Review: • On Nov 25, 2011 we entered an agreement with Signature Signs and Awnings to install an awning on our back deck.
• We met with [redacted] several times while we selected the correct fabric and provided specific directions for how we wanted to awning installed.
• Specific instruction included: moving the outside edge out to avoid the awning dripping in the railing, a cut out at the walk path so I would not hit my head on the fabric as I walked thru and installed by 1st weekend in June for our daughter’s college graduation party.
• [redacted] said he understood all these and would have no problem meeting them.
• The awning was installed in late May and none of the specific instructions were met and the awning was dirty and stained.
• We called [redacted] immediately and he stated he was so busy it would take several weeks to get here. We told him to come after the June party.
• We tried to get him all summer to correct his issues and he confirmed they were incorrect and would get to them as soon as he could. We have numerous phone messages from him confirming he understood he did not provided what was contracted and would correct.
• Just prior to Hurricane Sandy he still had not returned to take measurements for proper correction. We informed him the awning needed to come down for the storm and he said he was too busy to do it.
• I removed the awning just prior to Sandy to ensure my house was protected.
• The following week he picked up the awning to perform the corrections.
• Several weeks later, he returned with an awning that was now too big, could not be tightened, had significant gaps along the house and had additional material just added along the house that was not the quality we contracted.
• During our discussions with [redacted] and his helper, it was agreed by all the [redacted] could or would not make the awning as contracted and he agreed to return ½ of our $1,000 deposit and we would end our relationship.
• [redacted] stated he would have the money returned by end of the year.
• We have tried calling all winter so we could reach the agreement made to no avail.
• [redacted] has the awning and the deposit.
• [redacted] has refused all efforts at reaching him.Desired Settlement: We desire our deposit back since it is clear they cannot or will not install the awning as contracted
