He apparently had no intention of giving me what is owed.
A FEW YEARS BACK, I BELIVE 2003, SPANKY'S TREE SERVICE (OWNER TRACY [redacted] WAS CONTRACTED FOR PROPERTY CLEANUP, TREE TRIMMING AND THE REMOVAL OF A LARGE MAPLE TREE. HE NEVER WAS ON TIME ARRIVING TO THE SITE. HE CANCELLED ONCE BECAUSE HIS BUCKET MAN DID NOT SHOW UP FOR WORK. THE EMPLOYEES PLAYED AROUND, DAMAGED A DOWNSPOUT AND REMOVED A LARGE RIVER ROCK FROM A STONE WALL. HE HAS A HABIT OF NOT HELPING HIS WORKERS. HE DOESNOT LISTEN TO THE PROPERTY OWNER WHEN HE WAS TOLD TO NOT TOUCH PICK OR OTHERWISE DISTURB THE CHINESE / JAPENESE LANTERNS ON THE PROPERTY. HE REPEATEDLY PICKED THEM, PULLED THEM APART AND REMOVED THE SEEDS. TRACY STATED THAT HE LIKED PUSHING MY BUTTONS BY NOT DOING AS THE PROPERTY OWNER REQUESTED. HE REPEATEDLY ASKED FOR ITEMS LOCATED ON THE PROPERTY THAT HAD NOTHING TO DO WITH THE CONTRACTED WORK.
THE WORK PERFORMED BY THE WORKERS (THE YARD CLEANUP, TREE TRIMMING AND TREE REMOVAL) WAS ACCEPTABLE. TRACY [redacted] WITH HIS ACTIONS, REFUSAL TO LISTEN TO INSTRUCTIONS FROM THE PROPERTY OWNER, DESTROYING FLOWERS AND TRYING TO IRRITATE THE PROPERTY OWNERWERE UNACCEPTABLE.
On [redacted] Spanky's Tree Service company was in my next door neighbors yard at [redacted] cutting down a large Oak tree in the back yard. In the process of cutting down the Oak tree, Spanky's employees dropped part of the tree onto my property, destroying a 14+ foot tall French Lilac tree which I had been cultivating for the past 10+ years and which made up a large part of the privacy barrier between yards. Spanky's employees made no attempt to inform me of the damage while willingly and knowingly entering onto my property and removing all evidence of the destroyed tree from my property without my permission. The neighbor, whose yard Spanky's company was working in, came and informed me of the damage, at which time I took pictures of the company truck in their yard and pictures of the destroyed tree. My neighbor also contacted Spanky's and informed them of the damage, yet it took 3 more days before I heard from the owner, [redacted] At which time he made it perfectly clear that he did not want to pay actual costs to repair my property, stating he wasnt going to pay 4 - 500 dollars but he might give me a couple hundred and that it would come out of the employees pay. On [redacted] I sent Spanky's an estimate for a replacement for the tree they destroyed, a 12 - 14ft French Lilac tree [redacted] including tax, this estimate does not including delivery or labor charges to remove whats left of the destroyed tree and plant the new one, labor and delivery charges are estimated to be another [redacted] I am willing to settle for the cost of the new tree and handle the removal of the old tree and pick up and planting of the new tree myself providing that they pay me for the new tree. To date, [redacted] 2015, I have received no response from Spanky's Tree Servcie.Desired SettlementI require payment of [redacted] so that I can purchase a new tree and repair my property to the condition it was before it was damaged by Spanky's Tree Service, otherwise I will have no choice but to file a small claims action for the full amount including labor and delivery charges.
