Concrete fulfilled the specifications of our contract with Mr*** for concrete installationMr*** was at his residence/job site on the day grading was in progressI had discussed in phone conversation with Mr*** that once grading began, work would continue on to completion A Spartan Concrete representative met with Mr*** a couple of days after the work at his residence was completed. At that meeting Mr*** expressed that his main concerns were what he regarded as (1) lack of communication about the work schedule and (2) his loss of hrs time/wages when he left work to come to the job siteThe Spartan Concrete representative asked Mr*** what amount of compensation he felt was appropriate for any miscommunication and time/wages lost. Mr*** agreed to a $reduction in the amount due as his final payment for the concrete installation. Mr*** wrote checks at that time to cover the remaining balance minus the $discount and shook hands with the Spartan Concrete representative, With regard to cracks that may develop in concrete, Spartan Concrete does not “guarantee” that stress cracks won’t occur. Prior to work beginning, the B***s received an estimate and an attachment on customer information on concrete which further specifies the terms of work to be performed. In addition before signing the estimate agreement, MrB*** requested and received addresses of several previously
completed job sites by our company. The B***s paid a 30% deposit (as specified in their estimate) prior to work beginning. In removing the existing concrete from the B***s residence, we encountered thicknesses of concrete greater than inches; in some instances the center of their drive was to inches thickWe paid for additional stone to bring these areas to the 4-inch level as specified in their estimate and as referenced in our concrete information attachment which states that thicknesses greater than -inches will result in additional cost. We, however, did not charge the B***s for these additional costs we incurred- approximately $2,000.00.Sprinklers in the front were damaged, as sometimes happens when bobcats are excavating large amounts of concrete; however, we replaced those damaged sprinkler heads, as well as several undamaged ones in the rear of the property at no charge to the customer, as, as the sprinkler heads were approximately yrs old.The estimator and owner of Spartan Paving did meet with the B***s upon completion of the estimated work. The B***s had concerns; these concerns were written down and signed by MrB*** and by the owner of Spartan Paving. The B***s then paid 1/of the remaining balance with the agreement that the remaining balance would be paid upon resolution of the concernsSpartan Paving resolved the concerns as agreed, and the B***s paid the remaining balance.We feel we have certainly met the terms of both the original estimate and of the concerns referenced above. The B***s have a great driveway at a very competitive price and did not incur any additional cost for the amount of concrete that was removed being in excess of the terms of their estimate

The paving done on the customer's driveway was an asphalt 'cap"; that is, the customer had an asphalt driveway and our company paved an additional asphalt layer on the existing driveway.(A new parking pad was also installed/paved.) We will address through additional paving the driveway issues that
are not related to the existing grade of the driveway.As mentioned in information provided to the customer with the estimate, paving over an existing driveway does not change the grade of the driveway as the grade/slope was determined when the existing driveway was installed by "others"For this reason, we cannot guarantee that all water will run off any driveway on which a "cap" is paved.As related to grass growing, asphalt is permeable (grass and weeds will grow through asphalt and/or on it); customers are advised through information provided them that any growth should be treated promptlyControlling grass/weed growth is part of a customer's maintenance of a driveway.Optimum temperature for paving is above degrees. We will pave an additional layer of asphalt on the customer's driveway by-AprilWe will notify the customer prior to scheduling the paving so that any vehicles may be moved.Note: The cost indicated by the customer was incorrect

We intend to do exactly as requested by the customer, however with the recent fires and floods we have been unable to do so yet. As to the billing, the invoice she was referring to was left at the time of delivery but as explained on the phone it has not been billed, and will not be billed until the...

time when the issue is rectified. Once rectified we will send the customer a bill for only the 100 gallons request and at no time do we expect any payment until we are able to remove the excess gas from the tank. We are sorry we haven't been able to rectify this already but as stated we expect no payment until excess gas is removed and then and only then will the customer be bill for just the 100 gallons. Should customer should have any questions please feel to contact our offices directly with any question.Thank YouJ[redacted]

[redacted]        I am rejecting because the work done was not to the contract. First off like I said I DID NOT SIGN OFF on forms before concrete was poured. Backfilling and grading WAS NOT COMPLETE before concrete was poured. The day of grading which was a Friday they ran out of gravel and did not finish the grading and packing down of gravel. They left and I was never contacted when they would return. After hearing nothing all weekend I called [redacted] on Monday around 10am he told me they were pouring concrete. I left work arrived home and the forms were wrong, even the guy pouring the concrete knew they were wrong but said he was doing what he was told to do by [redacted]. And the slab inside garage was finished without the slope from back to front for water to drain out. And I payed for level floor and there are low spots throughout the garage. Since the backfill was not complete it took 6 more yards of concrete to complete the job, not my fault and should not be and argument from Spartan Paving about extra cost involved like [redacted] mentioned two days after. Which he did not meet me at job site to discuss my concerns. I had to leave work yet again and meet him off hwy 290. If we go strictly by the contract and not word of mouth between [redacted] and myself, Expansion joints were NOT sawed 10x10, 100sq.ft., which would of helped prevent cracking per [redacted]. And I payed for gravel to be compacted underneath ALL concrete, this is not what I got. The driveway section has no gravel underneath due to them running out and not finishing the grading before concrete was poured. And besides just contractual issues, let me mention the use of my personnel equipment (skid steer) by Spartan Paving WITHOUT my consent. $30,000 piece of equipment used and left with concrete all over it, which causes major damage to hydraulic cylinders and seals! This whole ordeal was handled very unprofessionally and company did not follow there own contract. [redacted] said multiple times that I would sign off on forms BEFORE any concrete was poured, was NOT the case. Contract was not followed, 100 sq. ft. saw joints, gravel poured and compacted underneath ALL concrete, and slab to slope back to front for water drain. When I upload contract to computer I will attach the file for ALL parties can view. If [redacted] is saying contract was followed, sorry but it was not. And [redacted] and I discussed the final price of what was owed and expressed my feelings of the contract not being followed and the fact of my personnel equipment used. He argued that the job took my concrete than quoted and he couldn't work with me on pricing because of that reason. Again that was not my fault, and that doesn't help me get what I paid for. I was not going to argue with him and I pay my debts when owed, so at the completion of the job I wrote him the check to pay for services.

The check was received as promised and we have deposited in in our bank account. As we discussed, you may mark the complaint as "resolved." Thank you for all your help in this matter. [redacted]

The response by Spartan did not address the poor workmanship.  The poor workmanship is apparent in the rough expansion joints; the slanting front sidewalk which results in standing water; the water flow is to the patio sidewalk instead of down the driveway as specified in the estimate; driveway entrance where skim coating is breaking up; and general appearance is rough.  This is apparent especially when the owner stated that this was a B/B- work.  I can send pictures of the above items if needed.  Again the main issue is the general poor workmanship.  It is not a "great job"! as Spartan has stated!W[redacted] B[redacted]

[redacted]I had another of our estimators come by [redacted] earlier this week to look at your drive.He took pictures also which I have forwarded to [redacted] (my son) so that he could review the concerns you mentioned.From the pictures, it  appears that the base (ground prepared prior to...

our paving) has sunk in an area or two and the compromised base has caused the damage (alligatoring) to the asphalt in those areas.  We will address the problem and probably cap the full area after excavating and leveling the two sunken areas.The cap will also address any small cracks. (The drive area will need to be dry for the work to be done.)I'm attaching asphalt information that you may already be aware of, but it is helpful customer info on asphalt maintenance and characteristics.  If you have any questions about the information, please let me know.As I mentioned when we talked week before last ([redacted] in hospital for surgery), the heavy rain in our area has put us behind schedule.  However, we will schedule your repairs as soon as possible.  If possible, I will let you know a couple of days in advance of our crew planning to come, but if you agree, we may be in the position of having schedules change and have only a 24 hr or less window to let you know that  we can schedule the work.Best Regards,[redacted] (for [redacted] Cell  - 864-[redacted]
