I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted].
Again, that sort of damage should not occur after such a short period of time. But at this time, that's beside the point. I was told by [redacted] and the office staff over one year ago thatthe work would be done at no charge. Ask Mr. [redacted] how he would feel if the wait timeafter being told that is 1.5 years. What would his response be to the contractor he had hired?I have never dealt with a contractor that takes an anti-customer stance as this and I'll takeit to the attorney general if I need to.

When the customer first called the office he was told that any warranty issue would be repaired but that someone had to come out and take a look at it. When I inspected the driveway I found there was no problem in workmanship at all and determined it would not be a warranty repair. The "rutting" the...
customer claims to have is actually caused from a set of tires that were continuously turned in place without the vehicle moving. This is the number one rule we tell customers not to do especially on a new driveway. The second issue of the car bottoming out is just the natural slope of the driveway. The reason the problem wasn't there before was because the old driveway was so old it had sunk at the entrance to the driveway. With the new driveway being back to grade he is now experiencing a problem. During my meeting with him I explained all of this to me and he even went as far as saying he believed his wife was the cause of the tire marks that had been ground into his driveway. I explained to him that this would not be a warranty repair but I would still be willing to repair it for free as long as I could come by when I was already in his area for another job. He agreed and I told him I would be in touch when we were in the area. At the time we had a job that was scheduled to be done near his house but that job got put on hold until the spring. I explained to the customer if we were to come out to his property just for the repair with nothing else going on in the area we would have to charge him. The problem the customer has is he does not want to wait but also does not want to pay. Once again, since this is not a warranty issue we will not make a special trip for free to repair the tire mark. If the customer is willing to wait until we are in the area we will still go by and repair for free, if not there will be a mobilization charge to come out to his property to complete the repairs.

I was typing my rejection response and the window closed out, so I was instructed to complete the message in this fashion.I will start over: There are falsehoods in the company's response. Yes, I did say the ruts in my driveway were caused by my wife's car,but this was not due to excessive turning but the inevitable turning one does in their driveway, and this occurred after wekept off the driveway for one week. Additionally, my car, which backs straight out of the driveway without any turning, also causedindentations in the driveway. This should not occur right after we begin using the driveway after being off for one week. Also, I was not told that the hump in the driveway which my car hangs up on had anything to do with the reasons he mentioned dueto settling. There is also a 3ft x 3ft patch with loose asphalt which I pointed out to him which has nothing to do with the other twoaforementioned issues. Having said all this, I would remind the company that they came out over one year ago and told methey would take care of all these issues at no charge and, to date, they have not. Never was I told that the repair on my driveway hadto be done in conjunction with another job in the area or that I would be charged otherwise. That is simply a falsehood.Yes, it was suggested to me through email by Mr. [redacted] that they were trying to line up a job with mine, but I was not told by him on the premisesthat this was a prerequisite to my repairs getting done. Making such a statement is disingenuous, and he knows it. Nor was I told when he came tomy home that if it could not be lined up with another job that I would be charged. That is simply not true and, in any event, he simply stoppedcommunicating with me when we were trying to figure out a time for the repair. That type of customer service is simply unprofessional, and he knows that as well. Putting this on the customer when I have been dealing with this for over a year trying to get them to my house isjust a very unfortunate way of responding and offers a glimpse into a company that does not know the meaning of good customer service. You would think that they would honor my request after promising to do so over one year ago without such proclamations as he made in his response.
Once again the "rut" was made from tires turning in place. I was the one who stated that and he agreed it was his wife car that was in the area of the damage. Yes the customer never stated she was turning her tires, I was the one who stated that. It is as clear as day that is what has happened. There are no tire "tracks" in the asphalt. There is a divot with asphalt pushed up on the sides consistent with tires being turned back and forth in place without the vehicle moving. As I stated previously we did tell him we would fix it for him as long as he agreed to wait until we were in the area so he could avoid any costs associated with repairing it. He did agree and apparently now how become unhappy with waiting. We would be more than happy to repair his driveway but once again if is was to be for free he would need to wait until I was in the area, other wise we would have to charge him for a special trip to his driveway.
