S.E. Smyth Landscaping

Review: Contact SE Smyth in April 2012 re: cutting my lawn. Stated price would be $30 per cut ($32.10 with tax). Check sent for first 10 cuts and subsequently for additional cuts throughout summer.

April 11, 2013: Sent check for first 10 cuts. Contacted SE Smyth by phone to be sure price was still the same and that he was onboard for cuts. Checks sent subsequently for additional cuts throughout the summer.

March 2014: Sent check for first several cuts. Checks sent subsequently for additional cuts throughout the summer.

April 7, 2015: Sent check #[redacted] for first 10 cuts. Check cashed (see attached). Contacted by e-mail on 5/5/15 to see if they would be cutting my grass by the end of the week. They responded at 8:39PM that evening to say that they would. Contacted them by phone on 5/8/15 when grass still was not cut. Left message asking for return call. No return call. Wrote letter Sunday, May 10, 2015 firing them and asking for return of $321. Letter mailed certified mail. They showed up 5/11/15 in the morning to cut the grass.

As of 5/21/15 the Certified mail has not been claimed. On 5/21/15, I attempted to send another letter stating the same thing as the previous letter to the fax number listed on the website, but it’s not in service. I mailed the letter instead on 5/21/15 and also e-mailed them and said I was going with another company and asking them to return $288.90 to me. There’s been no reply to date.Desired Settlement: Refund of $288.90.
