Hillsborough franchise refuses to present a copy of a contract which I never signed and refuses to send an invoice to close out the account properlyI became a month-by-month member of Snap Fitness and signed a month-to-month auto-pay agreement stating that $59.95 would be debited from my account for every month that I was a member. The agreement was set to auto-renew each month. I moved away from NC in mid-January and contacted Snap Fitness ([redacted]) in December and received no response for my cancellation request. I followed up with a second email the day prior to moving (January 14th) and got a response that my cancellation fee would be $139.90. This cancellation policy was not communicated to me and the representative who owns this franchise claims that I was in a 12-month contract. No contract was signed. She claims that she requires a 2 month cancellation notice and thus is charging me for 2 months plus a $20 fee. I have tried contacting the parent company Snap Fitness but they do not provide ANY support for ANY customer, only franchise owners. I am okay with paying this unjust fee to simply prevent her putting me into collections over a miscommunication and bad business practice. I have requested three times for an invoice to be sent to me either electronically or by mail and she refuses. Instead she keeps referencing a difficult to read email and says all of the information is there. This business practice I believe is unfair and needs to be addressed as soon as possible, possibly revoking her license to do business since she is presenting perspective clients with a month to month billing agreement and then switches it to a 12-month term without providing the customer (me) with any copy of the contract that was signed and any support in case we need to dispute something within the contract.Desired SettlementA full copy of all signed contracts be electronically delivered AND sent via certified mail accompanied with the full invoice and detailed line items disclosing the final charges for the account. Meaning (according to the agreement) that February would be his last payment. Again we are willing to work with Mr. XXXX and not enforce the February payment of 59.95 per the agreement. However we require the January payment of 59.95 plus the 20.00 Insufficient Fund Fee. Total Payment that we will accept is 79.95. If Mr. XXXX would like to call in the morning to make the 79.95 payment via Credit Card or Debit Card I will be in at 9:00 a.m. We can also take a money order or check if he would like to mail the payment. Money order or check needs to be made out to [redacted] Inc. All payments and Insufficient Fund payments that are not received by the last day of the month are automatically sent to collections. Mr. XXXX simply did not want to follow the guidelines of the SIGNED agreement. It is unacceptable to believe that an adult individual was unable to contact us, as was clearly states in the complaint, when we are more than accessible with a 24 hour answering service, email and on Facebook in the social media, but can quickly and effortlessly email our corporate office and file complaints with the Revdex.com and not make a phone call if something is unclear in an email. We sincerely wish Mr.XXXX well and hope that he finds a gym that will better serve his needs.
