SPC Homes sold us a home with a water well open permit and in code violation and home warranty issues and has avoided our call and contact attempts.
We currently bought a home on Feb 21, 2020 from the builder SPC Homes owner Lazaro Rodriguez. We received a notice from the Public Health Department regarding our water well being in Code violation because it is not at least 75 feet away from the neighbor's septic and drain field. The well has an insufficient bladder tank that does not deliver the appropriate and adequate water pressure to our home and it was not dug deep enough as well. My husband and I have made multiple attempts to contact the builder and no luck in resolving the issue. We've also filed a home warranty claim regarding other issues in the home and haven't heard anything back either. We've called their number which now seems to be an "non-working" number and have also emailed them. I've contacted my realtor which has made attempts to contact the seller's agent and still no resolution. We have exhausted our time and patience on the matter and are forced to proceed with legal advice. This issue is preventing us from moving forward with placing a chlorinated system for the well thus continuing to place our family's health in jeopardy due to the "brownish and metallic/iron smell and taste" that comes from the well water. I'm hoping that you can shed some light on the matter and direct us in the proper path in order to be able to rectify the issue at hand. Sadly we are not the only ones that SPC, Homes Lazaro Rodriguez has done this to. Thank you for your time.
We seek for the water well permit to be closed, a new well within county code to be placed with the appropriate bladder tank and dug appropriately and for our home warranty claim to be resolved by repairing what needs to be repaired ASAP.

We have not stated we are going to file a suit. We posted on social media asking others to see if they were having the same issues as us and if so how did they proceed. Those who commented on social media told us we should seek legal council because it has happened to them and that is what they did but never did we say we had a lawyer or that we were in the process of getting one. Those who commented on social media also stated that they have contacted Mr. L and his SPC Homes company and he has not returned their calls or emails. We would like for this to be resolved by the builder because it is his wrong doing from the start. As a matter of fact, I contacted the public health department representative who has been overseeing this issue regarding the open permit of the well and he informed us that Mr. L advised him that he was going to take care of the well issue, yet we haven't heard from him. He has been avoiding us. I don't understand how he has the time to be on social media regarding my comments and others instead of resolving the issues.

The business keeps stating they cannot respond to our request because we are obtaining an attorney which is false. The business is basing this from social media posts. Yes it is true that a post was posted on social media regarding to know if other consumers in the neighborhood have had the same problem and if so how did they proceed. We did receive inputs from many neighbors stating their opinion with regards to the matter and some stated they've had issues with this business one who actually filed suit and recommend we do so ourselves. Last time we checked it was not illegal to ask others for their experiences and opinions and recommendations. It is not illegal to get feedback from professionals either which does not imply we have secured an attorney. Unfortunately we don't have the funds to proceed legally and that is why we are seeking to have this matter resolved. It would be prudent for the business do due its due diligence and fix what was stated would be fixed especially when this was told to the public health department who has cited us for something we have no fault in. It is really sad for a business to do this to a consumer knowing that it is not the consumers fault or responsibility. All we want is for the problem to be fixed.
I have two outstanding warranty claims with this business and I've tried contacting them multiple times.

I have filed many warranty claims with SPC and they have taken care of most of them. Honestly, some of these could be classified as "user errors" ; however, the two issues I've cited, plus a third one (front door handle falling off), still need remediation. I have spoken with Marcy about this a few times and I feel that she has sincerely tried to contact their vendors regarding these claims, but it's still taken way too long. On top of this, SPC Homes has pretty much stopped responding to my inquiries. I bought this house with a 10 year warranty, and I expect this builder to stand behind their product.

We reviewed customers warranty concerns and found them to be non-warranty issues. Those warranty requests were closed and we now consider this complaint closed. The issues outlined in the above complaint are considered maintenance and or owner responsibility not warranty issues.

Well, these two items were entered BEFORE the expiration of the initial one year warranty, which was supposed to cover everything. If you don't want to replace the door handle, then fine as this is a newer thing that occurred about a month or so ago. Still, this doesn't mean that the other two items shouldn't be covered.

I still don't agree as the items were left on the buildertrend warranty section for quite some time. I had the impression that these would be resolved, but that never happened. If they were not going to be worked on, then they should have been closed right away and not left to linger, and thus providing me with false hope.
