Brilliant Move
violated the Fair Credit Billing Act (FCBA) that prohibits Unauthorized charges
on credit cards when the Company attempted to charge my credit card of the
disputed amounts. The only time that
Brilliant Move was authorized to charge my credit card was on October 29,
for the initial deposit of the job. Any
and all subsequent attempts were not authorized by me.State law, the Uniform Commercial Code prohibits
unauthorized cashing of checks. Brilliant Move violated this law when they attempted to cash the two
checks against my checking account, which resulted in unnecessary NSF fees and my
account being overdrawn. The Company intended
to violate this law when the two checks were drawn against my account despite
the fact that I specifically asked the company to not cash any of the checks
until the dispute was settled. In fact, this
information was written in the memo field of the second check that I was forced
to give to the movers on October 30, 2015.While Mr*** is correct that "he was within his rights
to collect on the debt owed to the company", the law does not however allow
one to engage in "self-help" type of actions.In my original complaint, I noted that the movers had
difficulty re-assembling the two pieces of furniture that I contracted for,
namely, my bed and my son's bed. It
turns out that when my son was over for the Thanksgiving holiday, his bed fell
apart, see pictures attached. At this
point, I am requesting that either Brilliant Move re-assembles the bed and
repair and any all damages, or reimburse for any fees that I may incur in
hiring a company to repair and re-assemble the bed.I appreciate you taking the time in resolving this matter
