surcharges are illegal in the state of California, this is not a surcharge it is a service fee to off-set the cost of accepting any card for such a small purchase. This was a preferable alternative to requiring a minimum purchase that would cause the customer to spend much more than .50 on items they did not want. A minimum purchase could also drive away potential customers.
The store does have a sign posted saying that there will be a store service fee of .50 for all debit or credit purchases under $10.00.
The issue of the service fee being taxed has been resolved and will now show as a non-taxable item.
