Southpoint Crossing Apartments

The landlord used my deposit to replace the carpet in the apartment, claiming pet damage that they have not described or shown pictures of.I chose not to renew my lease at Southpoint Crossing Apartments this past December. Up until that point, they had been a wonderful apartment and had had no cause for complaint.After completing the move, returning the keys and checking out of the apartment, I received a statement from them saying that pet damages had occurred to the carpet, such that the carpet had to be replaced. They used all $250 of my deposit for this, and are asking for an additional $77+. I asked for pictures of the pet damage, as I had not seen any major damage (pet-damage or otherwise) on the carpet when I was leaving. They did not provide the pictures, and instead provided an invoice stating that Sherwin Williams had come in to replace the carpet. I asked again for pictures of the alleged damage, or at least a detailed description of the damage including its location in the apartment. I have not heard back from them.I have also asked why, even if pet damage did occur, could my $400+ accumulated pet rent not be used to cover the $380 carpet replacement. This has not been explained to me either.The landlord has been very slow in responding, and has not provided proof of what they are claiming. I believe that they are trying to replace a carpet with reasonable wear and tear by citing pet damage that did not actually occur. I have cited the NC Tenant law to them, again to no response.Desired SettlementRefund of my security deposit and no further claim of financial responsibility on my part to replace the carpet. I will not contest the smaller water fees and the fee to clean the oven - those may still be taken out of the security deposit.Business Response [redacted]Document Attached[redacted] and [redacted] Arvind were former residents of Southpoint Crossing Apartments from 12/28/2014 to 12/27/2015. Our maintenance supervisor inspected their apartment after departure on 12/29/2015 and noted the drip pans were left dirty which resulted in a replacement charge of $20 and he noted the carpet was damaged due to pet stains. We then had our carpet cleaning vendor inspect the carpet to see if cleaning could be done to restore carpet and they recommended replacement (documentation is attached along with the invoices for carpet replacement, resident has also been provided with this). The charge for carpet replacement was $386.40 (prorated based on life of carpet). Below is the breakdown for amount due at move-out:Carpet replacement $386.40Drip pan replacement $20.00Final water/sewer $25.40Security Deposit -$250.00Credit from December overpayment -$104.00Total Due: $77.80A final move-out statement was sent within 30 days of move-out and our office received and responded to disputes by [redacted] by providing documentation from the carpet cleaning vendor as well as the carpet replacement vendor and an explanation of the breakdown of charges. We also explained that per the lease agreement, pet rent and pet fees are not used for damages caused by pets. [redacted] responded on 1/28/2016 stating that she would mail payment but that she did not agree that she should have to pay these damages. She did not believe in the "privilege" of having to pay for pet fees and pet rent. On 2/5/2016 our office received a personal check #133 for $77.80 that was posted into their ledger for final payment.
