Overcharge for Services
Unresponsive/poor commuication
Unable to settle dispute
We had been using the services of Southern Blue Lawn and Landscaping in the month of October and had paid *** for *** worth of services rendered. During this time, at their own doing, they had given us a one time *** Public Service Discount.

On 11/27/2017, we received a bill for *** for ONE leaf pickup/removal from our residence which is less then *** acres with a house on it. On 11/28/17 @ 8:23am, I called the owner to discuss the bill and left a message to suspend all services until this was discussed and settled. We did not hear back from the owner.

We were then out of town for two weeks, but available by phone, and upon getting home on 12/10/2017, there was an invoice for *** I called on 12/11/2017 @ 4:08pm to verify that the issue was taken care of but was told no, this was a mistake and that we still owed the ***
Several times over the next couple months, we requested an itemized invoice to show all services and fees prior to 11/28/2017.

We did not receive anything until March 9, 2018.

On this newest invoice, there was now a charge of *** for a leaf removal on 11/28/2017 and *** for a lawn application on 02/16/2018, clearly both occurring after I suspended ALL services.

When we called to discuss, the owner stated he would "waive" the *** and the *** but that we still owed *** for the removal on 11/10/2017.

We inquired why the charge was so outrageous at *** and he indicated that it was because our fence gates were too small for the large equipment or large tarps to get thru. We advised him that this "surcharge" was never discussed at the time of services nor has it been brought up until now while we have been disputing this fee.

We have never stated that we do not owe him for services rendered on 11/10/17. On 03/09/17, we offered *** which he declined. We gave him a final offer of *** (which is still high for this one time service) and asked him to get back to us.

On 03/14/2018, we received another email from the owner stating that he will NOT accept the *** we offered for the leaf removal services on 11/10/17, as there are approximately *** in services we NOW owe him for as follows:

*** which is a reversal of the Public Service Discount for services done prior to 11/10/17.
*** Leaf pickup/removal 11/10/17.
*** Leaf removal 11/28/17(services suspended),
*** Lawn application on 02/16/18 (services suspended).

We have tried to work this out with the owner (***) and feel we have been more then fair. The services completed without our approval, after we suspended services, are not our responsibilty. He provides the Public Service Discount at his own discretion. And I have recevied other quotes on leaf removal (between $1XX-XXX per clean up) and not one has come up with *** for one removal/clean up.

At this point we are willing to pay *** for the leaf removal services on 11/10/17.

Desired Outcome

We are willing to pay *** to resolve this issue immediately.

Consumer authorized worked performed via text from *** on November 10, 2017. When presented with bill, consumer refused to pay for work. Southern Blue performed 2 leaf cleanups - the first on November 10th for which consumer was billed *** and a second on November 28th for *** In addition, Southern Blue treated Consumer's lawn in October, November and again in February after Consumer agreed by text on October 28th to pay for Southern Blue's turf application program at the rate of *** per month. Southern Blue personnel also cut their lawn on Nov. 28th which was billed at ***

Total amount due Southern Blue for services rendered to date is *** excluding previously authorized work in the amount of *** that was paid for by Consumer at the rate of *** after receiving a First Responder discount. This is a one time discount - not ongoing.

Southern Blue has tried to work it out with Consumer and cannot reach agreement. Southern Blue offered to settle the matter for *** provided payment was received by March 15th which Consumer failed to make. Southern Blue provided Consumer photos of work being done and work log entries from days the property was serviced to further substantiate its billing. Southern Blue provided Consumer copies of texts authorizing work which it now disavows.

Southern Blue further offered to wrap the past due amounts owed into an annual maintenance contract but Consumer refused.

In addition, Consumer refused to return numerous calls, emails and texts made by owner, ***, beginning in November.

Consumer's yard is fenced and is surrounded by big trees. Southern Blue expended 5 man hours removing approximately 20 yards of wet leaves on November 10th. In addition, Southern Blue incurred dump fees in the amount of *** on behalf of Consumer to dispose of the leaves. Furthermore, Southern Blue expended *** hours removing leaves on November 28th and an additional man hour cutting the grass, edging and blowing hard surfaces. Southern Blue personnel provided lawn application treatments in October, November and again in February for which it is owed ***

Southern Blue rejects the settlement offered by Consumer and will proceed with legal action to collect the full amount owed to it in accordance with Virginia Law. Consumer has not dealt in good faith and has exercised bad faith by refusing to pay Southern Blue in full for services it rendered pursuant to its express written authorization.
