Budget Towing Service ("BTS") is overcharging in violation of SECTION 1. Section 3068 and 3068.1 of California Civil Code. Section 3068(c)(3) of the California Civil Code states, in relevant part: "The charge for the care, storage, or safekeeping of a vehicle which may be charged to the legal owner or lessor shall not exceed that for one day of storage if, 24 hours or less after the vehicle is placed in storage, a request is made for the release of the vehicle. If the request is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full, calendar-day basis for each day, or part thereof, that the vehicle is in storage." In addition, Section 3068.1(a)(1) of the California Civil Code states, in relevant part: "A person seeking to enforce a lien for the storage and safekeeping of a vehicle shall impose no charge exceeding that for one day of storage if, 24 hours or less after the vehicle is placed in storage, the vehicle is released. If the release is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storage. " Our vehicle was only stored for not more than 3 or 4 hours because a request for release of the vehicle was made and payment of fees was remitted within those 3 or 4 hours (aka within the first 24 hours). In anycase, BTS charged for two full calendar days even though the charge should not have exceeded that for one day of storage pursuant to CA Civil Code 3068 and 3068.1 (cited above). This was in addition to a gate fee, which was understandably imposed because the car was released after normal business hours. However, the doubling of the storage fee charged was in excess of what is required, in this case. We are asking for a refund of the extra charge. The problem date was Saturday, August 24, 2019. The towing of vehicle, storage of this vehicle, and release of this vehicle all occurred between the hours of 9pm-1am. Vehicle information: 2000 Honda Accord Payment method: Credit Card Name on Credit Card: *** Total payment amount: $470 BTS's storage fee rate = $60 daily. (BTS itemized a charge of $120 for storage)
I was charged a storage fee for two nights when my car had been in their possession for only 4 to 6 hours.
My car was towed on the night of the 24th, between the hours of 9 and 12. I noticed my car was towed around midnight. I called the towing company to see if it was possible to pick up my car immediately. I arrived at their location at around 1 am. Their employee that night said that the storage fee was $60 per day, and that because I had picked it up after midnight, they could charge me for two nights even though my car was with them for only 6 hours at most. I looked up the law that night and called around 11am on the 25th. When I told the employee that I was illegally overcharged and that I wanted to speak to the manager, she said that it was out of normal business hours for them but that I could speak with a manager the following day. I called around 1pm on the 26th and the employee working during that shift said that the manager was not available.
I would like to be refunded for the amount I was overcharged ($60).
Wrongfully towed from private property, and charged ***, storage, and service fee, despite having visible valid permit.
On the morning of January 15, 2019 at 6:12 am, at275 Junipero Ave in a private parking lot in which I rent a space from the lot owner(s), my car was towed by Fernando of ***, for allegedly not displaying a valid parking permit. To my knowledge, according to the owner, there was no explicit request made to have my car towed, nor was any authorization granted to tow my vehicle. Additionally, the photo that Fernando took of my vehicle before stealing it, is of poor quality, in unfavorable weather, taken from what appears to be roughly 15 feet away from my car, making the papers in the windshield impossible to read from the photo.
Prior to recovering my vehicle, I contacted Sandra at ***, and informed her that I indeed have a valid permit in the dash is visible, and after placing me on hold to verify, she returned to deny that there was a permit there. Upon arriving I walked up to my car and could clearly see the purple colored parking pass *** the corner of my windshield which validates my parking through next month. When I brought this to her attention, she made me wait outside for about 20 mins before returning with the aforementioned poor quality photo, displaying on her phone.
So, based on a photo wherein no clear distinction can be made to validate their claim, I was charged $250.00. When I requested documentation of the tow, as well as any other information that I may be privy to, Sandra told me that if I want that information I would have to contact the police department to get it.
I am seeking a refund of the $250.00 that I paid for being wrongfully towed.
I received a *** service from *** and the tow driver broke my bumper off my vehicle. The manager is refusing to repair or help me.
I received a *** service from *** on 02/23/2018 around 11pm 12 am. The driver transported my vehicle a 2008 HONDA ACCORD 4 door from Downtown Long Beach to my apartment complex in Northern Long Beach due to my vehicle not starting because of battery drainage. As the driver inputs my vehicle into my parking space at my residency he fails to detach his truck from the bottom of my vehicle and rips the bumper off. The tow truck drivers name is *** and I have tried to contact the company's manager and he denies on giving me assistance on repairing my bumper. The manager claims that the driver said my bumper was already like that. However I have phsycial pictures of my bumper off the vehicle and *** trying to push in my bumper by force because it was not going in conclusion, the manager has been negligent towards fixing my bumper which they have caused to detach. I have also been very persistent with following up with the company because they fail to return my phone calls. I payed $80.00 for those *** service.
What I hope is for my bumper to be successfully replaced so that I can safely drive my car.
I was towed from River Drive Apartments the other night for parking in the guest lot without a parking pass. I was parked 4 spaces to the left of the dumpster where guests are allowed to park for 24 hours. They towed me anyways for "parking without a pass". Guests don't need passes *** the guest parking... I was charged $295 dollars for parking where I was supposed to park! I had a test to take that day and didn't do so well without my books that morning. It was a terrible day because of the unjust actions of this company.
