My name Is Scott W***, owner of Scotfs Home ImprovementThis letter is in referenceto a complaint filed against me ID#***The customer's complaint is based off of an initialproposal that was drawn up as an estimate of work to be completedBefore beginning the work, Iproceeded to draw up
a more detailed contract; she refused this and just wanted the job startedTheinitial proposal includes no timeline for the completion of the job, not to merition a number ofunforeseen circumstances would have greatly impacted our ability to complete the job within anyoutlined time constraintWithin her complaint, the customer states that half of one tree is left and thatis far from the truthOne tree has been completely cut down to the stump, and the other has had allbranches removed along with at least % of the trunk of the treeThe initial prjsposal stated anagreement to cut down the trees without stump removal or mention of debris removal; the customertold me she would be burning the wood in her wood stove that she uses to heat her home in the wintertimeEquipment rental was included in the initial estimate, but due to the hcjmeowner instructing thecompany to drive the ton lift through a soft, muddy driveway and leave it parked in an area that wasfar from solid, we spent nearly days digging the machine out; this cost us a bill from Sunbelt rentals ofapproximately $along with additional time away from cutting down the treesI asked both herand the company to contact me prior to having the machine delivered so I could protect the drivewayand yard from being damaged due to the weight and condition of the property; I was not contacted.Therefore not just days were wasted due to no one informing me that the machine was there beingdelivered, but it made my working conditions unsafe and dangerous costing nie another hours oflabor due to unsafe conditions where the machine was either inoperable or not level, slowing the workdown by or days from what it would of taken if the machine was placed properlyThe customer isrequesting settlement of a refund for not all work being completed, but the fact of the matter is thatone tree has been taken down to the stump and the other there is maybe a foot trunk of the treeleft with the other feet of the tree cut downThis portion of the tree was tied off in order to protectthe home of the customer, due to intense wind conditions it was difficult to determine where the treewould fell and I had full intention to return to finish cutting this tree down after improved weatherconditionsIt was not until after she called, berating me about the time it has been taking for this joband telling me not to come back and she would have someone else do it, that I made the decision tostay away from the propertyKeep in mind that these trees were both approximately feet tall withbases of about feet in diameter; an accurate price to remove each tree should have been about$3,to $4,each due not only to their size but also the fact that there w^ only a 12xfoot placeto drop the trees due to the location of the trees that were towering over the house, trailer, fence andpower linesIt cost me $1,for the rental of the equipment therefore her payment of $1,wasn'teven close to the cost of the money for the machine rentalThe homeowner called me on the phoneday from the time that I started the job and on a daily basis and I was only trying to do her a favor forthe price I gave her and refuse to let anyone treat me the way she didIt cost me and another workerboth plus hours of back breaking labor trying to dig out a ton piece of machinery and the $1,000that she paid me wasn't even 1/of the cost of the piece of the equipment, gas and the labor to pay oneguy for the plus hours that we were there cutting down these trees and digging it out from where thehomeowner had the machine stuck and inoperableIn response to her gratefulness to Sunbelt rentalsfor fixing the damage to her driveway, this was done only after I spent additional time on the phonewith the company to hold them accountable for that damage since they did not call me to let me knowthey would be delivering the equipment and I was not there when they arrivedI completed themajority of the job that I agreed to do with intention of completing it fully, ev^ after her constantharassing, I also negotiated with the rental company in order to repair the damage done to thedriveway, all for a fraction of what someone else would have chargedI don't feel as though I owe her arefund for her decision to terminate.Sincerely,
