Customer makes irrelevant claims of disputed verbal statements and promises Exhibit E (reproduced below) of the contract also clearly indicates that exterior doors cannot be chosen or changed after the pad is cut -- which took place even prior to the foundation being poured. The customer acknowledged that she knew the house was at the foundation level, so any assertion that customer was uninformed that the changes for the exterior doors she wanted were prohibited is not valid Thank you

As per the terms of consumer's warranty and purchase contract, the carpet is not covered by warranty with Home Creations. Rather, the consumer's warranty is directly from the manufacturer through the supplier, Southwest Flooring. ...

Unfortunately, Southwest Flooring appears to have determined that the consumer's carpet issues are not a manufacturer defect, but they have not even inspected or examined the carpet to make such a determination. We recommend that the consumer diligently focus his attention toward Southwest Flooring and the carpet manufacturer, the proper parties to address the consumer's carpet issues.
Regarding the concrete walkway, Home Creations properly fixed a broken piece of the sidewalk on consumer's front walkway. However, issues of level surfaces are not relevant here, as the placement of the concrete was done in order to ensure proper drainage.
Consumer also reports a heat & air issue with the installation of piping. We are not in a position to evaluate the oral statements of any contractor, but only what is stated in written form. Consumer's piping issue was reported and repaired after the expiration of consumer's one year builder warranty.
For the consumer's concerns regarding the "deteriorating" concrete on back porch, Home Creations does not warranty concrete work on flatwork (i.e. non-foundation elements). Consumer did not report any such concerns during his one year warranty period.

were clear, and the customer acknowledges in her complaint that she was informed about the limitation on structural changes.  Buyers and sellers have an indispensable responsibility to familiarize themselves with the terms of the agreements they sign.     As the contract’s requirements for the return of earnest money have not been satisfied in this case, Home Creations cannot take the action requested in the complaint.   Thank you.
