We were glad to help [redacted] improve his pond. However, the verbal contract made between us did not guarantee that it would hold...
water. We were contracted to run machines by the hour to improve the pond. Soils in our area vary greatly. Some have the structure to hold water and some do not. For that reason, we do not guarantee any pond we build to hold water. Richards pond did not hold water before we worked on it and it was made clear before we worked on it that there was no guarantee it would hold. This pond, as with every pond we build, was built using the desired methods to make it hold water, however, we cannot change the materials available. We would be glad to resolve the issue by further investigating the problem at the owners expense. We feel that we performed the work we were contracted to do.

There is no need to assume anything. We discussed, as with every other customer we build a pond for, the fact that there was a chance it would not hold. All we could do was try. There was no guarantee made. This was discussed prior to working on the pond. No assumptions were necessary because it was made clear, before the work started, that it might not hold. For that reason, we don't think we should be held responsible for fixing it. Again, we would be glad to attempt to reseal the pond, but at the owner's expense.

We do not accept this as the Hughes brothers dug a pond for our neighbor and it is holding water and they went to the bottom just like our pond. We just do not believe that Any Company would dig a pond for water and not expect it to hold water.What kind of racket is this.You think people just throw money away on digging a pond for water.Maybe to you $2500.00 is not a lot of money but for a retired person it is. I guess the television [redacted] contact division should be asked if this is what companies do.We stand by our decision that it should be redug but Not at our expense!!
