Complaint: ***I am rejecting this response because: the company notes that there was no documentation on my employment history or my request to keep the residence absolutely crime free I have witnesses who were with me at the initial meeting with the agent where I diligently explained that this was absolutely a requirement She agreed and maintained that it would be noted on the account which it obviously was not It is absolutely not my fault that it was not properly documented Also the house had not suffered wear and tear There was furniture left behind in the house as well as the yard, there was a dead cat found in the front garden bed, the blackberry bushes have yet to be controlled due to their lack of maintenance due to the tenant error Not only were they not aware of the tenant running a childcare business out of my home they failed to check on complaints made to the city by neighbors as well as calls made by myself and my family who are local regarding the status of the yard The bathroom door was kicked in as well as the sinks in the house in disrepair I have never in my life lived in a house for two years and Seen the level of disrepair and neglect that my house was left in It is in your error and lack of management that my home is the way it was left by the tenants as well as your fault that it was not properly documents that I required absolutely no criminals in my residence This directly affects my job where I had to file paperwork to report it I have witnesses that can attest to the requirements of the renters as well as the complaints made against the upkeep of the residenceI also have witnesses that can attest to the renter running a childcare business out of the residence This company would rather collect money than follow up and take care of the problem. rentingEnclosed please find a copy of the management agreement along with a copy of the emails exchanged by Ms*** and our field agentYou will note that she asked a number of questions regarding the property and future tenants during this time, but at no point was there any mention of a potential tenant having no criminal historyThe management agreement itself allows for specific desires of an owner also, where again, there was no mention of criminal historyOn January 15, we processed an application for the unit for a couple from CaliforniaWe ran credit, employment, rental and criminal history, all of which came well within the realms of acceptabilityThe male applicant did have one DUI/marijuana charge from the past in California but that would not negate us renting to himThey were approved to take possession of the property on January 31st, when they signed their rental agreementDuring the following two years we collected rent each month and disbursed to the owner's bank account the balance, minus the management fee of 10%We inspected the unit months after the tenants moved in to be sure they were abiding by their contractAt that time the field agent noted that the condition of the house was 'very good' with the only problem noted that the yard was not completely mowedAll rooms in the house scored a out of on the inspection formThe most recent inspection done in did not note anything more than 'wear and tear' for a two year tenancy of a family with children other than, once again, the yard needing addressedThe tenants did assure the agent they were going to 'take care of it' but failed to do so prior to movingThe inspections and a stellar payment history along with a lack of any documented complaints or compliance issues allowed for us to move those tenants into another of our managed units upon move out on January 31, To be fair, we did move them into a unit with no lawn care as that was a problem area for themThe disposition for the tenants included charges for the cleaning, maintenance and yard care that would be needed to again make the house 'rent ready'Their $deposit was kept and deposited in the owner's account on February 27, The disposition shows charges above and beyond the deposit that will be revised once the owner provides us with actual receipts and time used to ready the unitIf the tenants do not make the payment at that time, we will then send them to our collection companyThere is nothing noted in the file anywhere regarding Ms*** employment history and the owner's employment is not something generally discussed in executing a management contractIf there had been a written request noting those specific concerns, we would, of course, have done everything in our power to honor itAs for her complaint of an alleged day care in the home, once again, we have no documentation that anyone let us know of this concernOur policy is to issue a day compliance when we receive complaints of this nature and there are none in the tenant fileWe do not deliberately ignore complaints of this nature as taking care of the properties we have been entrusted with is of high priorityWhile there are always inherent risks in making your home into rental property, there was nothing that caused us undo concern in this contractWe ran backgrounds on the tenants at the time of move out as we were processing them for another of our homes and found no new criminal historySince receiving this complaint, we again ran the tenant for criminal history and were unable to verify anything new within the state of WA where they have residedWe feel we have abided by the terms of the signed management contract and have provided Ms*** with two years of regular rental payments on her homeWhile we understand that Ms*** is unhappy with our services, we will continue to work with her on obtaining the final funds owed by the tenant when she provides the needed informationWe hope that with the attached documentation you can see that we followed the contract that we had with Ms***Please let us know if there is anything more we can do to helpSincerely,

The intent of this letter is to respond to the complaint submitted by *** *** on July 18,We have been managing the rental property in question for Mr.*** since April of Since the time of this initial complaint, Mr*** opted to move management of his property to another agency and his account has been closedThroughout this long business relationship, Sharp Property Management worked diligently with Mr*** in an attempt to operate in his best interestsOn occasion, this would include allowing short term, interest free loans from our company if there was an expensive turn over or repair-- something virtually unheard of in our industryDuring the course of this contract, a recurring theme of our management relationship was often Mr*** desire to spend as little as necessary, and to rectify maintenance situations only when an urgent need presented ItselfTenants in the home would often come to us with a long list of maintenance concerns, but Mr*** would opt to take care of emergencies or easy fixes but continually ignored certain requestsFor example: The tenant had repeatedly complained regarding old, inoperable windows and Mr.*** stated he had no intention of replacing them-his mind only changed when we inspected the issue while resolving other problems and explained to him that it was definitely a valid concernOver a year ago when the tenant complained about the tree branch, we sought the opinion of a local professional arborist, Champ's Tree Service, to assess the tree and offer a quote to take to Mr***We were told, quite clearly, that the branch was not In any danger of fallingOur job as property managers Is to take the stress of rental management away from the client- this includes times where a tenant may report maintenance issues (such as this tree branch), in which a professional told us there was no need to incur an expenseBased on that assessment, if we did not inform Mr***,it was because there was no need to do so, and even if we had- based on that professional opinion- we have no doubt that Mr.*** would have opted not to spend hundreds of dollars rectifying an issue that we were told did not existIt is also worthwhile to point out that our Management Contract with Mr*** contains a "Hold Harmless" clauseThis clause specifically states that unless there is willful misconduct or gross negligence, we are not responsible for costs incurred at his rental propertyWe operated with the information we had at the time, garnered from professional contractors, and are not guilty of any sort of willful misconduct or gross negligenceIt is our opinion that Mr.*** rental property suffered an unfortunate incident with expensive resolutionsIt appears to us that after years of working hard for Mr*** best interests, and working above and beyond what we do for many clients, he is attempting to use our company as a financial scapegoat now that the situation has grown more direWe are sorry that this business relationship did not end amicably, but we accept no liability in this case and consider it closed

The unpaid water bill was indeed left by the previous tenantAfter the tenant vacated the property, their entire security deposit was retainedThe complete balance of Ms*** account was sent to her in order to pay for the costs of damages and the unpaid water billMs*** had cancelled management, and the funds were disbursed, so we had no money with which to pay this billAny "ongoing" issue with a water bill is Ms*** to deal with, and would easily be resolved by paying the past due bill on her propertyWe would never have assured Ms*** that all bills were paid for, though we might have assured her that all unpaid bills and damages had been charged on the tenant's security deposit dispositionThe owner of the company did indeed leave a message for Ms*** to the effect of which she statedWhile Ms*** is correct that an unhappy customer has a right to share their experiences on the internet, it is rather the content of these postings-fraught with misunderstanding and half-truths-which prompted our owner to explain to Ms*** that slander and libel is on offense which we take very seriouslyMs*** phone calls to our company were foul-mouthed and abusive, and we do not condone subjecting our employees to abuseThe staff was instructed to hang up, should Ms*** continue to exhibit this behaviorFurthermore, Ms*** refusal to be reasonable and acknowledge the content of the contract that she signed leaves us in a situation where court is the only avenue remainingOur decision is finalMs*** will undoubtedly continue to reject our responses hereShe seems content to continue harassing our company rather than take the matter to the courts where it will be decided in a lawful and unbiased venue as we have suggested on multiple occasionsWe respectfully believe any further discussion here would be mute, and request that Ms*** take the matter to the courts for any further interactionSincerely,

Complaint: [redacted]I am rejecting this response because: There are many untruths and inaccurate statements. There is no half truths in any of my reviews.  There were no foul or harsh words used when communicating with the company.  The company continues to act in a childish manner.  It will be dealt with in court. The owner has dealt with this and any phone calls in a very threatening manner.  Never in my life have I dealt with an individual like this before.  This will be dealt with in court.  The tenant still owes money for which I'm sure I won't see due to the disagreement with this company.
