To Whom It May Concern:This letter is in response to false allegations made by a homeowner that I did work for. I am a painter that owns a very small business doing small interior and exterior paint jobs. The customer hired me to paint the inside of his condominium and install laminate flooring in...
part of his home. He also wanted shower to be removed and replaced with the same size shower and vanity removed and replaced with new vanity. The owner insisted on doing his own measurements and order the new products himself that were delivered to his home. The first part of the job began with painting. The paint and color choice was chosen by homeowner. After many coats of paint, the paint was not covering the walls which resulted in more money and time spent on this area of the home. The customer then chose a different color which resulted in covering the walls properly in the two coats that is normal for painting interior walls. From this point of the job things turned sour between him and I. In regards to the hood vent and stove, I slipped off my ladder due to a wet spot on his kitchen floor from him. I did dent the hood vent and I have full intentions on replacing the hood. The stove however did not have scratches on it. I only hit the hood due to it being out further than the stove so it was not possible for me to hit the stove. The measurement for the new corner mount shower done by the customer was incorrect which resulted in a inch gap. The customer refused to order a new shower and asked me to make it work. Which resulted in a new floor being laid around the corner mounted shower. The vanity also had a crack in the top counter area which resulted in having to order a new one. These issues caused delays and time that he did not have to pay for. When we started the laminate floor I explained the proper pattern of how the floor should be laid out. He did not want it done that way because he wanted to save on waste. He insisted that I lay it his way and I did. The customer was doing work himself and insisted on being part of the process the whole time. He laid many pieces of the laminate flooring while I was not there after working hours. His joints were not lined up correctly and he moved his couch on the new flooring that resulted in a nick in the flooring because the seam was raised. He said it was fine and did not want his mistakes fixed.Because of the delays in ordering new materials, paint issues, and the customers lack of skills I had no choice but to leave the job until all the proper material was there. I have a schedule to adhere to and I need to get back on track with other customers that were waiting for their work to be completed. When I returned to the job he had more of the work done improperly and started saying my work was done incorrectly. The tile floor is perfect and there is no need for it to be redone. The paint job is beautiful. The reason for him saying this is due to his anger. The customer began laying a handgun on the table while I was working. I asked him to put it away because it made me uneasy. He said no I have a "right to bear arms" it's America. I feel he did this to be intimidating. I worked with the customer on all issues and tried to resolve them. We started out great and in the end the tension was awful.I then left the job due to other responsibilities and had surgery. I was going to return after to finish the grout in tile baseboard, replace hood vent, and remove the trash in garage. This was not good enough for the customer. While being gone the customer drove past my house frequently, harassed me in text messaging/ phone calls, and stalked my facebook page. He also stated that I am not a licensed contractor which this is correct and he had full knowledge of that when hiring me. I do however have insurance and can provide proof of.ResolutionMy responsibilities to finish this job are;Grout tile base board Replace hood vent Remove garbageIt is a shame that this is even coming-down to this because the homeowner and I started out really good. It is always a terrible thing when things happen like this in business. I hope to learn from this issue and grow from it to prevent anything like this from happening in the future. My number one priority is making the customer happy!Thank youSpada Painting
Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
First of all my complaints are not false, and I did not complain about the pattern of the flooring. I did help by holding the planks but he was the so called expert and he made the determination that they were installed properly. When he started to install the flooring he couldn’t even get the planks together and I had to go to Lowes do they could show me so I could inform him how they were to be put together. I also did finish installing some of the flooring and it was done the right way with no gaps and no raised ends. He was supposed to remove all of the trim and old laminate flooring but I did that for him and that saved him a lot of time. Also, I gave him a gun for spray foam. I did not move my couch and damage a plank because it was sticking up, they did that and I showed him what they did and asked him not to slide the couch again and told him I would let the chipped plank go because the couch covered it. If I complained about anything he would get very belligerent and intimidating. As to the damage to my stove, cupboards, and vent hood, he was using my ladder and he tapped rags to the one end of the ladder to use against the walls when he was painting. When he was painting the wall above the stove he put the rag end on the floor and of course the ladder slipped and he and the ladder crashed down onto the floor causing the damage. The floor was not wet as he stated and the stove sticks out ten inches farther from the wall than the hood vent does also unlike he stated just the opposite. When he was painting the wall in that area he must have cranked my highest tract light toward the wall and shorted it out the damaged the switch, I asked him about it and he said he didn’t touch it but I could tell that he was lying. He also used my shop smith saw to cut the flooring. My measuring mistake had nothing to do with anything but costing me $500 more for him to put in a new floor which is so far from perfect it is laughable. The floor was not installed around the shower but the floor was installed when there was nothing in the bathroom and I did not tell him to make it work. The tiles do not line up and as you can see they are not even and level. He must have taken his pot break before he did the job. The new vanity granite top wasn’t cracked it was in two pieces and it was moved by him and his helper after it was delivered, I would not doubt the he was responsible for breaking it. I do have a hand gun that I keep on my night stand next to my bed and it was there long before he said it made him nervous and I didn’t say anything and put it out of sight. If he felt intimidated it was probably because of his quit long criminal record, and he probably can’t be in contact with firearms.I drove by his house one time to see where he lived and if his van was there because I did not believe he wasn’t working. He has other people working for him that could have done the work if he couldn’t. I check his facebook page and he was always accepting more work. I did not harass him. I just asked him when he was going to finish what I paid for. I think that after waiting 6 months I should expect that. Also, he did not tell me that he wasn’t licensed.I was supposed to give him $1850 to start the work and the balance upon completion. I paid him money on 5 different times because he kept begging me for money and the last time I gave him money he wanted the balance because he blamed me for him not being done. His responsibilities to finish the job are:Grout tile base boardReplace the hood ventRepair or replace the damage to cup boards (2 places) I fixed the bent door. Fix the scratch on the rangeFinish painting the bathroom Replace the defective dimmer switch for tract lightingGive me money for 3 tubes of adhesive he wasted glue shower wall to air ($15)Fix the bathroom floor so that I don’t trip and get hurt
