I have not received any proof that Source One Financial has validated anything via their delivery to me of 100% accurate and 100% verifiable proof of alleged late payments and all required notices, to include the notice of sale (within 10 days of sale), deficiency balance statement and/or surplus balance statement. They have either ignored or overlooked my requests. There seems to be a misunderstanding on the terms “original”, “100% accurate” and “100% verifiable”. This is more than just defamation of character. By not having, ignoring and/or overlooking to submit valid documentation, required by Federal Law, to report on any alleged debt, they have admitted to one of their many violations. Since with their admission of NOT having valid, physical verification, how are they able to LEGALLY report without being in violation of 15 U.S Code Sec. 809(b) of the Fair Debt Collection Practices Act? Since they admitted to conducting an internal investigation, what information was discovered to continue to illegally report? I’m sure the CFPB, Revdex.com, FTC, State Attorney General and the Federal Court System, as well as myself, would like to know their method of verification; so what is it? Why wasn’t the account updated with the CRAs to “consumer disputes” during the investigative process? As you will see, these questions have been asked; to no surprise, they failed to comply by ignoring and/or overlooking the emails in their entirety.
Dear Mr.:
We have provided you with a copy of your retail installment contract, your payment schedule, a notice of important rights, your notice of redemption and other materials.
Thank you
Revdex.com:
I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***.
Please read the message in its entirety since there are questions within the submission that, to no surprise, were ignored and/or overlooked; unless, you’re admitting that you are unable and/or unwilling to comply. Once again, you are ignoring and/or overlooking my requests. There seems to be a misunderstanding of the terms “original”, “100% verifiable”, “100% accurate” and “all required notices in accordance with Federal Law”. These include an original instrument of indebtedness in its original form, verifiable proof of alleged late payments (payment schedule is not a valid verification document per FCRA and FDCPA), the notice of sale (with verifiable date and delivery of documentation within 10 days of sale), deficiency balance statement and/or surplus balance sheet (with verifiable date and delivery of documentation within 5 days of sale). On numerous occasions, as well as continuing, you are failing to comply with documents required by Federal Law. If in fact you believe the documents you submitted were sufficient, please upload for the Revdex.com to review. The submission of the documentation, the response to the documentation submitted, along with results from any investigations conducted (wether it be from the Revdex.com, CFPB, FTC, Private Investigators in compliance with Federal Law, and/or any combination of these listed), will be used as evidence in Federal Court should you continue to prove your improper debt collection practices.
Regards

You have not provided all required documentation. There is no proof of late payments; there is no notice of sale; there was no surplus statement; there is no proof that those documents were sent within the allotted amount of time within federal law. You may now close this complaint since your response was given after expired time requested by Revdex.com, has not answered any of the previous questions, and has been escalated to the Massachusetts Attorney General; final step prior to Federal Court proceedings.

On April 5th I was notified by the credit bureaus that Source One reported that I was 30 days late on my March payment. When I called and spoke with ***, she couldn't see it and referred me to *** in legal dept. *** also said she didn't see it but would research. In the meantime I received a breakdown of my payments mad on time all the way to March 28th. I then finally spoke to *** who admitted o wasn't late but would NOT fix it and I would have to dispute thru credit bureau. I am two weeks away from closing on a house. If it is not fixed immediately I could lose the house or at best pay a higher rate. *** was VERY rude and even hung up on me...a trait that mirrors complaints all over the internet. This is fraud and they have repeatedly told me they are angry that I will not authorize an ACH payment.
Unfortunately Mr. made his payment after the month end and was >30 days past due on March 31, 2018. Reorting to the credit bureaus is done on the month end. If he had made his payment timely, or at least made payment prior to the month end he would not have been reported late.
The reporting has already been completed and is correct.
Thank you.
