SETCO Services has contacted me, a year after we used their services to close on a home purchase, to let me know that they 'inadvertently? gave me an additional $5000.00 dollar refund after the closing of our house. At the time I asked about the additional amount and was told by the SETCO title officer that the $5000.00 was indeed mine and not to worry. They not only waited a year to tell me that they made this mistake but expect me to pay them the entire amount immediately.

Billing Adjustment Ideally I do not desire to pay the $5000.00 back due to it being a mistake on their behalf but also because of the matter of how they have handled the issue from then to now. But because if the money is indeed not mine I will pay it back but request a reasonable and structured re-payment plan. Thank you for your attention to this issue

SETCO was the Escrow Agent responsible for holding an Earnest Money Deposit ("EMD") in the amount of $10,000.00 (two separate $5,000.00 deposits) for the closing that occurred for Clients. The Executed Closing Disclosure shows the EMD or "Deposit" was only $5,000.00. As a result, there was an overage amount of $5,000.00 in EMD funds, and SETCO issued a check to Clients on May 29, 2019 for said overage amount of $5,000.00. Then, on June 1, 2019, SETCO's Closer sent a second $5,000.00 check ("Additional Funds") to Clients that should not have been sent. Clients proceeded to cash the second check on June 4, 2019 without confirming with SETCO whether or not they were entitled to these Additional Funds. Clients were initially contacted on June 27, 2019 with regard to the Additional Funds, requesting that they be returned. SETCO has in their possession the email chain from June, 2019 showing that Clients recognized the issue and agreed to pay back the Additional Funds in installments. Clients were again contacted by SETCO's attorney on April 24, 2020 requesting reimbursement of the Additional Funds. Clients have been well aware of this issue since June, 2019, and have failed to make any payments toward the balance of the Additional Funds as of this date. Further, in the email sent on April 24, 2020 from SETCO's attorney, SETCO expressed its continued willingness to work with Client for reimbursement of the Additional Funds.

According to the response SETCO states I did not check with them that the additional $5000.00 was indeed mine, however, being that they where a few days apart and I live close to the office, I personally picked both checks up from the office and verified with them that they were indeed correct in issue it the funds. Since then I believe the agent I had dealings with has left the company. After the experience I had with SETCO and the mortgage company and the confusion stemming from the lack of preparation on both companies part, and confirming in person that the check was valid, I had no reason to believe the check was incorrect.
SETCO Services, LLC and the ***'s have come to an agreement to settle this dispute.
