I want to make other future homeowners (Buyers & Sellers ) aware of this company's refund practicesWe sold our home at the end of December and did not receive a refund check of property taxes until March **, (days later)We initially contacted the NYC office on February ** (days after closing) and talked to the office manager whom stated a check would be personally mailed out the following weekWe waited days (no check) and called about its whereabouts We were than transferred to a title processor whom stated that a stop payment was placed on the check because it could not be mailed to a PO Box A new check was supposedly issued on February *** to our attorney's officeWe waited days and contacted our attorneys office (no check)We finally called the corporate offices (New Jersey) on March * to complain about the NYC offices' refund practicesThe corporate office individual was very helpful and resolved our issueA check was finally mailed to us by *** and received days laterIt is hard for us to believe checks went missing by the ** *** *** and its even harder to believe that it takes days to receive a refund from a reputable title company
Review: We have been mistakenly overcharged $775.50 by this title company at closing. They promised a next day refund at closing. 5 weeks past closing and we still have not received the promised refund. My attorney, real estate agent, my wife and myself have placed separate calls along the way and each of us were told that the check has been sent. Yet we have not received anything at our new or old address. We should not be overcharged in the first place.Desired Settlement: Prompt refund and a letter of explanation.

The Client (buyer) was not mistakenly overcharged $775.50 by our company. His attorney had brought a certified check to closing that had $775.50 to much included. Our company policy is to refund any overage to the party which overpaid. In this particular case our closer which is an independent party that we hire to represent us at closing had made an arrangement to have this overage returned once we received the funds from him. Our closer miscommunicated to our company that he had made this arrangement with the buyer and his attorney. Our policy is to hold onto refunds until the documents that we submit for recording are reviewed so that if there happens to be money left over from recording fees or extra in a possible tax escrow to be refunded altogether in one check. Our closer also included in his package an envelope with the buyers name and address with directions for the refund to be sent to. We sent the refund check to that address (which was not the address of the property he had purchased). Buyer told his attorney he never received the check. His attorney called our office and after the escrow department verified that the check had not cleared, put a stop payment on that check and issued a new check. This check was overnighted to the buyer's real estate agent who was hand delivering the check to the buyer directly (we all wanted to make sure he had received it this time). During the course of this our escrow department representative emailed the buyer with the exact explaination and apology of events. This was a miscommunication between our closer and our office. In closing we want to state that we have followed company procedure and policy throughout this entire process and we want this complaint removed from record. Thank you.
