Review: I entered into a lease with this Landlord/Company and was told that some repairs/upgrades were being made and would be completed in 2 weeks and I was moving in in 3 weeks. When I went to move in these said repairs had not all be completed and she said the her loan did not go through with [redacted] to make these upgrades. I asked why she didn't call me and she said she was embarrassed. She would not be able to make these repairs/upgrades for another year or so, but that is how she had sold me the condo. She also told me she was trying to refinance the condo. Little warning flags said that if she didnt get the [redacted] loan how was she going to get the refinance loan. I couldn't move in with the repairs not done and knowing that I may have to leave if her loan gets foreclosed on. So I asked for my deposit back because she had lied to me and not made the repairs/upgrades. She said that according to the lease I signed there were no verbal agreements. So she outright lied to me to get me to rent the condo. And my fault for not reading all the fine print of the lease. So does that mean that I am out my deposit because I didn't read the fine print? We did go back and forth in a few letters and out of the $1500 deposit she has sent me a $100, and $360 for a total of $460, should I just be happy with that and drop the complaint?Desired Settlement: I asked for a $1093.80 which was a week of rent that she had to keep it for me. But she said it was off market for 2 weeks, because she didn't do the things she was suppose to do, so she refunded only $460. I was willing to settle for less of the $1500 deposit, even though she lied to me. I have all the correspondance to this point if you want.

RE: Complaint by [redacted]. #[redacted], San Diego, CA 92119
There are many misrepresentations in
the complaint letter sent to the Revdex.com by Ms. [redacted]. The
first is that I am a business-I am
not-- I am an individual property owner. The second is that I
made verbal agreements with her, which
I did not. She inspected the property on two separate
occasions and again before meeting to
sign the lease. When she met to pick up the keys (the
fourth time she inspected the townhome),
her son wouldn't come in after originally wanting to
move there. It was obvious at that
meeting; she was trying to think of reasons to void the
lease. I told her the town home had
been held for her and that she was responsible for the days
it was not being shown at the rent
rate she had signed for on the lease. She wanted the total
deposit of $1,500 back at that time.
The print in the lease is all the same
size (no fine print) and she initialed individual pages of the
lease. Please note two paragraphs of
the lease: Item #12:
Condition of the Premises (Initialed
by the tenant) and: Item #34: Entire Agreement (signed by
tenant). There is no agreement for
a door (which is under the control of
the HOA) or cabinet refacing, or a folding door.
I have tried to settle this matter by
explaining the position in which she had placed me-no
other tenant and no rent for 23 days, but did agree to only charge her
for 17 days and sent her
a total of $460. I even adjusted the
rent rate for her initially to fit her budget-from $1,995 to
$1,850 a month on which the 17 days of rent was based.
Thank you for hearing my side.

Response:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I am so disappointed in the lies made by [redacted]. I can't believe that she is lying to me or you this way. The whole premise on me renting her Condo was the new cabinets etc. that she was installing and then her loan with Home Depot didn't go through. What lies, lies, lies that she is telling. Anyway, she has her way of lying to get people to rent, and then tells more lies to get her out of not returning the deposits. I am not able to keep her from telling lies, but to file a complaint against her this way is the only way I could maybe at least save another tenant the same problems in the future. Obviously she is not going to give me any more of my deposit back and the way she is lying it doesn't help me to take her to small claims court either. So I will thank you for your time and end this.
Regards,
