We have tried to work with Ms*** on a number of ocassions, but for purposes of this complaint I will address each section of the complaint individually First, there is no requirement in her lease listing how often her grass is to be mowed and on what dates The lawn at that
unit is mowed once a month as per our contract with the lawn care company Second, Ms*** calls and texts our office sometimes as much as to times a day It is impossible to keep up with her communicationOften, she complains about maintenance issues that are over exaggerated or simply non-existentI have personally traveled to her unit to inspect issues and found them not to be present For example, in September, 2014, she complained of mildew on a board in her bathroom closet I and two maintenance personnel traveled to her unit to personally inspect and remedy and found the closet dry, free of mildew and in proper working order Despite these issues, I have made necessary repairs to her unit over the last year in the amount of $when they were valid and present Third, Ms*** is very difficult to communicate and has violated her lease Last summer, we tried to negotiate a new lease with her and she refused to come to our office to sign the lease In order to be served with a notice of rent increases and lease violations in January, 2015, it was necessary to secure the services of a process server at a cost of $to ensure she received the information as she has avoided legal service On at least one occasion, she has changed the locks to her unit door and the outside door to the building without our permissionShe has been assessed fees for this violation that she has not paid During an appraisal, her random lock changes made it impossible to access the unit to complete our work and required the appraiser to make a return trip at an additional feeMs***'s solution to all of this was to have the appraiser come to her apartment at 7:p.mat night, which she later was unavailable to do when we agreed to do so Fourth, Ms*** is in the process of eviction She has until March 1, 2015, to pay her charges for her lease violation and has sent us written notice that she refuses to do so As that is the case, we will be filing an eviction against her in Justice of the Peace Court on March 5, In conclusion, there are no current valid maintenance issues pending on this unit that need attention Our company currently has a percent occupancy rate and we have many return clients who have renewed their leases and brought other rental business to our office by way of referral We are very proud of our work here in San Antonio Thank you for your time in considering this response I hope this letter is a sufficient response to this complaint God Bless, *** ** *** *** Broker/General Partner Spiros Realty LLC *** *** *** *** *** *** *** *** ** *** *** San Antonio, Texas *** (210) *** (Direct) (210) *** (Fax) ***@sbcglobal.net

To Whom This May Concern:                   I am in receipt of your response to my complaint to Revdex.com Corporate Office.  I would like to take the time to respond to your allegations towards me and also include a resolution we can both agree upon.  I feel there has definitely been lack of communication from you that could have easily resolved any of the issues at hand.  I know that I am a good tenant, I always pay my rent on time, I have not damaged the property, and when issues arise I inform the landlord like any normal tenant would do.                   First, in response to the grass maintenance, I am not sure if it is in the lease or not about how often it gets cut, but there were times when grass was left unattended to for months and made the house look unattended to and unoccupied.  As a good paying tenant, and in the best interest of your property, pictures were took and sent to you so that you could see how it made the dwelling appear.  I have been a tenant for a year and a half now, and I only want what is best for the property while I am a resident.                   Second, there have been times where I tried contacting you several times throughout the day because I felt, as a single mother of a 5 year old, that there was a maintenance issue that could affect my daughter’s health and/or wellbeing (suspected mold, unmaintained lawn for safe play).  I feel if you would have responded accordingly the calls and/or text messages to you could have been avoided.  There are still maintenance issues that have been left unattended to that I have requested months ago to be fixed, for instance, the bottom lock to the front door to my unit still does not work properly, the rotting boards around the skirting of the house have still been left unattended to, the windows in the unit need to be caulked or something as the window does not touch the window pane and causes a lot of cold air to enter the house.  This problem has affected my winter [redacted] electricity bill to sky rocket because I am have to keep heaters on so the house can be warm for my child.  I have not seen any maintenance issues that would cost $850 to fix because the most that has been done is a ply board being nailed up in the bathroom closet, which has already fell, and the kitchen sink being caulked due to a leak.  There was a water pipe that busted in the front lawn, but I don’t think that the amount to fix that should be included in what was fixed for my unit.                   Third, I feel that I am a very easy person to communicate with, if you try.  I feel there has been a lack of communication from you since you took over for [redacted].  There are days and sometimes weeks between a text to you about an issue until you finally respond to the matter.  I am unaware of how I could have violated my lease as I feel I have done nothing wrong.  I have paid my rent on time every month for the past year and a half; I paid off the amount that was owed to you for the remaining balance of the $500 deposit; I have not caused damage to the property and when issues arise I report them to you as I feel a tenant should be able to do without getting harassed for doing so.   Further, when the new lease was to be negotiated, I spoke with a young woman at your office letting her know that because of my work schedule and location it would be impossible for me to come into your office during normal business hours, she then suggested that she would mail a lease to me, which was never done.  I then received a text from you a few months later stating that I would be on a month-to-month lease and my new rent would be $725 a month which includes the rent of $675 and water of $50.  I have been paying $725 a month, on time every month, since September 2014.  I feel your need to hire a process server to deliver a letter to me was unnecessary. I have never had any legal issues with you, and I feel a certified letter would have been adequate; also, the letter is accusing me of changing a lock I did not change and forcing me to make a payment of $225.00 for something I did not do and a water charge that I am unaware of because I am paying $50 a month for water already.  If I had a reason to replace the locks, I would have contacted you first because that is not my position to do so.  The locks were switched sometime last January/February when [redacted] was the landlord still, the only thing I can think of is that the maintenance man did not leave the proper keys in the lock box.  As far as the appraiser situation, I tried providing you with a copy of the keys, I stated I was able to meet during my lunch hour to make copies, but you never responded.  I then suggested a 7pm meeting time since I work late and have to pick up my daughter from daycare, it is true I had to cancel that day because something with my child came up, I offered to reschedule for the following week giving you dates and times, but you never responded.  You then proceeded to change the locks instead of trying to effectively communicate with me.                   Fourth, the process of eviction that you are planning to proceed with is absurd! I am a good paying tenant with a clean record and have kept the unit I live in clean and undamaged, as well as living in the unit without any disturbances to others.  There is no reasoning for an eviction. You are trying to evict me for the $225 charge you a lock I did not change and a water charge that I am unaware of because I have been paying $50 for water included in my rent of $725.                   Lastly, I believe there are still maintenance issues at hand that should be addressed and I hope that contacting you in the future can be done more easily and affectively with a response from you.  I would appreciate that you consider dropping the charge of $225 for a lock I did not change.  Also, I would like proof of where you are getting the balance from for the water charge you are trying to bestow upon me as I have included $50 payment a month for the water with my rent.  In the past I received water bills and they were only $35 a month, so I know that I am over paying for water as it is, thus making me unsure of where this charge is coming from.                     In conclusion, I would like for you to reconsider filing for eviction because I do feel I am a good tenant.  I am looking into moving, but with my daughter attending Pre-K at [redacted], moving during the school year is extremely difficult and stressful.  There are not a lot of properties for rent in this area, and it is not guaranteed that she will be accepted into another elementary school.  I am looking into moving sometime this summer due to the following reasons, the new neighbors upstairs being very disrespectful and causing conflicts late at night until the early morning making it difficult for my daughter to get her rest for school, the lack of communication between tenant and landlord, and the lack of maintenance.  I thank you for considering me and my daughter to still occupy the dwelling as to a move right now for us would be very difficult and because I do pay my rent on time and respect your property.                    Thank you for your time and attention, and I await your written response.
