Although the consumer simply failed to cancel the day trial period nor returned the item to avoid becoming a recurring VIP Member, after careful consideration and in an effort to resolve this matter, our billing department manager decided to go against our strict no refund no return policy and has extended the consumer a courtesy refund in the amount of $98.00, which has been issued today 2/23/

Our customer service representative thoroughly educated the consumer of the Terms and Conditions he agreed to upon signing up for the promotion. The consumer admitted to not reading the Terms and Conditions as well as receiving the product shipped to him. However, the consumer requested a refund. Our customer support representative explained the very strict return and refund policy in which the consumer agreed upon order placement.

However, the customer declined our courtesy offer. In addition to the consumer's decline of our offer, he also filed a dispute with his financial institution in which deemed each charge as valid and reversed the provisional credits granted to the consumer during the initial stages of the investigation. The consumer was thoroughly advised of the dispute process upon his declination of our courtesy refund offer and advised once a dispute has been filed we will no longer honor the $49.00 refund offer.

I had no idea that this was for a $98.00 VIP membership subscription service with a 14 day trial. This was never brought to my attention in the internet pop up ad. Interesting that the pop up ad never went to their web site. The ad stated that you would get a free pair of sunglasses or shoes. All you have to do was to select which product that you want and to pay just the shipping cost which was $5.99. Once I put my credit card info to pay for the $5.99 shipping I then got an email Order Confirmation that said Shoefashionize Male Sunglasses 401 - Order Total $5.99 and that was it. There was no company name, no business web address, no phone number, no membership number, no membership sign up or info in the email stating that this was for a VIP membership with a 14 day trial. I only got an email invoice for the sunglasses and that was it. When I got the sunglasses there was no info on the business or terms and conditions agreement in the box. So I got in the box what I thought was what the pop up ad stated. I had no problem with them taking $5.99 from my credit card for shipping charges but 15 days later they then took an additional $98.00 from my bank credit card.I had to do a lengthy Google search to find their business web address and phone number. I finally found their number and called them and they told me that they do not do membership refunds after 14 days. I had told them that I was unaware of and did not see the terms and conditions from the pop up ad. They told me that they usually don't refund at all but that they would refund me only $49.00 if I signed a waiver. I was not happy with that because I should be refunded $98.00 instead.I felt ripped off because the cheaply made no name sunglasses that was sent to me was not worth even $9.00. A legitimate business would link you to their website but the pop up ad just gives you an order form and you put in you credit card and shipping info and that was it. I saw no Terms and Conditions statement in that pop up ad.If I would have seen those terms or a membership sign up I would have never fallen for that. I strongly feel that I was tricked and later penalized by this business. They have taken my $98.00 and won't give it back to me. I have not an will no used those sunglasses that was sent to me. They are still in the shipping box unused. I would be more than happy to send the sunglasses back to this company. An honest and legitimate business should be more than happy to refund an unhappy customer if the customers was not satisfied with there products or service. I am a retired military senior citizen with a very limited set income and $98.00 is a lot of money to me. I would really appreciate it if this business would do the honest and right thing by refunding my $98.00.

Our company is not affiliated with the third party organization described by the consumer. Therefore, we are not responsible for the advertising used to offer the consumer to fill out surveys. Once the consumer was redirected to our company website it was his responsibility to fully read and understand the terms prior to agreeing by checking 2 separate boxes on 2 consecutive pages. The consumer enrolled in a trial membership, overlooked the Terms and Conditions, inquired about the charges incurred. The promotion the customer signed up for was fully explained to the consumer. Despite our strict refund policy, the consumer was offered a courtesy refund of $49.00 (50%) and advised to keep all products received, in which he declined and filed a dispute with his Financial Institution. Respectfully, we decline the customers refund request.

This company stated that it was not affiliated or responsible for the advertisement of their product. How did they not know about this type of advertisement? I was never directed to their website.I had no idea who these people were.After they charged my credit card the additional $98.00 I had to go on Google to find there website. If I would have seen there website and saw that this was a membership subscription I would have never done this. I was never given the opportunity to see there website before purchasing.As I said before I would more than happy to send them back the unused sunglasses for a refund.
