I was contacted by Solaire Energy Systems and also by *** ***, who released the lien against our home yesterdayI asked Solaire to inform future clients about this unpleasant part of their solar installationI do understand CED's need to protect their assets, however, I the customer, had no idea that there was a credit account that could, if unpaid, jeopardize my credit rating and my home ownershipHad that been explained to my husband and to me, the entire process could have been handled differentlyHaving been a part of the credit industry, I know that some times mistakes are made, liens are applied where funds have been paid, and it is an enormous burden for the homeowner to resolve.
This problem was exacerbated by Solaire's not paying our bill as we had agreedI thought everything was cleared, only to receive a certified letter from ***, explaining that it was not.
I would advise every homeowner who chooses a contractor, to not only review the contractor's reviews, but clearly understand the process of the installation and subsequent issues which may arise.

My response follows.
Solaire's representative never asked us if we had enough taxable income. If *** *** recalls, that wasn't his initial question to me either in our subsequent conversation. His question, as was Solaire's representative, was if we had 'taxable income'. The clear implication was if we had 'any' taxable income, that would fully qualify us for the entire amount of the green tax credit. To make that point even clearer, *** *** then asked me if we had a large number of write-offs (we didn't in any case--nor did Solaire's representative ask), and that if we did not, then it usually meant the entire amount of the tax credit in the first tax year would indeed apply. This indicates to me that *** *** was aware of situations where the entire amount of the tax credit was not received and did not apply, even if it was not usual. But Solaire's representative never indicated that this could be a possibility, and *** *** only indicated that possibility in our conversation after the fact.
Had we known, we wouldn't be in the present situation with a complaint filed with the Revdex.com indicating unfair business practices against Solaire Energy Systems. We simply wouldn't have done business with them*** *** said he was sorry that we didn't consult with our tax accountant prior to our entering into contract with Solaire. This is in effect placing the blame with us for having trusted them. Neither Solaire nor it's representatives should be giving out tax information if by *** ***'s assessment, it can't and shouldn't be trusted if they do. But they did. And we trusted it. It's their industry
And in fact, Solaire's representative was emphatic that if we purchased a Solaire Energy System immediately, the entire tax credit would apply the first tax year, which we could then apply to any outstanding short-term loan they solicited for us in order to pay for their system. My wife asked their representative at least twice if there was any possibility that we wouldn't receive the entire tax credit amount the first tax year. And Solaire's representative was unambiguous in his answer by saying that we would indeed receive the entire amount the first year. He gave us no indication that it was necessary to check with our tax consultant.
And mind you again, this is their industry. Their contract receipt to us even indicates a reduction of the total amount of the system cost by the total amount of the tax credit applied. If this was not accurate, then we should have been informed by their representative before signing any contract. We were not. And let me be also clear that we would not have faulted Solaire nor its representative had they simply given us their best guess understanding of our tax situation and income position were it done in good faith, with the understanding that we would then need to go to our tax accountant to fill in any gaps or possible pitfalls before deciding whether or not Solaire's energy system was right for us.
What I am faulting them for is giving us materially information in order to induce us to purchase a system that they either knew or should have known that we either couldn't afford or weren't ready to buy had we received the correct information from themBy not telling us about the requirements and consequences with respect to the tax credit, and indeed telling us falsely that we did qualify for the entire amount of the tax credit the first tax year when in fact we did not, they induced us into a contract agreement based on pretenses.
Let me explain how the consultation meetings proceeded when we met with Solaire's representative. After explaining and demonstrating the benefits of their product during our first meeting which convinced us of its quality (which I am not debating), their rep offered us a price for their recommended system. We balked, saying we weren't prepared to pay that amount (in excess of 48,dollars). We closed the meeting at that time. But shortly after, their representative contacted us again and asked if we had taxable income to which I responded that we did. At a subsequent consultation, he then showed us the benefits of accepting their system immediately as the federal tax credit would offset the price of the system he felt we needed.
He further explained how this tax credit would not be avaliable the following year as it was due to expire. And in the contract receipt once again, the amount of the total tax credit is subtracted from the total cost of their system. The new total of 34,dollars is written down as the final cost of their system after the tax credit is applied. Their representative at no time indicated to us that this tax credit could or would be applied over the course of several years as our, and later their tax consultant admitted to.
If they knew better, since again this is their line of work, then they should have indicated that to us. But they didn't. Their representative then offered us a same as cash loan solution good for ONE year through a third party that he contacted for us as we sat at our dinner table, as a way to pay for their system immediately, to be later paid off when the entire amount of the tax credit would be refunded to us. He explained to us how we would benefit from the cost savings of the solar power system to our electric bills immediately while the tax credit could be used to pay down a substantial portion of the loan to pay for the system when we filed our taxes. We would benefit both from the system by using it to cut our energy costs immediately, while at the same time use the tax credit to cut the cost of the system as well. All we needed to do was agree to the loan offer he had waiting for us on the other end of line. And after my wife confirmed the entire tax credit would be available that year with Solaire's representative, we took the phone and agreed to the terms of the loanOur tax credit the first year was dollars, which left us with an outstanding balance of over thirteen thousand dollars on the same-as-cash loan that has several thousands of dollars of penalties attached to it if we carry any outstanding balance passed that one year periodIn hindsight, I feel that the actions of calling loan officers while we were still trying to decide if this course of action was right for us while sitting at our dining room table, was nothing more than a high pressure sales tactic to induce us to purchase something before we were really ready to buy. Now *** *** is saying that we should have spoken with our tax consultant prior to our signing when the tactics used to secure our signatures under contract were really there to discourage us from doing exactly that. And to our embarrassment, it workedFinally I would like to address *** ***'s assertion that I have both slandered his company and engaged in 'cyber-bullying'. I categorically deny both claims. I have written five or six reviews relating our honest experience with Solaire, and I would invite *** *** to show me where I have not been truthful with respect to any of them. *** *** mentioned the many positive reviews his company has received from customers. I wouldn't deny the honesty of their claims. *** *** didn't mention the less than positive reviews his company has also received. And while fewer, I would certainly hope that others reading those experiences would extend to us as well the same courtesy of believing our reviews with respect to our experience with Solaire Energy Systems, its people and service, even if *** *** does not. I do believe it provides a better education for those considering their next big purchase in the solar energy industry to know what the good and the not so good experiences can be when dealing with the industryWe are not seeking a remedy for a sub-par system provided to us by Solaire, nor are we seeking a full refund for a system we simply didn't like and don't want to pay for. It has in fact been a good system that has worked well for the needs of our family. The remedy I am seeking is to simply refund the amount of money that we would have never agreed to pay, if Solaire hadn't provided us with information. But because they gave us information, and induced us to purchase their system based on that information, we sincerely feel it is incumbent upon them to rectify the situation. For such a substantial purchase we expect better customer service and satisfaction from a company that takes pride in providing both a good product and excellent customer serviceBased on the positive reviews they have received, I believe that Solaire Energy Systems, their representatives and *** *** are capable of providing that to us also

I am sorry to hear *** *** did not consult his
accountant regarding the tax credit prior to making a solar purchase. When making decisions regarding taxes it is
always important to consult a tax professionalI’d like to make it clear that Solaire
Energy Systems is
not an accounting firm and has never had access to *** ***’s
tax information. Our solar consultants
do not claim to be accountants and only inform customers that there is a tax
credit available if the customer has sufficient taxable income Our sales consultant explained how the tax
credit worked and possibly recommended banking options that he could utilize if
he had that sufficient taxable income. If
he had said “no I do not have taxable income” we have banking recommendations
for a lease that would work great for someone who cannot use a tax credit. In this case it appears he was incorrect
regarding his tax situation or hasn’t found a way to utilize the credit yet This situation is very uncommon since most
customers know their tax situation or will check with their tax professional if
they do not knowAs for Solaire Energy Systems paying the disputed amount of
$14,578, we are not obligated nor feel we owe *** *** any monetary compensation
*** *** *** *** signed a contract on 1/29/which clearly states that
“Rebates and tax credits are estimated and may change. Buyer must pay Solaire Energy Systems for the
full system price of this agreement, including any deficit between the actual
and estimated rebates and or tax credits.” It still may be possible to obtain the credit
if he looks into options not yet explored since there are multiple ways the
credit can be used and it can be acquired over multiple years
As for the loan, Solaire Energy Systems is not a bank and
does not provide loans to our customers directly. For their convenience, we do connect
customers with banks that offer solar loans.
Customers and banks enter contracts that Solaire Energy Systems is not a
part of I imagine there was extensive
paperwork presented to *** *** from the bank that explained his loan’s terms
fully. If *** *** has questions
regarding his loan I recommend he contact his bank directly
We here at Solaire Energy are sympathetic to *** ***’s concerns
but will not be harassed on multiple platforms *** *** ***) to pay for
a credit that he still may be able to acquire.
Having no obligation, our COO personally attempted to put him in contact
with an accountant and with other banking options to possibly help solve the
situationWe take customer service very serious here and it shows with 1000’s
of happy customers and an A+ rating with the Revdex.com. We will continue to give *** ***
terrific customer service when it comes to anything regarding his actual solar system
but cannot help him with his tax and banking issues. If the customer has questions regarding these,
he should contact professionals in those industries directly

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.[redacted] claimed that my description of Solaire's sales call was unfair.  I'd like him to answer how he could know that, while at the same time acknowledging that he wasn't there to verify his statement.  I described in my prior response what occurred during Solaire's sales call to our home, because I was there.
On the face of the contract receipt, the entire amount of the system cost is reduced by the entire amount of the tax credit (and at the very least, this is deceptive).  And Solaire's rep secured for us a loan for ONE year.  We, of course have the paperwork to show that.
It would not have made sense to have agreed to a one year loan term if we didn't believe that we were going to receive the entire tax credit amount to cover the loan within that time period (since the loan Solaire found for us had severe penalties attached).  We were enticed into the loan by Solaire's representative because he told us the entire tax credit would be available to us, and that this credit would not be avaliable the following year.  We agreed to it based on that information.  And the fact that Solaire's rep found for us a loan for only one year, gave us confidence that his statement regarding the tax credit was true.  It did not occur to us that his promise to us could possibly be untrue if he was willing to enter his customers into loans with such severe penalties attached, if his promise to us was anything but accurate.  We were wrong.  And now Solaire's COO blames us for its representative's false statements.
When I spoke with [redacted] about my great dissatisfaction, he mentioned to me that he knew of other Solaire customers that used their retirement accounts as other taxable income sources to cover the income shortfall that would have otherwise disqualified them too for the use of the full amount of the tax credit, to also pay for existing loans for a Solaire energy system purchase--after the fact.  So in fact, [redacted] does know of other times where this has occurred, and where Solaire's sales reps have done the same thing to other customers as was done to us.  My description of Solaire's sales call to us was therefore accurate, since [redacted] so much as confirmed it by addressing my problem with examples of how other clients dealt with the same situation.
I must also add that counseling the use of retirement accounts (in order to pay off short-term loans found conveniently by Solaire's reps for its customers), is an abuse of customer trust.  The very purpose of installing a solar power system is to save money in the long run.  But by promoting the use of personal taxable retirement funds to cover costs, the cost-savings benefit is not only lost, but those who follow this course of action end up paying twice--once for the system, and once again through the real loss of any accrued equity from the original principle amount when it was withdrawn from their retirement accounts and not working for them.  The resulting loss could be truly substantial.  By providing such advise, Solaire's customers are not helped, they are harmed.  And frankly, it puts the entire solar power industry in a bad light when Solaire's COO suggests this as a possible solution to pay for their solar power system.
[redacted] said that there is a seven day refund period that we didn't use.  That's because we didn't know it was necessary for us to use.  Again, had we known that the entire amount of the tax credit would not be available to us that first year, like Solaire's representative said it would be, we would not have entered into contract to purchase a solar power system from Solaire.  It's that simple.
Finally, my honest purpose here is not to harass.  It is to correct bad business provided to us by Solaire through their use of false statements in order to secure a contract with us that we would not have otherwise agreed to. 
[redacted] considers this business matter closed.  I would cite his response as more of the same that we have come to expect from Solaire and its representatives.  I would urge him and his company to reconsider the matter.

We apologize for the confusion with the scheduling of the initial site visit to
your house. The technician arrived late because he got lost and it
is standard protocol for them to make a call when this happens, and I...

assure you that this is not common. The technician did a thorough check of your
solar system and reported that none of your micro-inverters seemed to be
working. He was asked to just diagnose the problem and that was all. 
He
arrived back to our shop late that Friday night and therefore the data did not get to
me until the next day business day, Monday. To get you a quote to fix the system, more
trouble-shooting would have been required on my part to get an accurate
estimate of costs. Our Office Manager sent an email to you explaining this and
an additional charge. I would have needed to remove solar modules, and do an
extensive test to make sure the problem wasn't just isolated to the inverters.
There is a chance that there could be defective modules as well which would be
a much more costly fix. It would have taken me a large part of the day to do
this-hence the secondary charge to you. 
It
was never reported to me that our technician broke any tiles from our
correspondence with you or from our technician until now. If this had been
mentioned, we would have scheduled this repair promptly. This damage most
likely happened during the initial installation. However can replace the broken tiles at no additional charge to you since our tech was the last one on
your roof. As for the initial service charge, we will reimburse you the $160 that you paid for our diagnostic
fee. 
I
apologize for any inconvenience this caused and will have our office contact
you on Monday to schedule the roof tile repair. If you have any questions or
further concerns please don't hesitate to email or call me.

We feel that our initial response to [redacted]'s complaint fully explained why Solaire Energy Systems is not responsible for any monetary compensation. 
What was discussed during the initial appointment with our sales representative according to [redacted] is not a fair depiction of the conversation that took place, as it was over a year ago and was not recorded (to my knowledge). There is no way to know what questions and options our sales representative offered, but we do have the contract that both [redacted] signed stating "Rebates and tax credits are estimated and may change.  Buyer must pay Solaire Energy Systems for the full system price of this agreement, including any deficit between the actual and estimated rebates and or tax credits." 
In regards to your claim that our "high pressure sales tactics" to sign the contract prevented you from consulting your tax consultant; The contract also clearly states that the buyer has 3 full days to cancel without any penalty or obligation, and in cases of emergency the buyer has 7 days. 
Again, we here at Solaire are empathetic to [redacted]'s concerns, it is unfortunate that he believes any of our representatives would knowingly manipulate homeowners into doing something that would financially burden the homeowner. Solar is not a one-time sale, our customers are customers for as long as they have the system and we want to keep them happy. Simply put, Solaire would not intentionally sabotage a homeowner in order to get a sale. We fully believe in solar energy and truly want to help homeowners save money. 
We consider this matter to be closed.

Energy Systems would like to apologize to the [redacted] family for any inconvenience
they had to endure regarding the notification process [redacted]...

utilizes
when material is acquired through credit at their store.  [redacted] protects themselves from unscrupulous
contractors by starting the lien process when material is purchased on credit.  Within this process comes notification
through the mail with form letters stating approximate monetary amounts that can
be placed in a preliminary lien IF payments are not received by the
contractor.  In the case of the [redacted] family the amount owed was less than half of the $5000 approximation by [redacted]. 
Just to be clear, These form letters are the beginning of a lien process, not a lien on the
home and will not affect the credit of the family. It is very common in
the construction industry to start this process so the contractor is protected from a customer who refuses to pay.  
Solaire Energy Systems has a perfect payment
record with [redacted] and has never made them go through the entire lien
process.  As a rule, Solaire makes the
payment to [redacted] for each customer after we receive final payment.  As for Mrs.
[redacted], she was very kind and paid her final payment on time which was due on
11/19/15.  I then promised her I would
get to [redacted] as soon as possible to pay off her balance but was unable to make it
there until the date of 11/30/15.  I
truly believed I would of been able to make the payment sooner but due to the
Thanksgiving Holiday and a very busy schedule the Monday of 11/30/15 ended
up being the first day I could make it. With the payment made, Solaire Energy Systems
believed everything was fine until we received a Revdex.com complaint the following
day 12/1/15.   Apparently Mrs. [redacted] had received
another form letter on the date of 11/28/15 which prompted her to call [redacted]
on the same Monday I had paid. Unfortunately, the payment had been made but
it had not been processed so the individual she spoke with at [redacted] (not knowing
we had already made a payment, since the system hadn't updated it yet) told her
we had not.  At this point Mrs. [redacted]
wrote the complaint for which I am responding. 
I have spoke with Mrs. [redacted] and
with the [redacted] credit department and connected them with each other so open
communication regarding the payment is now available.  Solaire Energy Systems hopes this will
resolve the complaint made by the [redacted] family and allow them to be happy with
us once more.
