I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. While Spring Green has visited my property and offered a solution that is acceptable to me, they have not begun to initiate action on their part. They promised a full refund of the cost of the fertilizer appliactaion and I have been told the check has been mailed but I will wait to receve it and cash it before I clear them of their obligation. Also they prmiosed an application of iron fertilizer to rebuild the roots of the lawn. This has been scheduled but not happened. I agreed to water the affected areas prior to them returning and I have done that. So, to date it has been all words on their part and no action. When all is completed than I will pass judgement on their action and release them from my claim.

Initial Business Response /* (1000, 5, 2016/04/19) */
Our mailings are sent out thru a seperate business who
we send our database to. They run names/address against the Do Not Mail list. This list is run in January for a 3 part series in mailings. Our computer data is updated each fall with...
corrections to the proper names for each address. This is a national database update so I do not know why their name is not with said address unless it is because it is a rental property. We have not had contact with this individual until this year. We have since totally removed their address from our database but the business who handles our mailings already has said information. Also if their name is not listed with said address this fall it may be in the database update again as we progress with our mail campaign.
Initial Consumer Rebuttal /* (3000, 7, 2016/04/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We have recently moved to this address and have been inundated with mail from previous tenants and also from businesses like yours. That is why we have opted out via Do Not Mail and DMAChoice. We have zero intention of using your business services so this is wasted marketing dollars for you as well as our environmental resources. At no point did you tell us it was only updated once a year in the fall - that is quite ridiculous given that a database should be easily accessible to remove a name when requested; you still have a responsibility to work with your businesses to honor customer requests rather than shirk that responsibility. Let me make this very clear: WE DO NOT WANT OUR ADDRESS IN THE DATABASE. It should not be this hard to honor.
Great folks to do business with

I would like to detail circumstances that are surrounding this complaint. First, unlike many business organizations a lot of what we do and how we do it depends on the weather which of course no one can control. For instance, most herbicides are recommended to not have any water on it for at least five to seven hours. This can be very frustrating when trying to meet a deadline of applying our treatments. All of our treatments are applied at the recommended rate provided by the product label and we follow those recommendations. Crabgrass is one of the toughest grassy weeds to control. Timing is everything when it comes to preventing it, however as I mentioned above due to weather this can be very frustrating. Unfortunately not everything is 100% including the effectiveness of the treatment. We apply a crabgrass pre-emergent in order to "control" crabgrass germination as best as possible. There are some catches to the treatment however. If there is too much rain then the pre emergence can quickly ware off. If the treatment is applied too soon then it may not provide coverage for the entire season. If the treatment is too late due to the "weather" then the seeds may have already germinated. So, as you can see there are many elements that can be impossible to control. At Spring-Green we aim to give the customer the best quality and professionalism possible. I hope this may give some in site to the circumstances and that all may be resolved. In conclusion, we will be happy to apply four free visits next year at no charge. If there are any further concerns or questions we will be happy to answer them.Sincerely,[redacted]OwnerSpring-Green Lawn CareConsumer Response /[redacted]/as for the crabgrass.the month he was to treat for crabgrass.he missed completly and his answer to me when I complained was he has been so busey he just missed me.as for the weather. I did not see any problem.but to resolve the complaint the four free visits next year at no charge .will be ok, thank you very much [redacted]Final Consumer Response /[redacted]/
Review: The services that were provided were not authorized by both the homeowners of this residence. I am the co-mortgagee of this property, therefore, as the state of Wisconsin laws pertain to community property, I have 50% say and fiduciary duty with respect to the property. Spring-Green never provided any written agreement or obtained my permission or authorization to provide any services at the property. To add to that, when the service personnel did arrive onsite, it was without a pre-call to my husband and we had guests staying at our house from mid-August through early November (which I verified with my husband. I called Spring-Green when I saw there was a notice and an initial bill left on my door, paid an invoice and spoke to [redacted] and advised him of the above and asked him to kindly send me in writing the agreement of what services were being performed at what rates and when as well as asked about the notifications services that were to be performed prior to entering my property. Once I had a chance to review this I would approve the service and would have no problem continuing the service as long as the service was in agreement with said written contract and satisfactory. He said he had no problem dong this for me.
When the next invoice arrived for 10/1/2014, I pay on net 30, I went to pay my bills on 10/31 and noticed I still had not received any paperwork from Mr. Good so I called him. I advised him I preparing to make the payment right then, but that I had not received the information as promised. I received a hostile response from him in which he called me a " [redacted] it" and that "Spring-Green has over 3,000 customers and they didn't send out that kind of information and didn't need customers like me" and proceeded to hang up on me.
First, I filed a complaint with the Revdex.com, I thought, online, but I could not find it online, therefore, I am filing this again. Immediately after I had accessed the Revdex.com, I called the Corporate office # ###-###-#### and spoke with an Administrative Admin who was giving this message to someone who handles these specific customer relations issues with franchises, but no-one ever called me.
I have now received another invoice charged interest. I want this addressed. I thought again about just "letting it go" but the simple point in fact is this, if a company is gong to do this to me, they are going to do this to everyone. I am not one ESPECIALLY as a 25 year IT woman professional to be talked down to like I am an it, cursed at and patronized. On top of that being addressed like a fool for asking for something which I am legally entitled to, which was kindly offered to me, then refused, I know my rights and the law (helps that I also went to law as well).Desired Settlement: You will write this bill off, apologize and NEVER contact me again or return to my property.

Review: I regularly receive unwanted solicitations from this company, Spring-Green Lawn Service, over the past year. I have contacted them on several occasions, via mail,
and have returned the brochures, offers, promotions, flyers, letters, etc., explaining that I am not a customer, have never contacted them for any reason and want
our name and address removed from their mailing lists.
They fail to comply to this request.Desired Settlement: I simply want my name and my address removed from unwanted solicitations from this company so as not to receive any future mailings.

Response:
We have one promotional mail campaign per year which runs from late February to early April, the campaign involves 3 mail pieces being sent to the same list of prospects and is our primary way of attracting new customers. Prospects are single family home owners who live in neighborhoods where we are already doing business. These mailers are promotional pieces and nothing more. They are not contracts, do not insinuate that the recipient has ever been a customer or that they have previously contacted us about service. When we are notified that someone does not want to receive our promotional offers we mark our records accordingly so they will not be included in future campaigns. The complainant notified us in writing that he did not want to receive our mailers after he received our first piece of our 2013 campaign, we marked our records accordingly adding him to our do not market list. Before we could acknowledge his request he received the second of our three mailers and subsequently sent us another letter saying that he had filed a complaint. Last week I wrote the complainant a letter to acknowledge his request and to explain that once the mail campaign is put in motion in February that an individual piece cannot be removed from a bulk mailing campaign that includes thousands of pieces. We have mailed thousands of these promotional pieces over the years and have never received a complaint of this nature, a simple phone call to our office is all that is needed to stop future campaign mailings and allows us the opportunity to explain that we send three mailings over a 6-9 week period and once they have been delivered no future mailings will be sent.
