[redacted] Please See Attached Documents [redacted] December 29, [redacted] Revdex.com Resolutions Consultant Revdex.com of Alaska, Oregon & Western Washington RE: Revdex.com complaint # [redacted] , Soleil Medical & Beauty Spa LLC Dear Ms [redacted] , I received Soheila S***’s December 21, response to my complaint against Soleil Medical & Beauty Spa LLC, and appreciate her willingness to resolve this matter I would like to provide clarity on several statements made by MsS [redacted] that are NOT accurate: I was never offered a “test” of the Trusculpt procedure prior to purchasing the $1,package of three, and I certainly would not have declined a test if I knew one was available, especially given the lengthy discussion I had with DrD [redacted] regarding my concerns about the pain associated with the treatment I received only ONE Trusculpt treatment on April 2, The next time I came in for a Trusculpt treatment was on May 20, 2015, and I stopped that treatment within the first minutes because I could not tolerate the painI did not receive a 3rd Trusculpt treatment as stated by MsS*** After numerous attempts to reach MsS [redacted] by phone over the course of many months, on October 7th, 2015, MsS [redacted] called me in response to my letter of October 5, I have phone records that show this was the only time anyone from the Spa tried to contact meWe had a congenial conversation about the matter, but her recollection of our conversation differs from mine in that I understood she would call me back in a few days after talking with her business associates about my requested refundAs I recall, she stated that although her policy was no refunds on package deals, she agreed that because of my inability to tolerate the pain of the treatment there may be an exception made, and she would check into it and call me back After two weeks without follow up from MsS***, l left three left messages – one every two weeks, over the course of six weeks with Jennifer W [redacted] , Soleil Medical Spa’s office manager, requesting that MsS [redacted] contact me to resolve the matterI never received follow up of any kind from MsS*** I have made several respectful attempts to resolve this matter at the lowest level possible, yet without follow up from MsS***, I filed complaints with the Revdex.com and with the State of Oregon Department of Justice Consumer ProtectionNow it appears that Soleil Medical Spa considers contact by me to resolve the matter as “harassment.” On December 21, 2015, I received an email from someone named Douglass A [redacted] via a Soleil Medical Spa email stating that “We will have you speak to our lawyer if you have any further issues, however, any further contact with us is harassment and unjustified.” I would like to resolve this matter, and in order to do so, if Soleil Medical Spa will not provide a cash refund as requested, I will agree to other spa services in lieu of the Trusculpt treatments I purchased but am not able to use due pain intolerance in the amount of $ Thank you, [redacted]
[redacted] Please See Attached Documents [redacted] Dear [redacted] Thank you for the follow up regarding Ms [redacted] .As per previous correspondence and documentation, showing Ms [redacted] used her treatmentpurchased timesWe have made it clear that we would be happy to honor her treatmentsof a different laser for the same area to make her happy. As a point of interest, Ms [redacted] has been here on three separate occasions as perdocumentated - and ahalf treatments that are regularly priced at $perWe honored her50% off if she purchased three( the recommended treatment protocol) At this point, since shehas used treatments, there is a deficit in the value paid ($1500) and the compensation forservices recieved(reg price$2000.) if she were to break it into separate treatments valued atregular price. It needs to be understood that Solei! Medical Spa is very understanding if Ms [redacted] found thetreatment to be more painful for her,but obviously, we were able to successfully completetreatment on her in the prior treatments, and it wasn't until the last treatment that she decided shewasn't able (for what ever reason) to continue.Again, we would extend treatments of a similar treatment to the area that Ms [redacted] wasinterested in treatingThis must be scheduled after a consultation in a timely manner.Thank You,Soheila S*Owner Solei! On Janurary 13th Ms [redacted] purchased units of botox, originally priced at $perunit, we gave her our discounted price of $per unitShe used units that day and wantedto save the other for future, although we usually do not honor the $per unit rate forfuture visitsShe came back on 2/24/for a consultation with DrT [redacted] and he suggestedthat she needed more botox as usually units is not enoughShe insisted on having theadditional botox given to her for free which we did not offer herShe was very upset and angry, harassed our receptionist and yelled at the receptionist to refund everythingIt was disruptiveto our other patients who were waiting in the lobby and made everyone uncomfortableWetried to tell her we had to wait for our accountant to refund her $as it was late on a Friday, and there was no one in the office who could process her refundWe left a couple of messagesfor her asking for her credit card information so we could process the refundShe neverreturned our callsSo when we received your letter we contacted our payment processingcompany and they helped us refund her $120.If there is any need for further contact to solve this issue, I will be happy to provide you with mylawyer's information.Sincerely,Soleil Medical Spa

I am rejecting this response because:
The business NEVER made any attempt to contact me, in fact I had to call several times and all I got is the promise of a return phone call
Reason why I contacted the business and requested a refund is because the original units of botox administered had absolutely no effect on my skin and thus the doctor said and to have them re-done and wanted to charge againHonestly is like they had injected water and not botoxI asked them to please consider re-doing without charge and they refused and became very rudeI then requested to talk to the owner and the receptionist refused to let me talk to her
They lure people through Groupon and then offer other services such as botoxI do feel that they are scamming people and they are incredibly rude
Sincerely,

RE: *** ***ID ***Soleil Medical Spa*** ** *** ***Portland Or 97219503-244-7717We spoke on several occasions with Ms *** after she determined that she wasnot going to proceed with the TruSculpt treatments she purchased on March
27th,2015.She was given a sale price for a package of three treatmentsThe treatments purchasedindividually are $per sessionShe was able to receive a 50% off if she purchasedIt is recommended by the manufacturer that a patient do at minimum treatments over a periodthree months to see the best results.Ms *** came as per schedule on separate occasions for the treatments, April2nd, 2015, May 20th and June 23rd,The first two treatments she appeared to be happywith her services and the third and last treatment she ceased the service midway and said it wastoo uncomfortable for her and she would reschedule another day.It was about a month later that Ms *** called to see if we would be able to offer a refundfor the service not usedIt was explained to her that we sold her a package at a considerablediscount, and as such individually the first two treatments she did are valued at $each, soif she breaks it up, she in fact would owe us money for the treatments receivedIt wassuggested that she already used some of her other treatment , but that we would honor herthat at a later date in order to finish her treatment, She declined stating that she wanted hermoney backWe again revisited the idea of a compromise and offered her another treatment thatmight compliment the service she was having, and she should did not want that.Any policy change regarding refunding services already used would have to be brought to theattention of our CFOShe inquired as to who the CFO was and was informed it was theowner Soheila S***,Soheila tried calling Ms *** back several times and spoke with her brieflySheoffered her complimentary service and the use of the Tru sculptIt is at this point thatcontact ceased until Ms *** sent the letter in the envelope we have included for yourinspectionAs far as any contact with Dr D*** stating she could try and see, that is not asuggestion that she in any way was promised a refund or free services and is not substantiatedby any notes on Ms ***s chart. It has been customary to have our services on sale often throughout the year, andthat is our right as a business to provide salesIt is in our best interest to offer services if theyneed three or more treatments for best results in a sale package, we are interested in customersatisfaction, however if they want to just try it, usually we offer a test spsee if they canhandle any pain associatedMs *** declined to have any such test. There is no suggestion of a refund either verbally or written and she has already used moreservice than what she paid for If she would like to finish the treatment, we are happy toprovide it for her, or a complimentary service that is comparable. We would also like to point out that she names 5//as a day that she spoke with usShe wasin service for a treatment as the information we provides for you showsWe have all evidencethat Ms *** was not interested in completing her services and just wanted to get her moneybackShe contacted my office manager several times and I did respond with a solution, but itwas as stated above, not as she states in her letterHer second time talking to us 7/07/15was just two weeks after her last treatmentWe were expecting a eall to reschedule her appointment for herIt was at this time that I offered her some exchange of service. The third time was just two days after she sent us a letter and we contacted her immediately. You have a copy of her letter included here.Sincerely,Soheila S*Owner-CFO- Solei! Thank you for sending the response from Soleil Medical SpaThis is a very difficult situation with a lot of money at stakeI have tried to be fair and respectful in my dealing with the spa, but they are wither grossly mistaken or they just flat out lying about the services I receivedI did not receive treatments as MsS*** claimsIn her response she states that she provided documentation to that effectCan I please get a copy of that documentation?Sincerely,*** ***

RE: Revdex.com complaint #[redacted], Soleil Medical & Beauty Spa LLC
Dear Ms. [redacted],
I received Soheila S[redacted]’s December 21, 2015 response to my complaint against Soleil Medical & Beauty Spa LLC, and appreciate her willingness to resolve this matter.
I would like to provide clarity on several statements made by Ms. S[redacted] that are NOT accurate:
I was never offered a “test” of the Trusculpt procedure prior to purchasing the $1,500 package of three, and I certainly would not have declined a test if I knew one was available, especially given the lengthy discussion I had with Dr. D[redacted] regarding my concerns about the pain associated with the treatment.
I received only ONE Trusculpt treatment on April 2, 2015. The next time I came in for a Trusculpt treatment was on May 20, 2015, and I stopped that treatment within the first 3 minutes because I could not tolerate the pain. I did not receive a 3rd Trusculpt treatment as stated by Ms. S[redacted].
After numerous attempts to reach Ms. S[redacted] by phone over the course of many months, on October 7th, 2015, Ms. S[redacted] called me in response to my letter of October 5, 2015. I have phone records that show this was the only time anyone from the Spa tried to contact me. We had a congenial conversation about the matter, but her recollection of our conversation differs from mine in that I understood she would call me back in a few days after talking with her business associates about my requested refund. As I recall, she stated that although her policy was no refunds on package deals, she agreed that because of my inability to tolerate the pain of the treatment there may be an exception made, and she would check into it and call me back.
After two weeks without follow up from Ms. S[redacted], l left three left messages – one every two weeks, over the course of six weeks with Jennifer W[redacted], Soleil Medical Spa’s office manager, requesting that Ms. S[redacted] contact me to resolve the matter. I never received follow up of any kind from Ms. S[redacted].
I have made several respectful attempts to resolve this matter at the lowest level possible, yet without follow up from Ms. S[redacted], I filed complaints with the Revdex.com and with the State of Oregon Department of Justice Consumer Protection. Now it appears that Soleil Medical Spa considers contact by me to resolve the matter as “harassment.” On December 21, 2015, I received an email from someone named Douglass A[redacted] via a Soleil Medical Spa email stating that “We will have you speak to our lawyer if you have any further issues, however, any further contact with us is harassment and unjustified.”
I would like to resolve this matter, and in order to do so, if Soleil Medical Spa will not provide a cash refund as requested, I will agree to other spa services in lieu of the Trusculpt treatments I purchased but am not able to use due pain intolerance in the amount of $1000.00.
Thank you,
[redacted]

On Janurary 13th 2017 Ms. [redacted] purchased 24 units of botox, originally priced at $16 perunit, we gave her our discounted price of $10 per unit. She used 12 units that day and wantedto save the other 12 for future, although we usually do not honor the $10 per unit rate forfuture visits. She came...
back on 2/24/17 for a consultation with Dr. T[redacted] and he suggestedthat she needed more botox as usually 12 units is not enough. She insisted on having theadditional botox given to her for free which we did not offer her. She was very upset and angry, harassed our receptionist and yelled at the receptionist to refund everything. It was disruptiveto our other patients who were waiting in the lobby and made everyone uncomfortable. Wetried to tell her we had to wait for our accountant to refund her $120 as it was late on a Friday, and there was no one in the office who could process her refund. We left a couple of messagesfor her asking for her credit card information so we could process the refund. She neverreturned our calls. So when we received your letter we contacted our payment processingcompany and they helped us refund her $120.If there is any need for further contact to solve this issue, I will be happy to provide you with mylawyer's information.Sincerely,Soleil Medical Spa
