The information provided by *** *** is incorrectWe received a contract for repairs to the home in questionThe first step in our process when dealing with an insurance job is to provide the insurance claims department with our estimate for their reviewWe provided the insurance company with
contracts, Roof, Gutters, and SidingAll three estimates were approvedAs discussed with *** and *** *** the reason there are separate contracts is because there are separate trades involvedWhen each item is completed we take payment and then continue on to the next trade working our way from the top (roof) downWe do not continue to the other trades until the first one is completed and paid in full This is why the items were on separate contracts and not all on After confirmation from insurance and *** and *** *** had confirmed a roof color we completed the roofWe had to wait a few days when we first went to re-roof the house as there were other contractors working inside the house on items not pertaining to the insurance claimWe were later to find out from *** that he had used his first insurance installment to perform work on the inside to prepare the house for saleThis obviously made us very nervousAfter nearly DAYS of completing the roof we had not received a single payment from Mrand Mrs***; work that we had already paid material and labor on but received nothing from the ***s, not even a response as to when we would be paidWe then notified Mr*** that we would need to file a Mechanics Lien before our Day deadline to do soHe first told us that we failed to contact his insurance and that they had not paid himWe called the insurance and they had already released funds to Mr***So basically, he was paid for the roof and never paid usWe finally received a check for $on the same day we filed for a mechanics lien with our attorneyI deposited the check and it was RETURNEDHe then began threatening us with legal action as he himself said he is an attorney as wellAfter it had gotten to this point I directed him to deal with my attorney and asked him to deal with them directly and not contact me anymore. Shortly thereafter he deposited $into our business account which was his first payment towards a nearly $15,roof and demanded that we removed the lien so he could remove the cloud from his title thus making it easier to sell the homeNaturally we refused as what recourse would we have after title is transferred? We even spoke with him and agreed to settle for an additional approximately $to split the difference which he still owed which would not even have covered our costs, but we were willing to do so to avoid conflictWhen we agreed he told us he would contact his insurance and pay us within days that they pay himTHEY HAD ALREADY PAID HIM We then took the deal off the table as it was clear he had no intention to pay. We simply want to be paid for the service we provided as our contract with Mr*** statesWe have done our partThe insurance company has done their partMr*** has notThe mechanics lien will remain until the balance is paid or we are forced to take further action, which we do not want to do as we discussed with *** ***We want to be paid for the work we have done and we have not charged interest or the amount it has cost us in legal fees to deal with Mr***When he pays us we will remove the lienIf he does pay us we will not remove the lien. THIS IS NOT A VALID COMPLAINTSIMPLY PUT, WE PROVIDED A SERVICE AND WERE NEVER PAID AS PER OUR AGREEMENTTHANK YOU FOR REMOVING THIS COMPLAINT FROM OUR FILE

Work was approved by insurance before we startedWe do not start work without prior approvalPrice of contract was same price as every contract in our system, including all jobs performed for all other Farm Bureau customers this yearAs per our contract, work being performed is contingent upon weather, material, and availability of crewsWith over 40,homes being damaged from the hail storm we had on 05-18-we can't be expected to do the job right awayAll jobs are performed in a first-come-first-serve basisWe spoke to *** *** before starting the project as we do with all customersThere was no problemHe asked us to go ahead and beginThe problem occurred when we invoiced the job upon completion and sent *** *** multiple invoices and left multiple messagesWe only heard back from him finally when we threatened to lien the propertyHe then explained he used his first insurance check for interior work not pertaining to the claimWe then filed for a mechanics lien as he could not tell us when he would pay us his first paymentNaturally, as we had seen other contractors working inside and a for sale sign in the yard we got very nervous and did what we needed to do to protect ourselvesWe filed a lien the same day we received a first check for $7,over days after the job was completedHis check bounced and was returnedHe then deposited $5,cash into our account after finding that we filed a lien on the propertyHe has not payed anything sinceWe are almost at days now and *** *** has been trying to strong arm and bully and threaten with lies for us to release the lien so he can sell the home easier as there is now a cloud on the titleNeedless to say he has lost all of our trust and being that he is an attorney does not put fear in us with his bullyingThe lien will stay until the bill has been payed for the work that has been performedWe have already paid the material and labor for his roof over months agoThe remaining two contracts have been canceled and we will not be performing any further work as he has failed to follow protocolIf we had promised all work to be performed at one it would all have been contained on one contract rather than contractsIt was made very clear that the work is performed in steps by different crews as they are different tradesWe do not take deposits but when we finish any contract payment is due upon completion as clearly marked on the contract with *** and *** *** If *** *** feels he needs to continue to lie and slander us because he is upset we will add interest and attorney fees as thus far we have waived our right to do soSoon we will look into enforcing the lien as it is clear that *** *** has no intention to payWe will not respond to any more of *** ***'s claimsThe situation is very simpleWe performed a job per our contract and we have not been paid aside from a $payment for a nearly $15,jobThe lien will stand and soon will be enforced if we are not paid in fullWe have waited long enough and been more than patient and the patience is soon to end as *** has no reasonable excuse to not pay his bill.*** Singh

I already have spoken to Mr***None of the items listed in this complaint are on the building code inspectors correction noticeThe only item on the correction notice is that the flashing between the roof and the wall is top be under the siding, not the shingles, which there is flashing both
behind the siding and another layer on topAs this was not a valid complaint and the items on the building inspectors correction notice are not correct and we have corrected the items in Mr***s' here with the Revdex.com complaint although we were not required to he has agreed to WITHDRAW this complaint as we have spent approximately $correcting items we did not need toThis is how we do businessWe exceed our requirements and have a reputation not common to contractors We do not want to see any complaint whatsoever on our record even if it is to say it's been resolvedWe don't want to see that any complaint was made at all and would like to maintain our clean record for good reasonThank you

Revdex.com,
I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Singh Contrating ignores several of the biggest issues, and flat denies a course of conduct that I have documents to prove. Singh admits in the very first sentence or two of their response that it is their policy to supply the insurance company with a quote, have it approved (i.e. the homeowner would receive the insurance payment for the work to be done), and then conduct the work. This responseIgnores the fact that our insurance did not approve ANY of their work until October 12. I have the written document to prove that. I did not receive that document until after October 20. So they commenced work without insurance approval, and we had NOT been paid the insurance supplement needed to cover their bill until in the past two weeks. If they had followed their own policy then it would work fine for them to receive payments for sections of the work as completed because the insurance proceeds would have been received. They proceeded to do work prior to having any approval from insurance and then demanded full payment from us before we had the insurance proceeds to cover the demand. I have the dates of all of the checks and approval documents, as well as Singh's demands that we pay in full that came prior to may insurance company approving their work.Ignores the fact that they started two months late.Fails to address anything about the fraudulent statements they made to our insurer in apparent attempt to get a higher payout for work they didn't actually do. They claimed that the insurance company had approved their work and had issued payment before we tried to settle. I have the insurance companies approval that didn't issue until October 12. Purports to know how we paid other contractors. This may be paranoia that we were paying others with the hail damage claim. This speculation by Singh isn't accurate.Ignores the fact that they initially promised to do all the work covered in the insurance claim, but then came back and told us they would only do some of the items on the list. Of course this meant we needed to hold back some of the insurance proceeds to cover the items Singh declined to do. Singh, however thought that they were entitled to the entire first check, though their work was not yet approved by insurance, they were under investigation for fraud by my insurance company, and they had stopped midway leaving my home exposed to rain damage and facia damage (unpainted boards). It would be folly for us to turn over insurance proceeds for work unapproved by insurance, and proceeds earmarked for work this contractor now refused to do. Most importantly, this contractor admits in his response that his procedure is to get insurance approval prior to commencing work. They admit they did not follow that process. They ignore their other wrongs primarily the long delay before starting, and the fraudulent padding of their quote to our insurance. We hired them to handle all the work needed for our insurance claim. They stopped part way with unpainted facia showing and gutters torn off. We ended up having to lower the price on our home and have been exposed to damage by their stopping work. If they had followed their own policy that they admit in their response, most of this would have been avoided. (Their refusal to do part of the work, and their delay would still have caused us hardships, but there would not have been any payment delays for the work actually done. The amount they agreed to take in settlement was an additional $4,000. At the time we had still not received the October 12 clearance from insurance or the supplemental check. Singh says we had already received this. I have the document to show otherwise.Since my initial complaint I requested that they reduce the lien to reflect the $5,000 payment we made in an effort to ease their paranoia. They have declined to do so, so we are attempting to sell the home with a lien showing, though this contractor has received $5,000 and refuses to reduce the lien to reflect the change. We have been damaged, quantifiably and substantially by this contractors unexplained delays, refusals to finish work, forcing us to market an incomplete home, and forcing us to take substantial time off work to address the issues caused.I have spoken to several others that faced similar breaches of promises from Singh and then threatening behavior. I think it is critical that it be reported.
Regards,
[redacted]

Review: We hired Singh based on a series of representations, including that they would: 1) do all the repairs on our home that were listed in our insurance claim, 2) that they would handle obtaining supplemental payments from our insurance company prior to completing work, 3) that they would not need any prepayments or progress payments from us because they would be paid straight from the insurance proceeds, 4) that they could begin work within 2-3 weeks. These were all important to us because we were placing our home on the market soon, and timely, complete delivery, from a single contractor would make that possible. Singh has breached every one of these promises in fantastic fashion, and refuses to acknowledge any fault.

-Work began two months late (after we had moved). Forcing us to market the home under construction.

-They refused to do a number of items on the insurance claim, forcing us to withhold some funds for different contractors and forcing us to incur the cost and expense of finding and managing other contractors.

-They started work without getting approval from the insurance company or supplemental payments to cover the cost of their work.

-They then stopped the project mid way and demanded full payment for one part. That one part (the roof) was higher than any insurance proceeds received and the insurance company had not approved any of their work yet.

-They finally submitted their bid to the insurance company, but overstated the work they had done. The insurance company caught on and launched a fraud investigation further delaying issuance of additional funds to cover the work.

-Singh demanded full payment for the partially completed project, though it was not approved by insurance. They used frequent calls to my wife, often on nights and weekends, though nothing was yet owed pursuant to their original representations. They threatened to lien and foreclose our home.

-To get Singh to stop their harassment of us, while Singh was under investigation for fraud on our insurer, we offered an early $5,000 payment. This worked for a week or so, but then they started again.

-Though we gave them full written assurances and even offered security interests in sales proceeds of the home, they still liened our home and are threatening foreclosure.

They do not acknowledge any wrongdoing. Though no progress or early payments were part of this agreement. They incessantly demanded early and high payment from our personal funds for a job that is sitting incomplete. The cost to us has been heavy, in lost time, additional work, and stress. The home sits without gutters and susceptible to damage from the elements. If Singh would have simply submitted accurate quotes prior to commencing work, as promised, this could have gone off smoothly and they would have full payment.

We reached a settlement of this dispute last week, but I got a call the next day saying Singh had decided they would not settle and would not remove the lien. The lien is not even legal because the job wasn't completed.Desired Settlement: We request that the lien be removed and the parties walk away. We have given a partial advanced payment. One that was not due. Given the losses we have now incurred, we ask that the lien be removed immediately and the parties walk away.

Response:

The information provided by [redacted] is incorrect. We received a contract for repairs to the home in question. The first step in our process when dealing with an insurance job is to provide the insurance claims department with our estimate for their review. We provided the insurance company with 3 contracts, Roof, Gutters, and Siding. All three estimates were approved. As discussed with [redacted] and [redacted] the reason there are 3 separate contracts is because there are 3 separate trades involved. When each item is completed we take payment and then continue on to the next trade working our way from the top (roof) down. We do not continue to the other trades until the first one is completed and paid in full This is why the items were on 3 separate contracts and not all on 1. After confirmation from insurance and [redacted] and [redacted] had confirmed a roof color we completed the roof. We had to wait a few days when we first went to re-roof the house as there were other contractors working inside the house on items not pertaining to the insurance claim. We were later to find out from [redacted] that he had used his first insurance installment to perform work on the inside to prepare the house for sale. This obviously made us very nervous. After nearly 60 DAYS of completing the roof we had not received a single payment from Mr. and Mrs. [redacted]; work that we had already paid material and labor on but received nothing from the [redacted]s, not even a response as to when we would be paid. We then notified Mr. [redacted] that we would need to file a Mechanics Lien before our 90 Day deadline to do so. He first told us that we failed to contact his insurance and that they had not paid him. We called the insurance and they had already released funds to Mr. [redacted]. So basically, he was paid for the roof and never paid us. We finally received a check for $7000 on the same day we filed for a mechanics lien with our attorney. I deposited the check and it was RETURNED. He then began threatening us with legal action as he himself said he is an attorney as well. After it had gotten to this point I directed him to deal with my attorney and asked him to deal with them directly and not contact me anymore. Shortly thereafter he deposited $5000 into our business account which was his first payment towards a nearly $15,000 roof and demanded that we removed the lien so he could remove the cloud from his title thus making it easier to sell the home.. Naturally we refused as what recourse would we have after title is transferred? We even spoke with him and agreed to settle for an additional approximately $4500 to split the difference which he still owed which would not even have covered our costs, but we were willing to do so to avoid conflict. When we agreed he told us he would contact his insurance and pay us within 7 days that they pay him. THEY HAD ALREADY PAID HIM. We then took the deal off the table as it was clear he had no intention to pay.

Review: Did not do a very good job of working on the roof. According to Billings city code inspector: Flashing is not under the shingles but over the shingles. Drip edge too short in places. There is a gap of 1/4 between the drip edge and the soffit. Gutter was removed from one section of the house but not [put back correctly thereby allowing the rain water to get between the gutter and the soffit. Nails protruding from the edge of the roof. Went over these issues twice on the phone and once in person. The last time I contacted this business I was forced to leave a message with no ca.l back to date. [redacted] said he would repair the items but after 2 months and heading into winter has yet to raise a finger.Desired Settlement: Repair the items we talked about and bring the roof back to code.

This is how we do business. We exceed our requirements and have a reputation not common to contractors. We do not want to see any complaint whatsoever on our record even if it is to say it's been resolved. We don't want to see that any complaint was made at all and would like to maintain our clean record for good reason. Thank you.

I called this business about putting a new roof on my home due to wind damage. Their advertisement says they will give you an estimate within 3 days. Their contact person arranged 2 different times to come look at our house and give the estimate, but never showed up or called when they missed the 2nd appt. .
