In response to the continued complaint from this customer in the email you send on 8-19, here is the reply from *** Byrd, owner, Sea Bird Publications: I’m sorry that *** feels we’re being unfair. I’m surprised it took her an additional months to respond to our offer of accepting $as payment in full. We printed and distributed the 15,copies and have had great results with the publication. She hasn’t paid anything for the ad she ordered and our publications have been in circulation since Novof with her ad in it. I don’t think it’s fair that she receives a free ad for the entire year, but since she hasn’t paid for her ad, that’s where it stands right now. I sent 10 pages of documentation to Mr. [redacted] with specific emails generated by myself and [redacted] Byrd almost from day 1 regarding the inaccuracy of her promise or "contract details". She consistently changes her information of what I will be getting with the distribution of the ad. She promises 200-300 business and the list she provides me is 82 with very few of them being in York County which was my main marketing area. There were very few businesses in the Hanover area and the ones I checked DID NOT HAVE THE FREE PAPERS. The one business I requested by add initially received less than 30 papers. The others I suggested received none. I was told by the man that wrote my credit card number on the invoice the day he gave me 30 papers that he was distributing a total of 1500. She turns around and says that 15,000 were distributed at that one distribution. Wrong. She also stated in an email that the business will receive ongoing distributions throughout the year. Wrong. None were found. She also states in an email that the add will be on line within 2 weeks of distribution. Wrong. It never was put on line. Our communication continued through the end of December when I stopped the charge through a dispute resolution through my credit card. I sent them the same documentation that I sent Mr. [redacted] and the charge was reversed by my credit card company since the terms, agreement and scope of the advertising promise was not delivered and was misrepresented. Now she tells you there were 100 businesses when in fact her distribution list shows 82. This tells me again that this is strictly fly by night operation that will produce only a few publications to give to the people that agreed to take out an advertise knowing full well that the balance will never be distributed in its entirety as promised. I received 30 papers. The one business I recommended had less than 30. I certainly am not paying $329.50 for that. This is not the way to do business. This is not the way to gain repeat business. This is not the way to have business speak highly of the opportunity. I would advise other agents to no consider an advertising venture with this company. In my opinion I do not owe the establishment one penny. Falsification of advertising opportunity, failure to produce what was promised, failure to follow-through with all the parts of the advertising promised to include online advertising and failure to show in actuality what each business really received--if any, failure to provide documentation that 15,000 were distributed, failure to connect with 200-300 businesses as promised.

I don't expect it to happen at this late date and I do not intend to pay for something that never happened. In regards to never contacting her again. I responded through the Revdex.com as I was instructed and that comment was the same as the comment I am giving now. I will not pay for something that never happened and I don't intend that it will happen almost I year later and I do not intend to pay for something that did not happen as was documented by [redacted] in an email. If you can live up to what you say you are going to do as a business then you can't expect people to do business with you now or in the future. Other agents have voiced similar comments from their past but their beef is not mine to deal with. I want no further contact with this establishment. According to the [redacted] Bank [redacted] I have no reason to pay for something that did not happen as was stated in an email and on the phone. The only reason I sent the documentation in again was due to the fact that the bureau requested copies for their files. Whether they were lost or what I do not know. But this edition was so popular that the 100 locations asked for more copies because they really liked them. I explained that to my customer. She paid for her ad with a credit card on 11/25/14, disputed the charges on 1/6/15 and my company was charged back the $329.00 for her ad. Which means she hasn't paid for her ad and the publications have been out in distribution for almost 6 months. So she has a free ad, which isn't right. We sent a past due notice on 1/23/15 and an overdue notice on 3/3/15 and a 14 day demand on 4/9/15 and no response from the customer. Since the turnover date for collections is very soon, I am willing to settle for $200.00 as payment in full, provided we receive payment by 5/20/15.Sincerely,[redacted]Publisher

left her a message on her voicemail (since she didn't answer her phone) that I
was very sorry that I could not cancel an ad that was already printed on Friday
at noon and that I would be willing to set up a payment planShe never called
backI left her another message on 10/7/after my delivery person delivered
the publicationsHe tried to talk to her also and she hung up on himOn
10/8/I called and left her another message that I cannot take an ad out of
the paper once it's printed, but I can remove it from the online edition and
give her a discountShe called me on 10/8/and screamed at me to not call
