My name is *** *** and both *** and I spoke with *** and placed the order for the building*** discussed the building specs and I picked out the colors of the siding, trim and roofAs stated in ***'s response, we told him we were pouring a concrete slabWe even asked if we needed to do anything special to the slab and if we needed it to be any wider than the building in order for them to build on itNothing was mentioned about anchor bolts at that timeNone of our invoices or paperwork from lucky lumber ever mentioned anchor bolts being extraWe were only told we would have to pay extra by *** when we mentioned that we wanted the damaged material replacedWe have paid $15,for this building so farI don't believe we should have to pay for damaged material*** also acknowledges the material was damagedRegardless of how little he thinks the damage was, we are buying a new buildingIt should not be damaged at allThey should either replace the damaged material or credit us the cost of having someone else replace themThey can't just start adding things to the invoice because it is going to cost them extra to make the trip

Let me get a few facts straightOur agreement was with Mr*** *** Mr*** contacted us about the buildingMrKee signed all the documentsMrKee is the owner of the buildingBefore and during the construction we never had a conversation with Ms***We are responding to her complaint as a curtesyMrKee has not been involved in this action
I believe the main issue here is a miscommunication between MrKee and Ms***During construction minor damage to the metal siding was noticed by the builder, *** ***Mr*** notified the owner, *** *** Mr*** was given the option of having the metal replacedMr*** chose to have the metal installedI assume Ms*** had a different opinion after the metal was installedMost people know that replacing metal after it is installed is much more costlyYou have to remove trims, screws and metalThen recut angles and reinstall the damaged metal and other metal that was not damagedYou have more cost in screws, most of the time they cannot be reusedThen you have to reinstall the trimIt would have been much less expensive to replace the metal before it was installedIt is our position that we have absorbed a lot of extra cost trying to please our customerWe took care of the foundation issue, anchor boltsWe refunded $more than the value of the entry doorWe have to draw the line somewhereMr*** instructed the builder to install the metal, even though it had minor damageWe feel he should cover the addition labor cost of replacing the metalIf Mr*** pays the final payment of $500.00, we will gladly replace the metal in questionIf MrKee pays the final $we will gladly supply replacement metal, which he can install himself or have installedAgain, totally his option

That is completely untrueI, *** *** was on the phone call with *** when the order was placedAs I said previously, both *** and I talked to ***, *** discussed the specifications and I discussed the colors and made the selectionsI am just as much an owner as *** is, my name is on the deedI *** up the floor plans and I communicated those plans to the builders along with the placement of windows and doorsThere is no miscommunications between *** and IIt is plain and simpleMy new building that I paid for has damaged metal that was damaged by Lucky Lumber before it was installedLucky Lumber has not disputed the fact that this metal was damaged by them and was damaged before it was installed, they just want to charge us more to replace it because it will cost them moreI'm not concerned with their cost, I'm concerned with what I paid for and it was a less than satisfactory productIf Lucky Lumber had inspected their material before it was delivered and had not installed damaged material in the first place there wouldn't be an issue

Contact Name and Title: Gary [redacted] President

Contact Email: [redacted]@luckylumber.com
Mr. [redacted] called me personally in 2013 about a condensation problem with his barn. He stated that his RV and other items in the...

barn were getting wet due to condensation dripping from the ceiling. I made a appointment and met Mr. [redacted] at his home. After viewing his barn it wasn't the insulation that was causing the problem, it was that he had a white chat floor and it absorbs moisture from the ground and being inside a close structure the moisture condensates on the bottom of the roof insulation and that's causing the dripping. He would have either poured a concrete floor or pulled the chat out and put a visqeen plastic cover down and then put the chat back in that would stop the condensation. He also had one piece of insulation that had come loose and I told him when I had a crew back in the area they would come by and fix it. I haven't had any crews in the area and that is my fault.
Gary [redacted]
ps....I just got a call from Mr. [redacted] stating that he has a building crew their at his barn and it has two holes in the metal roof and they are also fixing the piece of insulation and replacing some 2x4"s that have turned black from the condensation and wants Lucky's to pay this crew $2500.00 which I declined. This job is nothing more than a $200.00 to $300.00 job to complete. He then informed me that he's having them do this work and will sue Lucky Lumber. I ended the conversation telling him that's his responsibility if he goes forward with this without us resolving this matter through Revdex.com.
Initial Consumer Rebuttal /* (3000, 11, 2015/09/18) */
________________
Gary [redacted] is badly mistaken with regard to why and how there was condensation in my building. He did come to see me and we noticed that there was more than one strip of insulation falling. In fact, the whole north side and south side was coming loose due to the fact that there were several screws missing in the roof and water ran down through the holes onto the insulation. Not only that, the sides of the insulation had two-sided tape, and the people that put the insulation up did not take the paper off the tape. The carpenter that I had come look at the building crawled up on the roof and noticed there were four rows of screws missing the entire length of the building. So Mr. [redacted] is totally wrong on how the condensation got into the building. He told me the warrant was no longer valid since I had someone else here working on the building. The reason I had someone else here working on the building was because I had been trying to get Lucky Lumber out here for over three years to fix the problem. Not only that, I really don't want him messing with the building because I do not trust him or his crew working on the building. If he couldn't build it right in the first place, I don't want him messing it up more. What I really want is this to be publicized so people know what kind of person Gary [redacted] is and his company Lucky Lumber. If you have any person calling, please give them my number ([redacted]) and I can give them the facts. Thank you very much for your assistance.

I see that Mr. [redacted] is now saying since his gravel floor isn't the problem for his condensation then it must be Lucky's. As I told him before, then ground is wet under his gravel and with the insulation in the roof it will cause condensation. When I was there, condensation was dripping from the underneath side of the insulation and causing moisture inside of his building. I contacted the insulation distributor and the manufacture about Mr. [redacted]'s moisture problem and they both confirmed that the gravel floor was the issue.
Mr. [redacted] called me after filing his first complaint with Revdex.com and told me he had someone there at that time to work on his building. I said since you have filed a complaint with the Revdex.com let's solve this disagreement through them and he said no he was going to go ahead and have the work done. That ended our conversation.
Also here is my number (417-935-4201) and if anyone want's to know the details of Mr. [redacted]'s condensation problem I'll be more than happy to tell them what not to do.
