Review: On ** June 2014, I placed a $500 deposit to lease a car with Smith Haven Mazda. I placed the deposit with a debit card over the phone. The card information was given to [redacted], [redacted], who assured me in no uncertain terms that the deposit was fully refundable should I decide not to go forward with the lease.

After my offered lease rate was changed from the one initially quoted, I decided to withdraw my deposit from Smith Haven Mazda. On ** June 2014, I called the dealership and requested my that deposit be refunded. I was told at that time that I could expect the $500 credited to my card within 5 business days. On * July I called again to check the status of my refund, which had not yet appeared in my bank account. A member of Smith Haven Mazda's finance department informed me that no one had initiated the refund, despite my call on ** June. I was again told that the refund was going to be issued by the end of that business day (* July 2013).

The following week, on * July, I called the dealership again to request a receipt of refund be emailed or faxed to me immediately since I was told the transaction would not appear in my bank for a number of days. [redacted], [redacted] with whom I had initially placed the deposit assured me that the refund was issued and that the receipt was on his desk, and he would email it to me right away. No such email was ever sent to me. My calls to the dealership with request to speak to [redacted] were systematically ignored in the days following the conversation on * July.

On ** July, I again called Smith Haven Mazda to restate my request that my deposit be returned. I spoke with [redacted], who told me that he would call back within a half hour with information concerning my refund. As of writing this (12:00 PM on ** July), I have not received a call back from [redacted].Desired Settlement: That my $500 deposit be returned immediatel.

Review: On May *,, 2015 I signed a lease agreement with Smith Haven Mazda There were two months left on the old lease; the salesman, Nick E[redacted], told us it was no problem for SHM to return the old car to Fusion Auto Finance (Fusion) - this way he could close the deal that same weekend.

On May [redacted], my daughter picked up the new leased Mazda from SHM and left the old Mazda in the dealer's care, to be returned to Fusion. She took pictures of the car minutes before she dropped it off. Later that month I got a bill from Fusion, listing $1,149.64 worth of damage that we knew nothing about: the car only had a small damage to the front bumper. I contacted SHM first, and then Fusion; they pointed fingers at each other. SHM accused Fusion of lying about the damages, and Fusion accused SHM of having damaged the car and having removed parts to use in other vehicles. Which side is telling the truth? Are they both guilty of some wrongdoing?

Mr. E[redacted], the salesman, said tat the car was in great shape when it was dropped off and that Fusion had a reputation for overcharging customers for lease returns. I checked online and found several similar complaints. At that point, I was convinced SHM was in the clear, and Fusion was not. I tried to get SHM to help by asking them to get the employee who gave the car to Fusion to attest to the car's state, as Mr. E[redacted] saw it comin in. Mr. E[redacted] said he could not find out who worked that day or who gave the car out. Then he stopped taking my calls and returning my messages. I then contacted Denis A[redacted], sales manager. At his request I emailed him Fusion's invoice (I also added some of the pictures we took). Then just like Mr. E[redacted] he started seemingly willing to help, then stopped responding to my calls or emails.

I believe the silence from SHM speaks of their guilt. I can't believe no one knows who gave the car to Fusion. The pictures sent by Fusion showed missing hubcaps, trash in the car, and other body damage. If it was done by a rogue employee, the right thing would be for SHM to fix the situation with me, the customer, and take whatever steps their policies dictate when dealing with the employee. This has all the markings of a company-wide habit and coverup.

Over the course of several months, I have unsuccessfully tried to resolve the issue with SHM - they seem to be the big culprit from this angle. Something happened to the car while it was in their care, but they have ignored my requests for help. I am caught between those two companies. We should not have to pay for something we did not do… This seems to be another case of another scam by a car dealership trying to take advantage of its customers.Desired Settlement: Smith Haven Mazda needs to pay for the damage to the car.

Review: I purchased a 2008 Mini Cooper on 1/**/2015. In approx 2 weeks there was a leak in front of car and check engine light on. I brought the car back to Smith Haven Mazda. They said they fixed the leak and cleared the check engine light. On 2/**/2015, there were 2 leaks coming out of the front of the car. Again I took the car back. They kept it for 4 days. I made several calls to the [redacted], [redacted] and the [redacted]. They kept giving me the run around as to what the problem was with the car. Finally they told us they didn't know what was wrong but if we paid them $135/hr for 3 hrs, they could take the engine apart to see if they could diagnose the problem - a Mazda technician, or they said take it to BMW, as they may not need to take apart the engine to diagnose it. On day 4, the [redacted] finally said, "There's nothing we can do. You bought a used car. Get your car out of the shop."

I offered to give them back the car for a full refund, which they said they would never do and I would loose my $2,000 deposit.

On Friday, March *, I took it from Smith Haven directly to BMW for a diagnosis. At BMW they warned me not to drive the car as I was in danger of blowing the engine due to the leaks. I then called Smith Haven Mazda to tell them what BMW said and to give them the amount of repairs that were necessary to make the car driveable.

Again, I dealt with the [redacted], and the Service Mgr. After numerous calls over the next 4 days, they kept telling me, they have to see what could be done....but nothing was done. And I had BMW also calling me as I had the car in their shop, I had their loaner car, and they wanted a decision. I had no choice but to borrow money for the $2,300 dollar repair job, all items that were covered under the Lemon Law.

Then on 3/17 I got all the documents together and sent them via Fax to William Balan, the General Mgr of Smith Haven Auto Group. I followed up with 2 phone calls, only to reach his voice mail, of course.

I have gotten nowhere since. I believe they intentionally wouldn't help me after the second visit because, if I brought the car in to them for a 3rd time, they would have to abide by the Lemon Law and give m a full refund. I believe they are intentionally trying to defraud me and haven't honored the implied warranty upon purchase. I don't think they serviced the car which was probably part of a new Mazda purchase/trade-in. They probably just cleared the engine codes and thought they could get away with it.Desired Settlement: I would like Smith Haven Mazda to send a check in the amount of $2,366, to me to cover these repairs.

Review: I was looking to purchase a car. On 09/**/2014, I put a one-hundred dollar "refundable" deposit down on a car. Financing fell through and I was unable to purchase the vehicle that had the deposit down. I called numerous times and was assured my refund would be corrected. I have text messages from the salesperson [redacted] assuring my refund would take place soon. However, weeks later I am still without my one-hundred dollars.Desired Settlement: I would like my refund back as soon as possible.
