Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Due to the negligence and my personal insurance company, USAA, contacting Mr [redacted] requesting his commercial insurance information after I refused the information, "I and My Insurance Company contacted" Liberty Commercial Insurance to file the claim on June That is when and how the claim was filedFor days July 2015, I - , I was not provided the Mr [redacted] ***'s Commercial insurance as my car sat at Kearney Pearson Ford until he contacted my insurance company and provided them the information who in turn contacted me and a claim was initiated by me and my insurance company.Through all of the documents, multiple inspections and findings by three different companies with Liberty Mutual Commercial being the last, it was determined that my mechanical failure was due to "workmanship" base of Mr***'s pre-work documentation on my vehicle one June 2015, post-work on my vehicle on June documentation, mechanical issues on June 2, resulting in me towing back to his shop, My videos of Mr [redacted] "driving" my car in the lot, reviing the engine while on the lift as his mechanics search for a leak, Mr***'s mechanics and remove and reapply the oil filter that they placed on my car the day priorThen upon final stall of my car, Mr***'s sent mechanic to my location with the portable diagnosticThe video and audio clearly states the mechanic stating that the problem with my vehicle is a "Mis-Fire" based of the codesWhen the car was towed to the dealership, the CODE HISTORY had been erased With all of that, I have lost a great deal of time from work which has impacted me FINANCIALLY due to this mechanical workmanship at Shift Auto and TireIn addition, my car was in the shop for days which I was unable to driveMy financial damages because of this resulted in loss income from work and paying for something that I could not use.Mr [redacted] ***'s Insurance Company upon their own independent inspection and evaluation by two separate companies determined that based of all of the facts, paperwork, pictures, interviews with Mr***, Kearny Pearson Ford, and myself that he was liable for the damages and covered the repair and rental car.I am requesting that Mr [redacted] do the right thing prior to being subpenad to court for the Civil Suit to reimburse me for lost time and expenses due to workmanship negligenceIn court based on this issue, Mr [redacted] can be held liable for 3x the amount of damages and court cost.I am requesting Mr [redacted] settles this matter out of court for If Mr [redacted] disagrees with the amount, then he can submit an amount to your office.I will wait on his response or no response and then this matter will move to Civil CourtLegal Counsel has been reviewing ang working on this matter but we are waiting to see what Mr***'s response is[redacted] Regards, [redacted]

Due to the negligence and my personal insurance company, USAA, contacting Mr. [redacted] requesting his commercial insurance information after I refused the information, "I and My Insurance Company contacted" Liberty Commercial Insurance to file the claim on June 9 2015. Review: June 1 2015- Took car and waited on oil change. KIA Optima Hybrid with 46,000 miles and never having any type of mechanical issues.Prioir to & after work, service invoice states so. Drove app 30-38 miles to next use on June 2, 2015. Within 1/2 mile of driving, oil light came on. Arrived at destination app 8-12 miles and smelled burning. Parked, turned off car, raised hood and motor oil exploded everywhere under hood. Checked oil level, bone dry. Waited to recheck after 20 minutes, bone dry. Insurance company dispatched tow and delivery back to Shift Auto & Tires. *MOTOR OIL ALL UNDER HOOD, IN EXHAUST, UNDERNEATH CAR, ON GROUND, ETC (PROBLEM #1, FILTER WAS NOT TIGHTEN UPON INITIAL INSTALL) Once there, the owner [redacted] plus 2 technicians pushes vehicle to bay area and raises vehicle on lift. Technician #1 removed their installed oil filter & reinstalled, lowered from lift, and owner drove car around lot for app 10 minutes. Car placed back on lift & lifted with owner behind the wheel. [redacted] continuously accelerating car while technician #1 is looking for oil leak(s) with existing oil covering the bottom of car. NO LEAK(S) FOUND! Car lowered again and [redacted] drives car a 2nd time around lot for appx 10 min & returns back to lift. I tell him I refuse to drive the car because of unknown damage that has already occurred with no oil & I was taking it to the Pearson to be inspected & he needs to take responsibility for his work. I took car to Pearson and NO LEAKES FOUND. Leak inspection done & cleaning motor oil from under hood. Cause of oil leak due to loose oil filter upon initial install. Drove the car and within 20 minutes, car would not accelerate, all lights on panel came on, and car shut completely down. Car towed for the 3rd time of day to Pearson and the diagnosis is a blown rod. REPAIRS ARE OVER 4700.00,RENTAL CAR @29.99 PER DAY, & EXPENSES LOSS OF WORK. ALL OF THIS IS BECAUSE OF AN OIL FILTER NOT BEING TIGHTENED COMPLETELY. TECHNICIAN #2 HAS ONLY BEEN THERE 4 MTHS. STILL IN TRAINING.Desired Settlement: (1) TOTAL REPAIRS due to their negligence PAID FOR BY SHIFT AUTO & TIRES to Dealership(2) All work to be done at and by Kearny Pearson Ford & Kia(3) Reimbursement for all rental care expenses(4) Claim submitted to Insurance Company of SHIFT AUTO and TIRES(5) Consumer Affairs to be notified of COMPLAINT(6) Payment for LOSS OF WORK due to the car being towed 3 times on that day due to the MOTOR OIL exploding in my car and not having oil in my car due to their negligence
