Business Bureau involving a complaint submitted by one of our customers. The customer purchased a home in July of his year and our company provided both Title and Escrow services on this purchase. The Purchase Agreement called for a Home Warranty to be issued and paid for through the settlement process. Our Escrow Officer forgot to send the Home Warranty Application and payment at the time of closing. We were notified by the purchasers’ Realtor that some repair work was done that should have been covered by the Home Warranty, but when the purchaser contacted the Home Warranty Company, she was informed that they had not received a request for coverage and therefor they could not honor her request for reimbursement for the repair cost.I spoke with the Purchaser and told her that I would contact the Home Warranty Company and advise them of our oversight in not submitting the Application for coverage timely and ask them to reconsider their decision not to cover the repair issue since the delay in submitting the Application was created by our company. I told them that we would be forwarding the Home Warranty Application and payment immediately. The Home Warranty Company agreed to handle her claim, under the terms of the Home Warranty Policy, as if it had been in place at the time of closing. They informed me that they would back date the policy in order to accommodate the claim request and that their liability under the provisions of her policy, would be $144.00. They also advised me that they could not pay this amount if the policy was to be placed in effect at a later date.I spoke with the Purchaser shortly after the conversation I had with the Home Warranty Company and advised her of their decision to back date the coverage so that she could receive what the policy would have covered for this claim. In other words, she received the exact amount the policy would have reimbursed her had the coverage been in effect as of the closing date. She then asked if we would be sending her a check for the difference in what she paid for the service and the amount she was reimbursed by the Home Warranty Company. Since she was paid in full under the terms of the Policy, I did not agree to pay any additional amount over and above what she was entitled to under the terms of her Warranty. In hopes of satisfying an unhappy customer, I will be sending her a check in the amount of $258.00 representing that difference and hope that she will be satisfied with this gesture. Thomas A.
