We paid a significant amount of money to have extensive landscaping done to our backyard. The installation was not professional. Things were planted in the wrong place, several things died immediately after planting. They had young college students planting the trees and now they are dead or dying. They told us when we hired them that they "guaranteed" their work and gave a one year warranty. Yet now they won't honor it! We had an independent arborist from *** come out to give us their opinion. See below for the assessment from ***:
The Spruces are very poor specimen to start with and likely would have had some degree of stress regardless of how well planted they were. However, overall whoever did this work did a pretty poor job of installing them. There are important steps in the installation process that were skipped. Most trees were planted either to high or too low. There is also no mulch over the root systems of these trees which makes it nearly impossible to retain moisture in the soil which expedited the issues you see. I would guess that there was a lack of tree knowledge by whomever did this work. I would suggest replacing the outer (2) Spruces, digging up Arborvite by the walk and replanting at a proper level.

I understand their frustration but they didn’t follow our recommendations for care of the trees or pruning the surrounding plants until it was too late. We had excessively high temperatures last summer as well as very low rainfall which is the cause of the stress on these trees. I have tried explaining that multiple times. Though they likely did water, it wasn’t enough to counteract the heat. We typically have 5% or less die back on plant installation projects. However, on their project, there have been issues with over half of the material installed. All of which have been resolved until now.They are citing lack of mulch as a cause of stress. These trees were installed 11 months ago and the mulch has decomposed throughout the whole bed. That occurs naturally with all hardwood mulch.Another issue they are citing against us is the severed roots on the surface. All trees that are bought balled and burlapped are field grown and cut with a tree spade to be transplanted. Severed roots are unavoidable. It was not our intention for the surface roots to be exposed and they were not exposed when installed nor were they exposed on any of my follow up visits.Our warranty states the following - “One (1) year warranty for woody plants and hardscapes. Thirty (30) day warranty on perennials. One (1) day on sod and seed. ONE (1) time replacement or repair. Weather, Acts of God, improper watering/care excluded.” Based upon the facts of this project, their claim is not valid for warranty replacement.I don’t recall a time in the past eleven years that I denied a warranty claim because things do happen. Plants die from time to time for any number of reasons. However, we always strive to make the situation right for our customers.
