As we stated earlier, we are a lease financing company based in New Jersey. We buy point of sale and credit card equipment leases from all over the country. Vendors from whom we buy the lease do not work for us. When we buy a lease from a vendor, also known as ISO - Independent Sales Organization,...
we send him/her our contract / lease agreement papers so they can have the merchant /business owner sign the contract, provided they agree to the terms and conditions. These leases are for 12 to 48 months. In addition to signing a legal contract, before we buy the lease and pay the vendor, we call the merchant and ask him/her whether the machine is installed and working properly. We also make sure the business owner fully agree with the monthly payments and the terms and conditions of the contract, in case they did not read the contract. We record this conversation after informing them that we are doing so.This is similar to leasing a car. If you lease a car and get the financing from a “BANK” and after signing the lease and getting the financing if you have a problem with your car or if you get a better deal, you cannot call the “BANK” with these issues. They will ask you to contact the dealer or the company from whom you bought the car. We have not received any lease payments since March 2017. We called the business and spoke to Ms. [redacted], who signed the contract. She said she is not the owner. We informed her that as she signed the contract she is responsible for the remaining payments. A person named Ms. [redacted] [redacted] sent us letters claiming she is the owner of the business & stating that she is terminating the contract with us. In this case, we bought the lease from a vendor named [redacted] [redacted]., [redacted], ** 48083. This lease ([redacted]) for “[redacted] [redacted]” was signed by Ms. [redacted] for 48 months. We paid [redacted] after Ms. [redacted] signed the contract. As Ms. [redacted] is not willing to pay for what we paid [redacted] after Ms. [redacted] signed the contract, we have sent this contract to our attorney. Once the papers are sent to the attorney we are not allowed to contact Ms. [redacted] or her company. Please have Ms. [redacted] or her attorney work with our attorney to resolve this issue.
Complaint: [redacted]
I am rejecting this response because:
As I stated earlier, I was told by [redacted] to fax a letter stating why we were switching Credit Card Companies and he would take care of this. I don't remember talking to anyone about any contract, but I do know the machine was not EMV compliant. I am not the owner of [redacted] and [redacted] the owner never sent letters stating I was the owner. I am an employee of this small business.
