As the
owner/broker of Shay Realtors I can assure you we take any concern about our level of services
very seriouslyI am pleased to provide information concerning this incident
On behalf of our clients, we advertised their home for lease in Carlsbad, California for $3,a month
We experienced an exceptional response with about forty people expressing interestThe owner selected
another applicantMr*** was advised he was not selected and his application was shredded
A few weeks later the selected tenant advised us they could no longer move forward due to a family
emergencyThe owner decided tore-advertise their home for rent at a price of$3,Your
complainant was never selected, never under contract, and was never told the owner had selected him as
their tenantHe has been advised by my staff as well as myself that his personal information has been
shredded
To claim we violated Federal Trade Commission regulations on his YELP review, demand we "abandon"
the listing in his letter to you and to pay him money to stop his harassment of our company is
unreasonableI will be referring any further issues on this matter to our legal counsel

I have accepted the response to end this dispute just to stop this waste of time with Ray and his realty. I am very dissatisfied with how they handle their business. They wasted my time and I am sure they careless about other consumers' time and my review is to protect future applicants before they disclose their sensitive information. Their agent contacted me on 8/11 offering the same listed property and we were writing back and forth without ANY MENTION of the increase in the rental fee until 8/14

After this email we went back and forth with emails (11 times) WITHOUT ANY MENTION ABOUT THE RENT INCREASE! AND THEN ON 8/14 THIS:
Hi [redacted],
I apologize for the mis-communication. I have stepped in to take over for [redacted] half way through her closed transaction which has now been reopened and has made it somewhat confusing. I sincerely apologize.
The rental in Carlsbad has been relisted for rent, however, due to some recent upgrades on the rental the new rental price is $3695 per month.
If there is still an interest please let me know. I can show you the property as early as Monday.

This is an unacceptable behavior and if Shay Realtors is ready to do business then they have to provide their agents with the necessary training so that their applicants' time isn't wasted before they realize they have shared sensitive information with them. I am sure the FTC will not like that.

Review: On 7/13/2014 I have attended an open house in response to an ad presenting a home for rent in Carlsbad, California [redacted]. The house was presented to us by [redacted] (property manager under Shay Realtors). [redacted] and her agency listed the house for $3500 and based on this monthly fee with good intention I have filled an application and provided them with my sensitive personal information (email). Few days later [redacted] emails me back that the house will be rented to other people who submitted the application. I have stopped communication with [redacted], but few weeks later I get an email form her offering us the same house again for which we have accepted. She then gave responsibility to another Realtor [redacted], after a week of wait taking her time to respond she responded by INCREASING the originally agreed amount of $3500 to $3695 AFTER I have submitted my application and shared my sensitive information with them. I object to such behavior displayed by Shay and his real estate Shay Realtors in San Diego and I request that they abandon the listing 6519 Avenida Del Paraiso for breaking the original contract or $250 for every hour wasted trying to do business with them (5 hours) and that is $1,250. Also I request an official letter which certifies that my information is completely destroyed at their end, including email and hard copies.Desired Settlement: A certified letter to knowledge the that my sensitive information provided in the application have been destroyed.and$250 for every hour I have wasted doing business with Shay and his real estate agency. (5 ours)orAbandon the listing of this Carlsbad property for breaking the contract. The owners must be held accountable for increasing the price after the original agreement.
