Hi ***, The membership you signed up on was our grand opening rate which every gym or new business doesWhich wasn't our rate Like any business we can't operate charging the same price now as we did almost 5years ago as expense and minimum wage goes up every year We have never done a lifetime membership that will guarantee a rate as we know cost to do business changes You also weren't a member for years and last year we ran a holiday special but it was a one year deal to the club You also provided a email to the front desk from which you then had a year gap of being a member which would discount you from anything that you used to payOur paid in full rate is $and we told you we would give it to you for $and your spouse for $also even though she wasn't a member last year The only person who would be authorized to do something out of the norm would be me and even I couldn't guarantee you a membership for a lifetime Nobody in any of our locations pays $for a year even people who have been members for all years we have been open Not providing you with a rate we don't have or offer isn't having bad customer service, we can't let customers determine our rates for the business
I am rejecting this response because:This is the first time I am being told I need to provide proof of moving outside the mile limit per my contractI would be happy to provide proof [redacted] said all docs I have provided were sufficientWhat shall suffice? USPS confirmation of move? Utilities in my name at my new address? You let me know Also, I just spoke with [redacted] this morning with someone named Sharmaine and she confirmed after speaking to her supervisor that I do not owe a cancellation fee due to the fact that I provided military change of station ordersEven so, a cancellation fee does not make up for the discrepancy of the refund amount I am disputingI paid $in April for a years membershipI gave notice in August and am to be refunded for unused services from September 2017- April At a monthly rate of $over the course of a year, with months I am owed, $186- I don't know how the figure of $was decided out of thin air.? Is the cancellation fee $86? I require an itemized breakdown as to how you come up with that figure being that your finance company has told me on several occasions that I am not to be charged a penalty for my husbands military obligations to moveI attended your gym for months and paid $I will provide you proof of move as well as provide you with my card for refund- but yes- I do dispute the refund amount still as you have not been able to provide me any type of explanation of charges as to how you came up with the figure of $ [redacted] says an "email from [redacted] states that is the refund amount" but they deny that they are responsible for establishing the prorated amounts - the gym does that since they received the initial payment [redacted] states he doesn't know how to process a refund so someone who knows how to proceed quickly should address the situatioI will be contacting the California Department of Consumer Affairs as well if this does not get handled in a timely manner [redacted]
We have never taken a verbal cancellation at the gym nor does any other health club The agreement is in writing and we would of needed a cancellation in writing with a day notice which is standard practice in this industry The person working the front desk would have no ability to cancel a membership so demanding him to stop the payment is out of his abilities Another reason we need it in writing is exactly because of this issue We need a paper trial we cant run business off of members who are past due just telling us oh I told them at the front desk to stop the membership The billing company handles all the cancellations acts almost as a corporate office because we are a small business and couldn't keep up with the volume of our facilities cancellations, freezes, relocation, and medical issue of all members in-house
I am rejecting this response because:Can you please explain to me how a customer “earned” the annual renewal rate of $99? This rate was not the annual rate charged at that time or any time for that matter As it was explained to me and noted in my original contract (which I have provided the Revdex.com with a copy), years of full cost dues were paid in advance ($849) in order to obtain a $annual renewal rate after the 3rd year This is clearly stated in my original contract Nowhere does it state that this rate will be subject to review, increases, changes, etc In fact, it was sold to customers as a way to lock in their rates and not have to be subjected to future rate increases So please explain to me how this special promotional program really worked Did he $that I paid in advance only allow me to renew one time at $or was it as long as you felt like honoring it? Neither makes much sense does it? I was told that as long as I remained a member in good standing, I was entitled to the $renewal rate every year after the 3rd year That was the sales pitch at the time and that’s what I’ve been paying up until now when you’ve decided that it’s no longer a good deal for you So again, please clarify how this deal really worked and how a customer “earned” this $annual rateThank you
I am rejecting this response because:First of all, I have been a member of many gyms, such as [redacted] , that has given me the same rate since I enrolled even though new members now have to pay more to enroll in the gymIt is called a contract for a reasonWhen I sign up for a price I expect to get that price continuallyI did not leave the gym until they raised my price unexpectedly the first timeYes, you are correct, no business with a F rating on the Revdex.com, that lies to their clients, and has such bad customer retention can operate on opening pricesUnfortunately, if you kept your promises on your contracts you would probably have more customers and therefore more income Second, I did not demand a priceI was sought out by the sales rep in an effort to bring back past gym members that had been burned by the business under past managementThe head of the sales department offered me a raised, but reasonable rate, with the promise that this rate would be on goingI had hope that the gym was finally going to fix their reputationHe put it in writing to assure you that I am not making up this price or demanding anything I was not promised by your employeesI have confirmation from two separate employees that my rate would not be changed againIf it is true that two employees have gone behind your back and offered deals they are not authorized to do, maybe there is a bigger issue withinLooking at my situation from a customers view, would you be ok with a business giving you promises and not following through time after time? We can go back and forth on this issue, but I have it in writing what my contract wasI hope you are a man of your word and will take responsibility of your employee's actions
I don't have a copy of the cancellationIt's a form that is filled out on their site and then printed off and mailed to a PO BoxStupidly, I did not think at the time that I would need proof of this years laterI am happy to pay the last month's fee, however the problem that I have is that it's on my credit report and I am being asked for times the monthly feeI tried to resolve this with them over a year ago, and I wasn't able to do soClearly there is fault on both sidesI do not think that this should appear on my credit report, as clearly there is a serious problem with their billing/collection practices
I am rejecting this response because:Thank you for your quick response, however, I am fully aware that the cost of doing business generally increases over the yearsKnowing then that this “phenomena” occurs, I accepted a promotion by your company which gave you operating cash up front (years of membership dues) and in return allowing me to lock in annual membership dues at $per year thereafter The agreement wasn’t, “Give us years of membership fees up front and then we MIGHT give it to you for $per year thereafter if we can afford it”If that was the case, I wouldn’t have chosen this agreement Who would have? I am also aware that you are no longer Gold’s Gym and have changed to California Ripped Fitness The ownership, however, has not changed and unless the business has filed for nkruptcy protection, it is still responsible for all assets and liabilities incurredI also find it hard to believe that you can’t find my original contractHowever, on June 28, 2014, just as you transitioned to California Ripped Fitness, you did honor our agreement and renewed my membership for $so your argument that you are, “No longer Gold’s Gym” doesn’t hold waterAlso, didn’t you review my contract at that time to ensure my renewal rate was $99? In an article published on February 19th, 2014, by the Sacramento Business Journal then Director of Operations for California Ripped Fitness, Nicholas Trosko, stated, “Other than the new name There were no changes in staffing or membership fees” Was that a lie? I’m simply a member who consumes virtually nothing at your gymYou are acting as if I’m a customer sitting at your buffet eating all of your food I am sorry that this is no longer a good or profitable deal for you, but it happens to be a good deal for me and it is the agreement we made and you should honor itIs there a waiting list for people to join your gym and you need to get rid of the older non-profitable memberships? It’s hard for me to believe that you would treat a faithful year dues paying member in this fashionI paid my dues even during the years when I didn’t use your gym in order to keep our agreement Should you refund my money for those years I didn’t use the gym?...I didn’t think so Look at it like this .My car isn’t worth as much or look as nice as it did when I first bought it, but I keep making the same payment because that’s what I promised to do when the bank loaned me the money All I’m asking is that you do the right and moral thing and live up to your end of the bargainOne more thing, your sales associate did not offer to meet me half way as you previously stated He offered me one free month if I renewed at $per year and signed a year contract That’s not meeting me in the middleThis complaint can be easily resolved by renewing my membership at the previously agreed upon rate of $per year Thankyou
We did have a electrician out several times and the problem has been fixed and the childcare is up and running There was a leak in the roof which caused some issues and we took it to the property owner and both the roof and lights have been fixed [redacted] and family have both been back to the gym on a regular basis so I hope everything is well and we are sorry for the miscommunication
Because of the amount of time this took we just refunded [redacted] the amount she felt we owed herWe didn't charge her the relocation cancellation fee that we would normally charge so I hope she can see we did our best to satisfy the member
There is no fraud happening on either end from CA Ripped or the billing company if you would like a copy of the contract you signed that states the terms we would be happy to provide one to you at the facilityAlso if you provided an email upon signing up then you also had one sent to you upon the time of signing upThis sign you state we had promoting a month to month im not quite sure about we do yearly termsIf you would like the membership canceled then you will have to be out of your term and follow the cancelation process
I am rejecting this response because:I understand the days and times your gym is openI never said that you prevented me from using the serviceHowever, I did say that I repeatedly tried contacting your management and was never able to get through to anyone, nor did I receive a return phone call from the facilityThe collections agency did contact me, as I stated previouslyAt that point I had already submitted a written cancellation formI understand how to pay bills, thank you very muchI am disgusted by the rude service I have repeatedly received from your gym, and I suggest you take a look at your Yelp reviews if you think I am the only customer to have had this problem with youIt's absolutely infuriatingIf you went out of business tomorrow, it wouldn't be soon enough
I reached out to the member on the phone and we got this matter setteled
Nowhere in the contract does it say you can have this rate for lifetime! Once again as I explained before, that was a Gold's Gym deal and that rate you continued to pay for 12yrs At this point we are CA Ripped Fitness and no longer have that rate nor are bound by any contract at that rate! So at this point there is two options you can pay the new discounted rate or you can choose another facility This is the situation for all the members and not just yourself, most of the old Golds members decided to renew and stay here with the discounted rate we are offering to them This rate isn't negiotable and we are not forcing or automatically charging it to anyone it is absolutely up to you We love to keep all of our old members but this is the best deal we have for any of the members Hope you will continue to use CA Ripped Fitness as your health provider
Hi [redacted] , If you have the proof of you sending in the cancellation paperwork we can definitely take care of this issue for you This is why we recommend sending these documents in certified mail so you can track this As national fitness stated to you when you called we would need a written notice to cancel your agreement, this is pretty standard practice in the health club industry
Good afternoon ***,In regards to Mr [redacted] #membership at California Ripped Fitness, if moving forward Mr [redacted] chooses not to pay for the last two months per his signed contract, then he will be sent to our collections agency, where his credit score may be impeded negativelyAs a courtesy, we already started the cancellation process for Mr [redacted] Our cancellation process requires that our members have to send in a written cancellation letter to our ABC Financial corporation, that process is a day process in which our members get charged their last month dues in order to cancelWe, again as a courtesy decided to forego that process for Mr [redacted] His membership will still be cancelled out as of January 11, 2017, however he still must pay the remaining two contractual monthly dues, or get sent to collections Best regards, [redacted] CRF Management
Does [redacted] have his receipt from certified mail? That is what is suggested for sending these in.
We have no record of any $payment for s cancelation fee! There was a $payment made in april which was a payment made because your account was past due! The billing didnt go thru in April and thats what that payment was for, was your past due amount! But since you are out of contract I will get your membership canceled!
This morning my account was cancelled and when this lady got back to work for her second shift [redacted] had called her manager and had my account reinstatedI would like to reopen my complaint against [redacted] He is the one that is causing all this [redacted] had no problem with my Verification of Disability [redacted] is not excepting it and he has some type of vendetta against meShe has never had this problem canceling a contractThe form I submitted is more information than [redacted] requires [redacted] wants my Doc to basically just write a note, he is saying since they are not with National Fitness anymore my Verification of Disability is no goodThis is all [redacted] I will be filing my small claims either tomorrow or Friday at Placer County CourtOnce I get my case number I will send you an emailThis guy should be fired from his jobI am also taking with a personal attorney to see if I can go after [redacted] himselfThank You
When you joined the gym you had a option to do a month to month membership at $a month and $down or a one your commitment that was a month with a $enrollment feeIn your contract you signed a specific signature that states the cancellation policy and auto renew policyThese two options along with a paid in full option were presented to you when you joinedYou picked the 1yr agreementIf you look at your contract you will see you signed it in places with all this informationSo you would not be able to cancel untill your agreements is up and we wouldnt refund anything because you are still in term
With this email attached the membership will be canceled with no further chargesThere has been nothing personal against *** in this matter and we do require a letter from a doctor to cancel our agreements, so we will upload the email to the computer and cancel
