This tenant has rented from us since 9-28-2010. The lease was month to month after the first year. We never raised her rent one time during this period. We have a full set of before pictures we are happy to provide as well as the full set of...
after pictures when she vacated the property. It is clear why we will not release her deposit. Stated in the lease agreement(item #12) states the Landlord has a right at all reasonable times during the term of the lease to to enter the premise for the purpose of inspecting the property and appurtenances. The Tenant agrees Landlord may "show" the property to prospective tenants, buyers or contractors as needed. We gave over a 72 hour notice to do this inspection,not to vacate. #12 states we will not LIST the property for sale with a company while tenant is living in the property. We did NOT list the property for sale but were approached with an offer by a contractor to possibly purchase the property. After the inspection and viewed the incredible amount of damage to the property we concluded it was best to sell to the contractor. We issued 30 day notice to vacate the property(per lease agreement) via email and certified mail according to the lease agreement.

I took pictures of the property when I was last in it, on Oct. 28. I also had a friend who is a former landlord walk through the property with me. He also took pictures. The property is not damaged. It does have wear and tear consistent with tenants living in a rental house for six years with minimal upkeep by the landlord.
