tell me this and now they have disposed of the evidence. Also, Mr. W[redacted] now claims that the tire had a hole in it. His employees told me that it was missing a valve. He can't even maintain a consistent storyThis matter is simple. I bought a tire. A week later after hardly driving on it, the tire failed. Of course I drove on it while flat because I had to drive to a safe place to fix it. A good business stands behind its products and workmanship. It treats its longtime customers fairly and does not hide behind warranty technicalities.
Sincerely,
