Shawn Green was trimming the trees around the 1900 building in Melbourne. He was on the opposite side of the parking lot when the incident I am about to describe occurred.
I pulled into the parking lot of the 1900 building. I was looking straight ahead as I was ascertaining whether I could keep going forward to get to the Melbourne Chamber of Commerce parking. I quickly realized I could not so I decided to park to my right in the 4th parking spot from the road. As I pulled into the parking spot my back tire rolled over something which turned out to be a silver adjustable ladder. The result of this back tire catching onto the ladder is that my tire popped. I got out of my car to see what had happened and from across the parking lot Shawn yelled over that he needed the spots to be free from cars so he could trim the trees.
Next I jumped into my car and moved to another spot and realized my tire was completely flat from running over the ladder. It was at this point I began to approach Shawn and his female worker. Immediately he and his partner took a defensive stance and basically inferred that I was a dumb as for not seeing his ladder in the parking spots. He admittedly said he ran out of cones and so he used a ladder instead. He claims that I saw the ladder and it was my fault. If I had seen the ladder why would I have driven over it? There were many other spots to choose from. The reality of the situation is that I did not see the ladder as I pulled into the parking lot as I said I was focused on the other end of the parking lot not the spots to my right. Had there been cones I would have certainly seen them because that is why cones are used and not ladders! When I decided to pull into the 4th spot the ladder was on the ground and out of view from my SUV. There was no way of seeing it from that vantage point. Shawn's use of a ladder to block off the parking spots was reckless and he should take responsibility for the incident.

I, Shawn Green was working on January 24, 2019 at the 1900 building in downtown Melbourne trimming all palm trees on the proproperty. We were working on the roadside where there was 12 palms along the road, we saw above driver, drive through the parking lot pass us along with all the cones we had blocking off the parking spots so she saw we were there working. We saw her try to squeeze into said parking spot, we knew she saw our ladder because she tried to drive around it she then drove over the bottom of our ladder, backed up ,pulled back into the spot running over our ladder again and then backed out again. I saw what happened and went to tell the lady she ran over my ladder, she then approached my wife and I yelling and cussing so we stopped talking to her even when she took a picture of my wife and my trailer. She had the owner of the building put on her spare tire and they talked to her for a while. She called us later on in the day to harass us some more and even told us she took pictures of the cones in other parking spots. Our ladder had been there for at least 2 hours, and nobody else parked anywhere near it. The lady's driving was wreckless and looked as though she did this on purpose with the way she acted when we went to talk to her. I even messaged her later on the same day to ask if her tire was fixed and she did not respond. I have been in business over 20 years and have always used my ladder to block parking spots when I run out of cones, and I have never seen somebody purposely run over a 32 foot ladder that cost well over $500 until this day. This was in no possible way, my fault that the lady ran over my ladder and backed up over it a couple times until her tire popped.

I do not accept this response because of the ill conceived notion that I would purposefully run over a ladder.Why would I pop my brand new tire on purpose? It makes no sense.
I did not try to squeeze into any parking spot. There were dozens of parking spots to choose from. I did not need to squeeze into one. I was simply not aware of the ladder that was being used in lieu of cones.
I also did not see this man and his truck as he was more than 500 feet away to the left side of the parking lot and I was to the farthest right. Nor did I see any other cones that he is referring to and thus did not take pictures of them. And from that distance how could you ascertain what I was thinking and doing?
As far as the ladder being used in replace of cones, I guess this will have to be brought up with OSHA to see if this is a safety hazard. A ladder is not an appropriate use as a barrier.
The only way to have seen that ladder was if I had looked at the few parking spots that were at the beginning of the parking lot to my immediate right before pulling into the entire parking lot. However, I was pulling into the lot from a busy road so my concentration was on pulling into the parking lot and looking straight ahead; not at the first few parking spots. Thus as soon as I was into the parking lot the ladder was on the right side of my car and out of my vision. There was no way to have seen it at that point. I would have had to observed it before pulling into the parking lot itself which again I was looking straight ahead. If there had been cones I would have seen those as they are red for a reason.
Also, I only caught the edge of the ladder once and did not run it over again and again as you say and my driving was far from reckless.
What was reckless was using a ladder as if it would do the same job as a red cone. It was clearly not a marker that got my attention as no one would be looking for a ladder in a parking lot.
As far as the shouting match goes, I was not the instigator. Shawn and his wife took an instant defensive response calling me names and threatening to call the police. It is clear that you are too ignorant to understand that a ladder should not be placed in a parking lot to deter drivers from parking in spots. The reason cones are red is to capture the attention of others. A ladder, when one is not expecting one in the parking lot, does not capture the attention of someone who cannot see it from their vehicle.
Also, the call I made to the company was to talk to the owner about the situation, but upon that call I realized that I was already dealing with the owner so that attempt at trying to reconcile the situation was fruitless. I did not call to harass, I was simply inquiring about the owner. In fact I was very cordial on the phone even when it was apparent that I was dealing with the same unreasonable person. I hung after the accusations began again. There was no use speaking to someone who was clearly taking absolutely no responsibility for the situation and deflecting the blame.
And the funny thing about all of this was that the only reason I approached you in the first place was to ask for your assistance in changing my tire! See what unreasonable aggression begets?
This is very childish going back and forth with somebody who does not take responsibility for their own actions. As I've stated previously I have been in the tree business for 20 years, and have never seen somebody act this way. Maybe the Melbourne Chamber of Commerce has cameras outside, that could prove that you backed over our ladder a few times trying to fit into this spot. Many cars saw our ladder there blocking the spots off so we could trim the palm trees, but for some reason Mary did not. I am not responsible for a licensed driver who for some reason can't see out their own windows to see a 32 foot ladder used to block spots off. Also, you claim you didn't call me and state you had taken pictures of the cones. Really? You must've realized that you only further proved our point that you knew we were in the parking lot trimming all palm trees, but please don't lie when it comes to somebody's livelihood. You did not approach me first, I approached you to say you were running over my ladder but then saw you run it over a few more times only to pop your tire, and ruin the edge of my ladder. I really hope one of these businesses has cameras to prove that you did this, we are not at fault and when we went to ask if you were alright or needed help you yelled at both of us, said*** you to my wife and took pictures of us.We would've helped you right when this happened if you hadn't acted like this was our fault, even coming over to me stating "your ladder popped my tire". How on Earth can an object such as a 32 foot ladder move and pop your tire? You drove over my ladder and therefore popped your own tire. Cones are orange and not red so people can see them, but you know that because you called and told me you took pictures of them throughout the parking lot. You talked to the owner of the 1900 building and they even told you exactly what was going on, and even told you that you were parking in his parking lot not the Melbourne Chamber of Commerce where you claim you were going. My ladder was a very clear and large marker that we were out there doing tree work, and you were on the same exact side of the parking lot as we were working so please stop stating you didn't see us when you clearly did. This is the last time I write back to this childish nonsense, I did nothing wrong, my ladder did not pop your tire you ran over my ladder and did that yourself. If you replace my $500 extension ladder, I will replace you a tire that you popped.
